Source text - Arabic حيث تتحصل واقعات الدعوى في أن المدعية أقامتها أمام هذه المحكمة بموجب صحيفة مستوفاة لشرائطها القانونية أودعت قلم الكتاب في 21/7/2018 وأعلنت للمدعي عليها قانونًا بغية الحكم بصحة توقيعها على المحررات العرفية المؤرخة 23/6/2018، 2/7/2018، 10/7/2018 وإلزامها بالمصروفات وأتعاب المحاماة، وقدمت سندًا لدعواها أصل المحرر (عقود البيع المؤرخة 23/6/2018، 2/7/2018، 10/7/2018)، وحيث تداول نظر الدعوى بالجلسات ومثلت المدعية بوكيلها (محام) وقدم أصل الصحيفة منفذ وحضرت المدعي عليها شخصيًا والتي أقرت بصحة توقيعها على المحررات موضوع الدعوى وقررت المحكمة إصدار حكمها بجلسة اليوم، وحيث أن المقرر وفقًا لما جرى به نص المادة 45 من قانون الإثبات أنه يجوز لمن بيده محرر غير رسمي أن يختصم من يشهد عليه ذلك المحرر ليقر بأنه بخطة أو بإمضائه أو بختمه أو ببصمة إصبعه ولو كان الالتزام الوارد به غير مستحق الأداء ويكون ذلك بدعوى أصلية بالإجراءات المعتادة كما جرى نص المادة 46 من ذات القانون أنه إذا حضر المدعي عليه وأقر أثبتت المحكمة إقراره وتكون جميع المصروفات على المدعي، وكانت دعوى صحة التوقيع وعلى ما جرى به قضاء محكمة النقض ليست إلا دعوى شخصية تحفظية شرعت ليطمئن من بيده عرفي على آخر إلى أن الموقع على ذلك السند لن يستطيع بعد صدور الحكم بصحة توقيعه أن ينازع في صحته ويمتنع على القاضي الذي ينظر دعوى صحة التوقيع أن يتعرض للتصرف المدون في الورقة من جهة صحته أو بطلانه وتقرير الحقوق المترتبة عليه فالغرض المستهدف منها إثبات أن التوقيع الموضوع على المحرر هو توقيع صحيح صادر من يد صاحبه.

وحيث لما كان ما تقدم وكان الثابت من مطالعة المحررات العرفية موضوع الدعوى أنها مذيلة بتوقيع منسوب صدوره للمدعي عليها التي حضرت شخصيًا وأقرت بصحة ذلك التوقيع المنسوب إليها ومن ثم تقضي المحكمة بإجابة المدعية لطلبها على نحو ما سيرد بالمنطوق، وحيث أنه عن المصاريف فالمحكمة تلزم بها المدعية عملًا بنص المادة 46 من قانون الاثبات.
Translation - English Whereas the Claim facts is summarized in that the Plaintiff filed such Claim before this court under a legal statement of claim archived with the clerk of the Court on 21/07/2018 and legally announced to the Defendant in order to judge under validation of her signature on customary documents dated on 23/06/2018, 02/07/2018, and 10/07/2018 with obligating the Defendant to pay the expenses and attorney fees.
She submitted authentically (sale contracts dated on 23/06/2018, 02/07/2018, and 10/07/2018) as a support for the lawsuit.
Lawsuit has been circulated deliberated in sessions and the Plaintiff was represented by an attorney and he presented the authentic statement of claim and the Defendant attended personally and declared the validation of her signature on the contracts, subject matter herein, and the court to set the case for adjudication on today's hearing;
Whereas the stipulated terms in accordance with article No. 45 of law of evidence provide that person who has a non-authentic contract, he shall filed a lawsuit against the witness of that contract so that he can declare that it is written in his handwriting, signature, stamp, or his fingerprint even it contains non due obligation. This shall be executed under an authentic lawsuit within the usual measures as stipulated in text of article No. 46 of the said law that in case the Defendant attends and declared, court shall prove his declaration and Plaintiff must be liable to all expenses….;
According to all mentioned above, the lawsuit was lifted and the Court of Cassation judged that it is a personal and conservative lawsuit legitimated in order to reassure all who possess a customary conventional authority. Moreover, the signatory on this above mentioned contract shall not, after issuing the judgment with the validation of his signature, dispute over his validation. Judge who reviews the lawsuit of validation of signature shall not judge the signature written in the contact concerning its validation or invalidation and shall issue any judge concerning the resulted rights as the aimed purpose from the said lawsuit is the proof that the signature of the contract is valid and is written by his owner hand.

