Source text - Indonesian Mekanisme nasional saat ini tidak mampu memastikan pemenuhan jaminan hak konstitusional bagi setiap warga negara tanpa diskriminasi atas dasar apapun. Kehadiran kebijakan daerah yang diskriminatif menyebabkan Indonesia semakin jauh dari cita-cita negara-bangsanya untuk menghadirkan kesejahteraan, keadilan dan kebhinekaan bagi semua.
Sebanyak 154 kebijakan daerah yang diterbitkan di tingkat provinsi (19 kebijakan), tingkat kabupaten/kota (134 kebijakan) dan di tingkat desa (1 kebijakan) antara tahun 1999 hingga 2009 menjadi sarana pelembagaan diskriminasi, baik dari tujuannya maupun sebagai dampaknya. Kebijakan daerah tersebut diterbitkan di 69 kabupaten/kota di 21 provinsi dan lebih dari setengah kebijakan daerah yang diskriminatif itu (80 kebijakan) diterbitkan nyaris serentak, yaitu antara tahun 2003 dan 2005. Jawa Barat, Sumatera Barat, Kalimantan Selatan, Sulawesi Selatan, Nusa Tenggara Barat dan Jawa Timur adalah 6 Provinsi yang kabupatennya paling gemar menerbitkan kebijakan daerah yang diskriminatif. Hanya ada 39 kebijakan daerah di tingkat provinsi (14 kebijakan), kabupaten/kota (22 kebijakan) dan desa (3 kebijakan) yang bertujuan memenuhi hak korban atas pemulihan.
Sebanyak 63 dari 154 kebijakan daerah tersebut secara langsung diskriminatif terhadap perempuan melalui pembatasan hak kemerdekaan berekspresi (21 kebijakan yang mengatur cara berpakaian), pengurangan hak atas perlindungan dan kepastian hukum karena mengkriminalisasi perempuan (37 kebijakan tentang pemberantasan prostitusi)., penghapusan hak atas perlindungan dan kepastian hukum (1 kebijakan tentang larangan khalwat), dan pengabaian hak atas perlindungan (4 kebijakan tentang buruh migran). Selebihnya, 82 kebijakan daerah mengatur tentang agama yang sesungguhnya merupakan kewenangan pusat dan telah berdampak pada pembatasan kebebasan tiap warga negara untuk beribadat menurut keyakinannya dan mengakibatkan pengucilan kelompok minoritas. Sembilan kebijakan lainnya merupakan pembatasan atas kebebasan memeluk agama bagi kelompok Ahmadiyah. Semua hak-hak yang dibatasi atau dikurangi ini merupakan hak-hak konstitusional yang dijamin bagi setiap warga negara Indonesia tanpa kecuali, terutama hak atas (a) kedudukan yang sama dalam hukum dan pemerintahan, (b) kebebasan menyatakan pikiran dan sikap sesuai dengan hati nurani, (c) penghidupan yang layak bagi kemanusiaan, (d) perlindungan dari ancaman ketakutan untuk berbuat sesuatu yang merupakan hak asasi dan (e) bebas dari perlakuan diskriminatif.
Kebijakan yang diskriminatif lahir dari praktik pengutamaan demokrasi prosedural. Praktik ini mengandung unsur eksplotasi ketidaksempurnaan mekanisme partisipasi dan akuntabilitas publik dan pembiaran tirani “kehendak mayoritas” lokal, yang berjalan selaras dengan politik pencitraan, kevakuman perlindungan substantif, serta pengerdilan kemandirian masyarakat akibat intervensi negara yang berlebihan dalam hal agama/moralitas. Pengutamaan demokrasi prosedural ini telah menyebabkan defisit kualitas demokrasi dan mengarahkan Indonesia pada kondisi kritis karena mempertaruhkan bangunan negara-bangsa Indonesia.
