Source text - English The significance of addressing human rights abuses by the previous regime in the period after a peace agreement has been reached cannot be overemphasized. With human rights advocates pushing for accountability for crimes committed conflict resolution advocates worry that punishing the culprits might further splinter the society, thereby compromising reconciliation.
Punishment vs. rehabilitation is a challenging issue during all phases of conflict, not just after a peace agreement has been signed. While there is a real yearning on the part of guerilla leaders in Colombia for inclusion they see violence as the only way to get
involved in a Government from which they have been alienated by Liberals and
Conservatives. Over the years, however, these non-State agents have turned to illegal
activities including hostage-taking, arms, drug and human trafficking, to support
themselves. This, as we are only too aware, creates a real challenge: to recognize the
legitimate interests of the guerillas to establish that politics, as opposed to violence, is the way to resolve differences, while at the same time to strengthen the rule of law by
prosecuting criminals for their drug activities and kidnappings. How can both views be accommodated?
In Sierra Leone, the conundrum involved the issue of amnesty for the leader and founder of the main rebel group as the peace agreement was being negotiated. It was such an important case that it pushed then Secretary-General Kofi Annan to explicitly withhold United Nations support for the granting of amnesty to faction leaders for war crimes as an incentive for a peace deal. While the Secretary-General could not initiate sanctions against such leaders, the withholding of UN approval for amnesty sent a signal that the United Nations refused to be a party to such a deal. More importantly, since the Sierra Leone talks, the International Criminal Court has started its operations, making it possible to prosecute leaders for alleged crimes against humanity. This makes it even less likely that leaders can demand complete amnesty in return for signing a peace accord. It remains to be seen what the impact of the ICC will be on future peace negotiations.
The Good Friday Agreement in Northern Ireland, while containing a strong human rights component to govern future relations is silent on acknowledgment of past acts of discrimination against the Catholics in the region. The founding of the state was based on discrimination and, even now, the human rights provisions in the Agreement are “underimplemented.” In fact, over the years the emphasis has shifted from a focus on human rights to a focus on power-sharing. Perhaps the continuing low-level violence and tenuous implementation of the Agreement may be because the core of the conflict is still largely not discussable?
These cases go a long way towards illustrating how complex the trade-offs are in the
context of real world circumstances. As of this writing, no systematic analysis has been done as to whether or not amnesty leads to the undermining of rule of law or to the instability of peace agreements. These cases ultimately point to the need for such an analysis to be done —an answer is long overdue.

Al presionar los defensores de derechos humanos por la condena por los crímenes cometidos, a aquellos interesados en la resolución del conflicto les preocupa que castigar a los culpables pueda profundizar la brecha social comprometiendo así la reconciliación.
La cuestión castigo vs. rehabilitación presenta un desafío en todas las fases del conflicto, no sólo posteriormente a la firma del acuerdo de paz. Si bien existe un anhelo real de parte de los líderes de la guerrilla colombiana por lograr la inclusión, ellos ven la violencia como
único modo de llegar a involucrarse en un gobierno del cuál han sido alienados por
liberales y conservadores. Con el paso de los años, sin embargo, estos agentes no estatales han incurrido en actividades
ilegales incluyendo toma de rehenes y tráfico de personas, drogas y armas para
poder sustentarse. Esto, como bien sabemos, crea un verdadero desafío: reconocer el legítimo interés de las guerrillas en
lograr que la política en vez de la violencia sea el camino para resolver diferencias, mientras al mismo tiempo fortalecer la vigencia de la ley
enjuiciando a los criminales por los secuestros y el tráfico de drogas. ¿Cómo se pueden satisfacer ambas posturas?
En Sierra Leona, este problema se dio en el caso de la amnistía del líder y fundador del principal grupo de rebeldes mientras era negociado el acuerdo de paz. Fue un caso tan importante que obligó al entonces Secretario General Kofi Annan a retener explícitamente el aval de las Naciones Unidas al otorgamiento de amnistías a los líderes de otras facciones por crímenes de guerra, como incentivo para lograr un acuerdo de paz. A pesar de que el Secretario General no pudo iniciar sanciones contra tales líderes, la negación de aprobación dejó en claro que las Naciones Unidas no tomarían parte en un acuerdo de ese tipo. Más importante aún, desde las conversaciones en Sierra Leona, la Corte Criminal Internacional ha iniciado sus operaciones haciendo posible imputar a estos líderes por supuestos crímenes de lesa humanidad. Esto hace que sea aún menos probable que estos líderes puedan demandar amnistía completa a cambio de su firma en un acuerdo de paz. Todavía falta ver cual es el impacto que la CCI tendrá en las negociaciones de paz venideras.
El Acuerdo del Buen Viernes en Irlanda del Norte, si bien contiene un fuerte énfasis en derechos humanos para gestionar conversaciones futuras, no tiene intercesión en cuanto al reconocimiento de actos de discriminación en contra de los católicos de la región ocurridos en el pasado. La fundación del estado fue basada en la discriminación e incluso hoy en día las provisiones de derechos humanos en el acuerdo están "sub-implementados". De hecho, con el paso de los años el énfasis se ha trasladado de un enfoque en los derechos humanos a un enfoque en la distribución de poder. ¿Será tal vez que el continuo nivel de violencia y la tenue implementación del Acuerdo sea a causa de que el núcleo del conflicto continúa quedando mayormente fuera de la discusión?
Estos casos ayudan en gran manera a ilustrar cuán complejos resultan estos dilemas en el
contexto del mundo real. Hasta ahora, no se ha hecho un análisis sistemático para determinar si la amnistía lleva a depreciar el valor de la ley o a la inestabilidad en los acuerdos de paz. Estos casos ciertamente develan la necesidad de que tal análisis sea realizado - ha pasado demasiado tiempo sin conseguir una respuesta.
