LEI Nº 12.850, DE 2 DE AGOSTO DE 2013.
Define organização criminosa e dispõe sobre a investigação criminal, os meios de obtenção da prova, infrações penais correlatas e o procedimento criminal; altera o Decreto-Lei no 2.848, de 7 de dezembro de 1940 (Código Penal); revoga a Lei no 9.034, de 3 de maio de 1995; e dá outras providências.
A PRESIDENTA DA REPÚBLICA Faço saber que o Congresso Nacional decreta e eu sanciono a seguinte Lei:
CAPÍTULO I
DA ORGANIZAÇÃO CRIMINOSA
Art. 1o Esta Lei define organização criminosa e dispõe sobre a investigação criminal, os meios de obtenção da prova, infrações penais correlatas e o procedimento criminal a ser aplicado.
§ 1o Considera-se organização criminosa a associação de 4 (quatro) ou mais pessoas estruturalmente ordenada e caracterizada pela divisão de tarefas, ainda que informalmente, com objetivo de obter, direta ou indiretamente, vantagem de qualquer natureza, mediante a prática de infrações penais cujas penas máximas sejam superiores a 4 (quatro) anos, ou que sejam de caráter transnacional.
§ 2o Esta Lei se aplica também:
I - às infrações penais previstas em tratado ou convenção internacional quando, iniciada a execução no País, o resultado tenha ou devesse ter ocorrido no estrangeiro, ou reciprocamente;
II - às organizações terroristas internacionais, reconhecidas segundo as normas de direito internacional, por foro do qual o Brasil faça parte, cujos atos de suporte ao terrorismo, bem como os atos preparatórios ou de execução de atos terroristas, ocorram ou possam ocorrer em território nacional.

This law defines “criminal organisation” and provides regulations for criminal investigations, means of evidence collection, related criminal offences and criminal procedures; it alters Decree-Law # 2.848 from 7th December,1940 (Criminal Code); it revokes Law # 9.034 from 3rd May, 1995, and sets further provisions.
The PRESIDENT OF THE REPUBLIC
Let it be known that the National Congress decrees and I ratify the following Law:
CHAPTER I
ON CRIMINAL ORGANISATION
Article 1. This law defines criminal organisation and provides regulations for criminal investigations, means of evidence collection, related criminal offences and the criminal procedures to be applied.
Paragraph 1. Criminal organisation is the association of 4 (four) or more persons, who are organised structurally and characterised by the distribution of tasks, even if informally, aimed at obtaining advantages through the commitment of criminal offences of any kind, whether directly or indirectly, whose maximum punishment is above 4 (four) years, or is of a transnational nature.
Paragraph 2. This law also applies:
I – to the criminal offences provided by international treaties or conventions when the criminal execution is initiated in Brazil and the result has occurred or should have occurred abroad, or reciprocally;
II – to the international terrorist organisations, acknowledged as such under the rules of International Law abided by Brazil. Such an organisation's acts of support to terrorism, as well as preparation or execution acts of terrorism which occur or may occur in Brazilian jurisdiction make this law applicable to them.
