Between
JIANGSU GEOLOGY & ENGINEERING, a commercial registered located at Rua 29, Casa Nr. 159, Luanda Angola, represented by Mr. Daniel António Mário Gasona, qualified as a manager designated by JIANGSU GEOLOGY & ENGINEERING.
And
MARICEL SALES ATUBANG, Philippine nationality, holding a passport nr. EC5953876 valid until November 11, 2020, resident at nr. 21 Morobento, 21 de Janeiro Street, house nr. 259 designated as “Workers”
(The JIANGSU GEOLOGY & ENGINEERING And the worker are also confirmed designated on both parties)
And presented the labor agreement to the right terms and that governed by the following terms:
Clause Nr. 1
(Objective of the contract, profession and occupational category)
1. That the represented of this working contract, objective and presentation of the judicial subordination of the workers and JIANGSU GEOLOGY & ENGINEERING specifically exercise his/her functions of quality, safety and health as mentioned by JIANGSU GEOLOGY & ENGINEERING in this terms and for the effects of the Ordinance Nr. 70/01 of October 5 and Executive Nr. 31/03 of June 24.
2. The workers had carried out the functions that the interest of JIANGSU GEOLOGY & ENGINEERING Services.
Clause Nr.2
(Start working contract validity)
1. That the presented working contract will start 30 days after the concession of the working visa of the worker.
2. The validity of the contract and its conditions:
a. Concession of the working visa
b. Finish work given to the worker and other entity need the date of contract signature.
Clause Nr. 3
(Duration of labor agreement)
1. A contract had been finished within a period of one (1) year.
2. In case the party don’t communicate with his/her without notification or written within 15 days before the terms automatically renewed with a period of one (1) year maximum of six(6) months.
3. The duration of the contract accomplished temporary requirements for work agreement, not residents.
4. The worker assumes under its commitments, he/she obligatory to return to his/her country of origin after finish his/her contract will take effect.
Clause Nr.4
(Work Place)
1. Local work place situated in the facilities of JIANGSU GEOLOGY & ENGINEERING, Rua 29, Casa Nr. 159, Luanda, Angola.
2. In case of location outside Luanda, dislocation expenses will assumed by JIANGSU GEOLOGY & ENGINEERING.
Clause Nr.5
(Remuneration)
1. Work compensation, JIANGSU GEOLOGY & ENGINEERING paid the workers monthly salary of 200,000.00 (Monthly Basic Salary)
2. The payment of salary will be given at the end of the day of the month, cash or transfer to his/her open account at Banco BAI.
3. Monthly salary deducted to the workers:
a. No work justification
b. Work income tax
c. Contribution of Social security
d. Any deduction from judicial law decision.
Clause Nr. 6
(Work Schedule)
1. The normal period of worker’s work is 44 hrs per week and 8 hrs per day except one day off work and 4 hrs distribution internal dealing with the JIANGSU GEOLOGY & ENGINEERING.
2. JIANGSU GEOLOGY & ENGINEERING will be able to request to work for an excess time to work if emergency and pay an extra payment.
Clause Nr. 7
(Obligation of the Party)
3. Obligation of the Workers:
a. To render the work for which was contracted with dedication and discipline and work professionally for his/her specifically at work and can adopt Angolan work with maximum knowledge.
b. To teach knowledge and technical or scientific knowledge to Angolan workers.
c. To maintain professional relationship with respect to other workers.
d. To attend, on time of work and inform to JIANGSU GEOLOGY & ENGINEERING in case of premature time as soon as possible.
e. To accomplish the rules and regulations concerning safety, hygiene and medicine against fire protection and avoid harmful to people and goods.
f. To follow the instruction and other responsibilities from JIANGSU GEOLOGY & ENGINEERING.
g. Use appropriate property materials issued by the JIANGSU GEOLOGY & ENGINEERING and to protect the goods of the company against damage and loose.
h. To follow the general obligation imposed by the law and these established by JIANGSU GEIOLOGY & ENGINEERING within the organization.
4. Obligation of JIANGSU GEOLOGY & ENGINEERING:
a. Security of the workers from risk of accidents and diseases professionally.
b. Register workers in National Security during the 30 days of contract.
c. Treating consideration and respect to other worker.
d. To guarantee the workers to allow and enjoy rest day in a week and annual vacation guaranteed by law.
e. To pay regular, punctuality and remuneration pay for a total of 13 salaries per year.
f. To grant the worker free lodging, food, and transport.
g. To grant worker an annual trip/vacation to the Philippines with pay round trip ticket.