Kebijakan daerah yang diskriminatif juga telah menyebabkan pengikisan wibawaan dan kepastian hukum. Kondisi ini hadir sebagai akibat dari kebijakan daerah yang berisikan pengaturan yang tidak efektif, bahkan juga ada yang sia-sia, dan membuka celah korupsi dan penyalahgunaan wewenang. Juga, karena kebijakan daerah yang diskriminatif melakukan kriminalisasi dan pemiskinan terhadap perempuan serta menciptakan “polisi moral” yang tidak segan menggunakan kekerasan terhadap anggota masyarakat, khususnya perempuan atasnama pelaksanaan kebijakan daerah itu.
Sistem ketatanegaraan yang berlaku saat ini belum mampu mencegah dan mengatasi persoalan-persoalan yang ditimbulkan oleh kebijakan daerah yang diskriminatif. Departemen Dalam Negeri dan Mahkamah Agung belum menunjukkan kepemimpinan dalam menjalankan fungsi pengawasannya. Sementara itu, Mahkamah Konstitusi tidak dapat menyentuh kebijakan daerah yang melanggar konstitusi.
Atas dasar temuan-temuan di atas, Komnas Perempuan mengajukan 20 rekomendasi, antara lain kepada:
• Presiden RI terpilih agar segera membatalkan demi hukum semua kebijakan daerah yang diskriminatif dan melanggar hak-hak asasi warga negara, sebagaimana dialami oleh perempuan dan golongan minoritas, atas dasar tanggung jawab negara untuk pemenuhan HAM
• Ketua Mahkamah Agung agar meningkatkan daya tanggap Mahkamah Agung terhadap permohonan-permohonan uji materil dari masyarakat terkait perda-perda diskriminatif dan, demi hukum, batalkan semua perda yang diskriminatif dalam maksud ataupun dampak.
• MPR agar menyelenggarakan amandemen UUD Negara RI 1945 untuk menyempurnakan mekanisme nasional yang efektif menjamin pemenuhan hak-hak konstitusional bagi setiap warga negara tanpa kecuali, termasuk dengan memperluas kewenangan Mahkamah Konstitusi (MK) dalam uji konstitusional materi perundang-undangan agar sampai ke tingkat terendah di bawah UU dan memberi kewenangan baru bagi MK untuk menciptakan mekanisme constitutional complaint yang dapat diakses oleh setiap warga negara.
• DPR RI hasil Pemilu 2009 agar melakukan amandemen terhadap berbagai produk Undang-Undang yang kondusif bagi pembentukan perda-perda yang diskriminatif dan bertentangan dengan jaminan-jaminan konstitusional.
• Kepala Pemerintahan Daerah agar mengambil langkah proaktif untuk membatalkan Perda dan Ranperda, yang diskriminatif maupun yang berpotensi mengakibatkan diskriminasi terhadap perempuan dan kelompok minoritas, dalam kerangka pemenuhan jaminan konstitusional bagi setiap warga negara tanpa kecuali dan demi menjaga integritas hukum nasional, serta memperbaiki mekanisme penerimaan dan penanganan bagi pengaduan masyarakat tentang sikap dan perilaku aparat Satuan Pamong Praja dan, untuk Aceh, Wilayatul Hisbah, yang melakukan tindak pemerasan dan pelecehan seksual dalam menjalankan tugasnya
• DPRD Kabupaten/Kota Hasil Pemilu 2009 agar memperbaiki mekanisme partisipasi publik dalam seluruh proses perumusan kebijakan untuk memastikan akses yang sama bagi semua pihak yang berkepentingan dan untuk menjadikan penetapan kebijakan sebagai produk dari perdebatan publik yang demokratis.
• Komisi Nasional Hak Asasi Manusia agar meningkatkan efektifitas mekanisme HAM nasional dalam menangani segala bentuk diskriminasi yang dialami masyarakat sebagai pelanggaran HAM.