Whereas because of the above and of the approved from reviewing the customary contracts, subject matter herein, that it is concluded by a signature this it is said to be issued from the Defendant who attended personally and declared the validation the said signature so as the court judges to answer the request of the Plaintiff as the wording of the court sentence says.

Safety Instructions
WARNING: This chapter contains important safety and operating instructions.
Read and keep this manual for future reference.
1. Please be clear which kind of battery system you want, lithium battery system or lead-acid battery system, if you choose the wrong system, energy storage system can’t work normally.
2. Before using the unit, read all instructions and cautionary marking on the unit, the batteries and all appropriate sections of this manual. The company has the right not to quality assurance, if not according to the instructions of this manual for installation and cause equipment damage.
3. All the operation and connection please professional electrical or mechanical engineer.
4. All the electrical installation must comply with the local electrical safety standards.
5. When install PV modules in the daytime, installer should cover the PV modules by opaque materials, otherwise it will be dangerous as high terminal voltage of modules in the sunshine.
6. CAUTION-To reduce risk of injury, charge only deep-cycle lead-acid type rechargeable batteries and lithium batteries. Other types of batteries may burst, causing personal injury and damage.
7. Do not disassemble the unit. Take it to a qualified service center when service or repair is required. Incorrect re-assembly may result in a risk of electric shock or fire.
8. To reduce risk of electric shock, disconnect all wirings before attempting any maintenance or cleaning. Turning off the unit will not reduce this risk.
9. NEVER charge a frozen battery.
10. For optimum operation of this inverter, please follow required spec to select appropriate cable size. It’s very important to correctly operate this inverter.
11. Be very cautious when working with metal tools on or around batteries. A potential risk exists to drop a tool to spark or short circuit batteries or other electrical parts and could cause an explosion.
12. Please strictly follow installation procedure when you want to disconnect AC or DC terminals. Please refer to INSTALLATION section of this manual for the details.
13. GROUNDING INSTRUCTIONS -This inverter should be connected to a permanent grounded wiring system. Be sure to comply with local requirements and regulation to install this inverter.
14. NEVER cause AC output and DC input short circuited. Do NOT connect to the mains when DC input short circuits.
15. Make sure the inverter is completely assembled, before the operation.

1. يُرجى توضيح أي نوع من أنظمة البطاريات تريدها، بطارية ليثيوم أو بطارية رصاص حمضية حيث إذا استخدمت النظام الخاص فإن نظام تخزين الطاقة قد لا يعمل بشكل طبيعي.
2. قبل استخدام هذه الوحدة، اقرأ كافة التعليمات والعلامات التحذيرية الموجودة على الوحدة والبطاريات وكافة الأجزاء المناسبة لهذا الدليل. تملك الشركة الحق بعدم تقديم ضمان الجودة في حالة عدم الامتثال لتعليمات هذا الدليل أثناء التركيب وتسبب في تلف المعدات.
3. يرجي تنفيذ كافة عمليات التشغيل والتوصيل من قبل مهندس كهربائي أو ميكانيكي مُحترف.
4. يتعين أن تتماشى كافة التركيبات الكهربائية مع معايير السلامة الكهربائية المحلية.
5. عند تركيب وحدات ألواح الطاقة الشمسية أثناء النهار، على عامل التركيب أن يُغطي وحدات ألواح الطاقة الشمسية بمواد غير منفذة للشمس وإلا فإنها ستكون في غاية الخطورة حيث أن هذه الألواح تكون ذات جهد عالي في ضوء الشمس.
6. تحذير-للحد من مخاطر الإصابة، اشحن فقط بطاريات الرصاص الحمضية ذات الدورة العميقة القابلة لإعادة الشحن وبطاريات الليثيوم. حيث أن الأنواع الأخرى من البطاريات من الممكن أن ينفجر ويُسبب أضرار وإصابات شخصية.
7. لا تقم بتفكيك الوحدة. اذهب بها إلى مركز خدمة مُتخصص عند الحاجة للخدمة أو الإصلاح. حيث أن إعادة التجميع الغير سليم من الممكن أن يؤدي إلى خطر الإصابة بصدمة كهربائية أو حريق.
8. للحد من خطر الإصابة بصدمة كهربائية افصل كافة الاسلاك الكهربائية قبل الشروع في الصيانة أو التنظيف. غلق الوحدة لن يُقلل من هذه المخاطر.
9. لا تقم بشحن بطارية مُجمدة أبدا.
10. للتشغيل الأمثل لهذا العاكس، يُرجى متابعة المواصفات المطلوبة لاختيار حجم الكابل المناسب. ومن الأهمية تشغيل هذا العاكس بطريقة صحيحة.
11. كن في غاية الحذر عند التعامل مع الأدوات المعدنية الموجودة على أو حول البطاريات. حيث يوجد مخاطر مُحتملة لإسقاط أداة لإحداث شرارة أو ماس كهربائي للبطارية أو أجزاء كهربائية أخرى ويمكن أن يتسبب ذلك في حدوث انفجار.
12. يُرجى اتباع إجراءات التركيب بدقة إذا أردت أن تفصل أطراف الطاقة المترددة أو المستمرة. يُرجي الرجوع لجزء التركيب من هذا الدليل للمزيد من التفاصيل.
13. تعليمات التأريض -يتعين أن يُوصل هذا العاكس بنظام أسلاك تأريض دائم. تأكد من الامتثال باللوائح والمتطلبات المحلية لتركيب هذا العاكس.
14. لا تقم ابدا بتوصيل مخرج تيار متردد مع مدخل تيار مستمر. لا تقم بتوصيل الأسلاك الرئيسية عند وجود دوائر قصيرة من مدخل التيار المستمر.
تأكد من أن العاكس مُجمع بشكل كامل قبل التشغيل.