Clause Nr. 8
(Other worker’s duties)
With signature of the contract the worker assume the following obligations:
a. To keep professional secrecy and confidentially of the services within 36 months of work relationship and in case of violation of the referred duties, it is subject for penalty in accordance to the judicial procedures.
b. To keep loyalty not negotiating in work independently or alienates in competition in JIANGSU GEOLOGY &N ENGINEERING.
Clause Nr. 9
(Obligatory Annual Bonuses)
1. The worker is entitled to monthly bonuses of 50% of the base salary.
2. If the presented working contract does not reach of one (1) year, bonuses will be calculated proportionally at the time of work rendered added to one month.
3. Worker will have Christmas bonus of 50% and the monthly base salary.
4. Only with the contract reach one (1) year, Christmas bonus will calculated based on the base salary.
Clause Nr. 10
(Vacation)
1. The workers will have 22 useful days for vacation per year.
2. The worker will have one (1) year contract corresponding to the 6 working days.
3. In the moment of the end of the contract or renewed of one year, the worker have one (1) month vacation which can be paid in the term of contact.
4. The period of vacation have been marked the same agreement of the JIANGSU GEOLOGY & ENGINEERING and worker. JIANGSU GEOLOGY & ENGINEERING, mark completed the period of the said vacation.
Clause Nr. 11
(Working Extension Judicial Relationship)
1. The working contract can be cancelled any moment for:
a. Causes objectives, strange the will of the parties
b. Resolution for mutual agreement of the parties
c. Unilateral rescission of any parties in the terms with effects of the general working law.
2. The contract and the general law of work, the extinction of the judicial working relationship is fair for a discipline under article nr. 223 and the following general law of work, it is exempted JIANGSU GEOLOGY & ENGINEERING for payment of any indemnity compensation of worker.
Clause Nr. 12
(Resolution of Litigation, Conventional Forum and Applicable Legislation)
1. For the resolution of eventual current litigation of the interpretation or execution of the contract will be competent at the office of the Provincial Tribunal of Luanda.
2. All of these regulated by this contract had been applied in the general law of work.
3. The validity, application interpretation of the contract as well as any litigation among parties of the contract should be in all aspect exclusively governed and interpreted in an agreement of the law of the Republic of Angola.
4. The contract expresses the will of the contracting parties or any other hypothetical agreement or contradictory understanding with this term.
Having triplicate and all understanding signed by the parties, given to them a copy at the Center Job Area of JIANGSU GEOLOGY & ENGINEERING for the normal judicial procedure and effect.

MARICEL SALES ATUBANG, nacionalidade filipina, portadora do passaporte nr. EC5953876 válido até 11 de Novembro de 2020, residente nr. 21 Morobento, 21 de Janeiro Street, casa nr. 259 designados como "Trabalhadores"
(O JIANGSU GEOLOGY & ENGINEERING E o trabalhador também são confirmados designados em ambas as partes)
E apresentou o contrato de trabalho aos termos certos e que se regiam pelos seguintes termos:
Cláusula Nr.1
(Objetivo do contrato, profissão e categoria professional
1. Que o representado deste contrato de trabalho, objetivo e apresentação da subordinação judicial dos trabalhadores e da JIANGSU GEOLOGY & ENGENEERING especificamente exerçam suas funções de qualidade, segurança e saúde conforme mencionado por JIANGSU GEOLOGY & ENGENEERING nestes termos e para o efeitos da Portaria nº. 70/01 de 5 de outubro e Executivo Nr. 31/03 de 24 de Junho.
2. Os trabalhadores tinham desempenhado as funções que o interesse de JIANGSU GEOLOGY & ENGINEERING Serviços .
Cláusula Nr.2
(Comece a validade do contrato de trabalho)
1. Que o contrato de trabalho apresentado terá início 30 dias após a concessão do visto de trabalho do trabalhador.
2. A validade do contrato e suas condições:
a. Concessão do visto de trabalho
b. Concluir o trabalho dado ao trabalhador e outra entidade precisa da data da assinatura do contrato.
Cláusula Nr.3
(Duração do contrato de trabalho)
1. Um contrato foi concluído dentro de um período de um (1) ano.
2. Caso a parte não se comunique com ela SEM notificação ou escrita dentro de 15 Dias antes dos termos serem automaticamente renovados com um período de um (1) ano, no máximo, seis (6) meses.
3. A duração do contrato cumpriu requisitos temporários para contrato de trabalho, não residentes.
4. O trabalhador assume sob seus compromissos, ele / ela obrigada a retornar ao seu país de origem após o término de seu contrato terá efeito.
