Regardless of the reason by which Party B resigns, Party B shall continue to keep, within two years after his or her departure (beginning from the date of his or her departure), the technical and business secrets s/he employs or learns during his or her tenure at Party A’s premise, those that belong to Party A or that belong to a third party but require Party A’s commitment for confidentiality obligations. Article 5 Restriction for Second Career
Party B promises not to practice any second career during his or her tenure at the premise of Party A. In particular, without the written consent of Party A, Party B shall not hold any position, including but not limited to partners, directors, supervisors, shareholders, managers, employees, agents, consultants and the like, at other economic organizations or social groups that produce and sell products of similar types or provide services of similar kinds.
Article 6 Carriers for Classified Information
The documents, materials, charts, notes, reports, letters, faxes, flash disks, CDs, instruments and any other forms of carriers logging Party A’s classified information, owned or kept by Party B as required by his or her job duties, belong to Party A, regardless of whether the classified information is of any commercial value or not.
Party B shall, at the time of departure or upon the request of Party A, return all the properties belonging to Party A and all the carriers that keep the classified information of Party A. None of the carriers and their duplicates shall be retained or transferred to any other person without consent.