• Organisasi-organisasi masyarakat sipil agar meningkatkan kualitas dan cakupan pendidikan politik – termasuk pendidikan kewarganegaraan di sekolah-sekolah – dengan fokus pada jaminan-jaminan konstitusional dan untuk membangun resiliensi masyarakat terhadap bahaya politisasi identitas.

The Institutionalization of Discrimination within Indonesian Governance
The current national mechanism has failed to keep its accountability in assuring the fulfillment of the constitutional rights for its citizens without discrimination on any justification. The presence of discriminative local policy has driven Indonesia away from its nation-wide vision to bring welfare, justice and harmony for all.
As many as the issued 154 local policies on provincial (19 policies), district/city (134 policies) and village levels (1 policy) in between the year of 1999 and 2009 have become a means for institutionalizing discrimination, by purpose and impacts. Those local policies were issued in 69 districts/cities within 21 provinces where more than a half of their discriminative local policies (80 policies) were ruled almost simultaneously, that is between the year of 2003 and 2005. West Java, West Sumatera, South Kalimantan, South Sulawesi, Nusa Tenggara Barat and East Java are the six provinces where their districts have shown the frequent trend of issuing the discriminative local policies. There are only 39 local policies on provincial (14 policies), district/city (22 policies) and village levels (3 policies) expressing their goals to fulfill victims’ right to recovery.
There are 63 local policies out of the 154 which practice straight discrimination toward women through the restriction upon the right to freedom of expression (21 policies on dress code), the decline of the right to law protection and security by woman criminalization (37 policies to end prostitution), the eradication of the right to law protection and security (1 policy to prohibit khalwat), and the disregard of the right to protection (4 policies on migrant worker). The rest of them, the 82 policies rule the religion practice which authorization should lie only in the hand of the central government. This kind of policy affected on the restriction of citizens’ freedom to practice their religion and on the isolation of the minority groups. The other nine policies take form in the restriction to hold and practice religion for Ahmadiyah group. All rights being restricted and declined are the constitutional rights that ought to be secured for every Indonesian citizen without exception, particularly the rights to (a) equal position in the face of law and government, (b) express one’s thought and attitude according to one’s conscience, (c) proper living, (d) protection from the fear of intimidation to act on one’s right and (e) be free from discriminative action.
Discriminative policies are produced from the practice of overstating the procedural democracy. Such practice contains the exploitation of the flawed public participation mechanism and accountability, and the laizes-faire of “majority expectation” local tyranny, hand in hand with the politic of image, the absence of substantive protection and the society’s dwindling independency as the consequence of State excessive interference upon religion/morality. The overstating procedural democracy has lowered democracy value and led Indonesia to a critical condition for risking its nation construction.
Discriminative local policies also caused the eroding dignity and security of law. This is seen as the result of ineffective and careless local policy ruling that had opened a door for power corruption and abuse. Moreover, these policies put into practice woman criminalization and impoverishment, create “moral police” whom voluntarily use violence against the citizens, especially women, on behalf of these policies.
The present governance system has not been capable of preventing and dealing with problems emerged from these discriminative local policies. The Ministry of Internal Affairs and the Supreme Court have yet shown the leadership role in executing their observing function. Meanwhile, the Constitutional Court has also failed to interfere with the local policies from violating the constitution.
Based on the aforementioned findings, Komnas Perempuan proposed 20 recommendations to, among many:
• The elected president of Indonesia, in the name of law, to without more ado withdraw all discriminative and human-right violating local policies, as suffered by women and minority groups, on the ground of State accountability for human rights fulfillment.
• The head of the Supreme Court to increase its responsiveness toward the proposals from the people for material review regarding the discriminative local regulations and, in the name of law, to withdraw all discriminative local regulations by purpose as well as by impacts.
• People’s Consultative Council to execute the 1945 Indonesian Constitution amendment to improve national mechanism in order to effectively secure the constitutional rights for all citizens without exception, including to advance the Constitutional Court authorization to perform constitutional review over law material to the lower levels than the Law, as well as to provide new authorization for the Constitutional Court to create a constitutional complain mechanism for every citizen to access.