هذه القوائم المالية مسؤولية إدارة الشركة، فالإدارة مسؤوله عن إعداد وعرض القوائم المالية عرضًا عادلا وواضحًا وفقًا لمعايير المحاسبة المصرية وفي ضوء القوانين المصرية السارية، وتتضمن الإدارة تصميم وتنفيذ والحفاظ على رقابة داخلية ذات صلة لمعايير المحاسبة المصرية وفي ضوء القوانين المصرية السارية، وتتضمن مسؤولية الإدارة تصميم وتنفيذ والحفاظ على رقابة داخلية ذات صلة بأعداد وعرض قوائم مالية عرضًا عادلًا وواضحًا خاليًا من أي تحريفات هامة ومؤثرة سواء ناتجة عن الغش أو الخطأ، كما تتضمن هذه المسؤولية اختيار السياسات المحاسبية الملائمة وتطبيقها وعمل التقديرات المحاسبية الملائمة للظروف.

Translation - English Administration Responsibility for the Financial Statements
These financial statements are the responsibility of the company’s administration. The administration is responsible for preparing and presenting the financial statements in a fair and clear manner in accordance with the Egyptian Accounting Standards (EAS) and in light of the applicable Egyptian laws; including the responsibility of the administration to design, implement and maintain internal control related to the preparation and presentation of financial statements in a fair and clear presentation clear of any significant and influential distortions whether resulting from fraud or error. Also, this responsibility also includes choosing and applying appropriate accounting policies and making accounting estimates appropriate to the circumstances.
Responsibility of the Auditor
Our responsibility is limited to expressing an opinion on these financial statements in light of our review of them. We conducted the auditing according to the Egyptian Auditing Standards and in light of the applicable Egyptian laws. These standards require the planning and performance of the audit to obtain adequate assurance that the financial statements are free of significant and influential errors.
The audit work includes performing procedures to obtain audit evidence regarding the values and disclosures in the financial statements. The chosen procedures depend on the personal judgment of the Auditor, including assessing the risks of significant and influential misstatement of the financial statements, whether resulting from fraud or error. Upon assessing these risks, the Auditor takes into account the internal control related to the establishment's preparation of the financial statements and the fair and clear presentation thereof in order to design audit procedures appropriate to the circumstances, but not for the purpose of expressing an opinion on the efficiency of the internal control in the facility. The audit process also includes evaluating the appropriateness of accounting policies and the important accounting estimations prepared with the knowledge of administration, as well as, the accurate presentation in the financial statements.