• The House of Representatives elected from the 2009 general election to execute amendment over various Law products in favor of the local regulations that are discriminative and contradicting the constitutional protection.
• Leaders of the Local Government to take any proactive measurements to withdraw Local Regulations and the drafts, those that are discriminative or potentially discriminative toward women and minority groups, for the purpose of fulfilling constitutional protection for every citizen without exception and for guarding the national law integrity as well as for improving the mechanism of receiving and managing people’s report on the local security personnel’s (Satuan Pamong Praja) improper attitude and misconduct, and for Aceh context the Wilayatul Hisbah, for their exploitation and sexual harassment when performing their duty.
• The Local Representatives of District/City elected from the 2009 general election to improve public participation mechanism within the overall policy formulation process in order to ensure equal access for all relevant parties and to guarantee that all policy authorization is resulted from a democratic public debate.
• The National Commission on Human Rights to improve its effectiveness in national human rights mechanism in dealing with all forms of human-right violation discrimination suffered by the people.
• Civil Society Organizations to improve the quality and advance the scope of political education – including citizenship education in schools – with the focus on the constitutional protection and to develop community resilience against the danger in the politic of identity.

Financial Infrastructure broadly defined comprises
the underlying foundation for a country’s financial
system. It includes all institutions, information,
technologies, rules and standards that enable financial
intermediation. Poor financial infrastructure in many developing
countries poses a considerable constraint upon
financial institutions to expand their offering of financial
services to underserved segments of the population and
the economy. It also creates risks which can threaten the
stability of the financial system as a whole.
The World Bank Group is a leader in financial infrastructure
development in emerging markets, including
payment systems and remittances, credit reporting and
secured lending. Moreover, the World Bank Group is
intensifying its commitment to promote and disseminate
the policy and research debate on these and other
topics within the scope of financial infrastructure and
also plays the role of international standard setter in this
space.
Credit reporting systems are very important in today’s
financial system. Creditors consider information held
by these systems a primary factor when they evaluate
the creditworthiness of data subjects and monitor the
credit circumstances of consumers. This information
flow enables credit markets to function more efficiently
and at lower cost than would otherwise be possible.
This report describes the nature of credit reporting elements
which are crucial for understanding credit reporting
and to ensuring that credit reporting systems
are safe, efficient and reliable. It intends to provide an
international agreed framework in the form of international
standards for credit reporting systems’ policy
and oversight. The Principles for credit reporting are
deliberately expressed in a general way to ensure that
they can be useful in all countries and that they will be
durable. These Principles are not intended for use as
a blueprint for the design or operation of any specific
system, but rather suggest the key characteristics that
should be satisfied by different systems and the infrastructure
used to support them to achieve a stated common
purpose, namely Expanded Access and Coverage,
Fair Conditions, and Safe and Efficient Service for borrowers
and lenders.
Against this background, the standards are expected
to inform the action of authorities in this field, for example
central banks and banking supervisors in the
context of their supervisory function. It is further envisaged
that the standards would be useful to service
providers and system operators when designing or
modifying their product offerings, to financial intermediaries
when choosing to be a participant in any specific
system, and to end users when agreeing to use a
specific system.
The report has been prepared by a Task Force coordinated
by the World Bank, with support from the Bank
for International Settlements. The Task Force comprises
representatives from central banks and other financial
and privacy regulators, from multilateral organizations
involved in credit reporting and from international
credit reporting service providers. The Task Force also
benefited from the significant experience of the Credit
Bureau Team of the International Finance Corporation.
Some institutions (“Tier 2” Group), although not considered formally members of the Task Force, have been
actively consulted to provide inputs during the process
of preparation of the Principles. They include other industry
associations, private sector operators, scholars
and practitioners. The report was also released for public
consultation.