The employer has entered into financial agreement with an official financial establishment (Official Bank) which entails that all the employer’s financial rights, (and/or) due monies/ refunds including rights for compensation, bonds, claim, etc. arising, as per this contract agreement and all related (from time to time) consequential amendments, shall be transferred to the merit of the named official financial establishment (official Bank)
10- The insurances
The company shall at its own cost take out the following insurances with insurers acceptable to the employer and under one or more policies in such form and with only such exclusions and restrictions as the employer may approve, namely:-
a) Plan and contractor’s equipment- being coverage in respect of all risks of physical loss or damage, which may occur.
b) Workmen’s compensation- being coverage as required by the laws and regulations in the country.
c) Motor vehicle third party and passenger liability insurance.
11. Contractor’s Principal Obligations
In consideration of the payments to be made by the employer to the contractor as per this contract, the contractor hereby covenants with the employer to carry out and complete the works and to remedy defects therein in conformity in all respects with the terms, conditions and provisions of the contract.
12- Employer’s Principal Obligations
The employers hereby covenants to pay the contractor, in consideration of satisfactory carrying out and completion of the works and the remedying of defects therein, such sum or sums as shall become payable under the contract at documents at the times and in the manner in accordance with the contract.
We confirm our agreement to the terms, conditions and provisions of this form of agreement.
9.18 Mobilization
Mobilization as per the Project Manager requirements shall be agreed with the contractor and to be paid in accordance with sub clause 26.2 (b) of the condition of contract. Mobilization is making available and/or delivery and installation on site and/or reallocation if necessary of all temporary equipment, systems, services, facilities, resources, and all the preparatory works including but not limited to shop drawing time schedule etc.., necessary to enable construction to start and be maintained at the stipulated rates of progress according to terms and conditions governing the execution of the works.
9.19 Independent Site Survey and Progressive Surveys
Contractor shall allow for the provision of modern “Total Station” surveying equipment, properly calibrated, checked and certified on a programmed basis. Copies of calibration certificates shall be provided. Survey team members shall be properly trained in the use if said equipment. Verification of the initial site survey and every other month check of progressive surveys by the employer. Reports on aid survey verification shall be submitted every other month.

10- التأمينات
يتعين على المقاول أن يشترك على حسابه في التأمينات التالية لدى شركات التأمين المقبولة بالنسبة لصاحب العمل، وبموجب بوليصة تأمين أو أكثر بالصيغة وبالاستثناءات والقيود التي يعتمدها صاحب العمل، وهي
أ. معدات المقاول وأجهزته-على أن تكون التغطية التأمينية شاملة جميع المخاطر الخسارة المادية أو الضرر الذي قد يقع
ب. تعويض العمال-على أن تكون التغطية وفقا لما ينص عليه قوانين الدولة ولوائحها
ج. التأمين ضد سيارات الغير ومسئولية الركاب
11- التزامات المقاول الرئيسية
نظير المدفوعات التي سيدفعها صاحب العمل إلى المقاول بموجب هذا العقد، يتعهد المقاول بموجب هذا العقد لصاحب العمل بتنفيذ وإنجاز الأعمال المسندة إليه ومعالجة أي عيوب قد تظهر بها يما يتفق تماما من جميع النواحي مع شروط وأحكام العقد.
12- التزامات صاحب العمل الرئيسية
يتعهد صاحب العمل أن يدفع إلى المقاول، لقاء تنفيذ الأعمال على النحو الذي يرضي صاحب العمل ومعالجة العيوب التي قد تظهر بها، المبلغ أو المبالغ المستحقة بموجب هذا العقد وذلك في الأوقات وبالطريقة التي ينص عليها العقد.
إثباتا لما تقدم، نقر بقبولنا الشروط والأحكام الواردة باتفاقية العقد هذه.
9-18 توريد المعدات
يتم الاتفاق مع المقاول على توريد المعدات وفقا لمتطلبات مدير المشروع، ويتم السداد نظير هذه العمالة وفقا للبند الفرعي 26-2 (ب) من شروط العقد. والمقصود بتوريد المعدات هنا هو توفير و/ أو توريد وتركيب جميع المعدات المؤقتة والأنظمة والخدمات والمرافق وجميع الأعمال التحضيرية بالموقع و/ أو إعادة توزيعها إن لزم الأمر، ويشمل ذلك على سبيل المثال لا الحصر، الرسومات التنفيذية والمخطط الزمني وما إلى ذلك من الوثائق اللازمة للبدء في أعمال البناء، على أن يتم الاحتفاظ بها بمعدلات التقدم المرحلي المنصوص عليها وفقا للشروط والأحكام التي يخضع لها تنفيذ الأعمال.
9-19 مسح الموقع المستقل والمسوحات التقدمية
يتعين على المقاول أن يسمح بتوريد أجهزة مسح حديثة "محطة متكاملة"، على أن يتم معايرتها بالشكل الصحيح وفحصها واعتمادها على أساس مبرمج. ويجب تقديم نسخ من شهادات المعايرة. ويجب كذلك أن يكون الفريق المعني بأعمال المسح مدرب جيدا على الأجهزة والمعدات سالفة الذكر. ويتحقق صاحب العمل من المسح الأولي للموقع والفحوصات الشهرية للمسوحات المرحلية. ويجب تقديم التقارير الخاصة بفحص المسوحات المذكورة كل شهر.