Introduction and Executive Summary
Well functioning financial markets contribute to
sustainable growth and economic development,
because they typically provide an efficient
mechanism for evaluating risk and return to investment,
and then managing and allocating risk. Financial infrastructure
(FI) is a core part of all financial systems. The
quality of financial infrastructure determines the efficiency
of intermediation, the ability of lenders to evaluate
risk and of consumers to obtain credit, insurance and
other financial products at competitive terms. Credit reporting
is a vital part of a country’s financial infrastructure and is an activity of public interest.
2. Credit reporting addresses a fundamental problem
of credit markets: asymmetric information between
borrowers and lenders, which may lead to adverse selection,
credit rationing, and moral hazard problems. Regulators and financial market participants are therefore increasingly recognizing the value of credit reporting
systems for improved credit risk and overall credit
portfolio management, to enhance financial supervision
and financial sector stability, and as a tool to enhance
access to credit.
3. In competitive markets, the benefits of credit reporting
activities are passed on to borrowers in the form of
a lower cost of capital, which has a positive influence on
productive investment spending.3 Improved information
flows also provide the basis for fact-based and quick credit
assessments, thus facilitating access to credit and other
financial products to a larger number of borrowers with
a good credit history (i.e. good repayment prospects).
4. While credit reporting systems are developing rapidly
across the world, there are no principles to systematically
guide the various stakeholders in dealing with the
challenges associated with the development and dayto-
day operation and improvement of these systems.
The Credit Reporting Standards Setting Task Force was
launched by the World Bank, with the support of the
Bank for International Settlements, to fill this critical
gap, aiming to provide a core set of general principles
to guide these efforts in any given jurisdiction.
5. The general principles are intended for policymakers,
regulators, financial supervisors, credit reporting
data providers, credit reporting service providers, the
users of such services, and individuals and businesses
whose credit histories and identification data are stored
in these systems (the latter two are referred to as “data
subjects” throughout the report). In addition to the
principles, the Task Force has also developed a set of
specific roles, one for each of the stakeholders in credit reporting systems, as well as recommendations for effective
oversight of credit reporting systems.

Aliran informasi yang telah berkembang juga memberikan dasar untuk penilaian kredit yang cepat dan berbasis fakta, sehingga memfasilitasi akses terhadap kredit dan produk-produk keuangan lainnya untuk jumlah peminjam yang lebih besar dengan riwayat kredit yang baik (yaitu prospek pembayaran kembali yang baik).
4. Meskipun sistem pelaporan kredit berkembang cepat di seluruh dunia, tidak ada prinsip-prinsip yang secara sistematis memandu beragam pemangku kepentingan (stakeholder) untuk menghadapi tantangan yang berkaitan dengan perkembangannya, operasi harian dan perbaikan sistem-sistem tersebut. Gugus Tugas Penetapan Standar Pelaporan Kredit yang diluncurkan oleh Bank Dunia dengan dukungan Bank untuk Penyelesaian Internasional, berusaha mengisi kesenjangan yang kritis ini dengan tujuan menyediakan seperangkat inti prinsip-prinsip umum untuk memandu upaya-upaya tersebut dalam yurisdiksi mana pun.
5. Prinsip-prinsip umum dimaksudkan untuk para pembuat kebijakan, regulator, pengawas keuangan, penyedia data pelaporan kredit, penyedia jasa pelaporan kredit, para pengguna layanan-layanan tersebut, para individu dan kalangan bisnis yang riwayat kredit dan data pengenalnya disimpan dalam sistem tersebut (dua yang disebut terakhir disebut sebagai “subyek data” di seluruh laporan ini). Sebagai pendukung prinsip-prinsip, Gugus Tugas juga telah mengembangkan seperangkat peran khusus, masing-masing satu untuk tiap stakeholder dalam sistem pelaporan kredit, serta rekomendasi untuk pengawasan yang efektif terhadap sistem pelaporan kredit.