Cláusula Nr.4
(Ambiente de trabalho)
1. Local de trabalho situado nas instalações da JIANGSU GEOLOGY & ENGINEERING, Rua 29, Casa Nr. 159, Luanda, Angola.
2. Em caso de localização fora de Luanda, as despesas de deslocação serão assumidas pela JIANGSU GEOLOGY & ENGINEERING.
Cláusula Nr.5
(Remuneração)
1. 1. Remuneração do trabalho, a JIANGSU GEOLOGY & ENGINEERING pagou ao trabalhador um salário mensal de 200.000,00 (Salário Básico Mensal)
2. O pagamento do salário será feito no final do dia do mês, em dinheiro ou transferência para a sua conta aberta no Banco BAI.
3. Salário mensal deduzido aos trabalhadores:
a. Nenhuma justificativa de trabalho
b. Imposto sobre o rendimento do trabalho
c. Contribuição da segurança social
d. Qualquer dedução da decisão judicial.
Cláusula Nr.6
(Horário de trabalho)
1. 1. O período normal de trabalho do trabalhador é de 44 horas por semana e 8 horas por dia, exceto um dia de folga e 4 horas de distribuição interna, lidando com a JIANGSU GEOLOGY & ENGINEERING.
2. 2. A JIANGSU GEOLOGY & ENGINEERING poderá pedir para trabalhar por excesso de tempo para trabalhar em caso de emergência e pagar um pagamento extra.
Cláusula Nr.7
(Obrigação da parte)
3. Obrigação dos Trabalhadores:
a. Tornar o trabalho para o qual foi contratado com dedicação e disciplina e trabalhar profissionalmente para o seu trabalho especificamente e pode adotar o trabalho angolano com o máximo conhecimento.
b. Ensinar conhecimento e conhecimento técnico ou científico aos trabalhadores angolanos.
c. Manter relacionamento profissional com respeito a outros trabalhadores.
d. Para participar, no tempo de trabalho e informar a JIANGSU GEOLOGIA & ENGENHARIA em caso de tempo prematuro o mais breve possível.
e. Cumprir as normas e regulamentos relativos à segurança, higiene e medicina contra a proteção contra incêndios e evitar danos a pessoas e bens.
f. Para seguir as instruções e outras responsabilidades da JIANGSU GEOLOGY & ENGINEERING.
g. Use materiais de propriedade apropriados emitidos pela JIANGSU GEOLOGY & ENGINEERING e para proteger os bens da empresa contra danos e soltos.
h. Seguir a obrigação geral imposta pela lei e as estabelecidas pela JIANGSU GEIOLOGY & ENGINEERING dentro da organização.
4. Obrigação da GEOLOGY & ENGENEERING:
a. Segurança dos trabalhadores de risco de acidentes e doenças profissionalmente.
b. Registre os trabalhadores na Segurança Nacional durante os 30 dias do contrato.
c. Tratar consideração e respeito a outro trabalhador.
d. Garantir que os trabalhadores permitam e aproveitem o dia de descanso em uma semana e férias anuais garantidas por lei.
e. Pagar regular, pontualidade e remuneração para pagar um total de 13 salários por ano.
f. Para conceder ao trabalhador alojamento gratuito, comida e transporte.
g. Para conceder ao trabalhador uma viagem anual / férias para as Filipinas com o pagamento do bilhete de ida e volta.
Cláusula Nr.8
(Deveres de outros trabalhadores)
Com assinatura do contrato o trabalhador assume as seguintes obrigações:
a. Manter sigilo profissional e sigiloso dos serviços no prazo de 36 meses de relação de trabalho e em caso de violação dos deveres referidos, fica sujeito a multa em conformidade com os trâmites judiciais.
b. Manter a lealdade de não negociar no trabalho de forma independente ou alienar na competição em JIANGSU GEOLOGY & N ENGINEERING.
Cláusula Nr.9
(Bônus anuais obrigatórios)
1. 1. O trabalhador tem direito a gratificações mensais de 50% do salário base.
2. 2. Se o contrato de trabalho apresentado não atingir um (1) ano, os bônus serão calculados proporcionalmente no momento do trabalho prestado acrescido de um mês.
3. Trabalhador terá bônus de Natal de 50% e o salário base mensal.
4. 4. Somente com o contrato atingir um (1) ano, o bônus de Natal será calculado com base no salário-base.
Cláusula Nr.10
(Período de férias)
1. Os trabalhadores terão 22 dias úteis para férias por ano.
2. O trabalhador terá um (1) ano de contrato correspondente aos 6 dias úteis.
3. No momento do término do contrato ou renovada de um ano, o trabalhador tem um (1) mês de férias que pode ser pago no termo de contato.
4. 4. O período de férias foi marcado o mesmo acordo da JIANGSU GEOLOGY & ENGENEERING e trabalhador. JIANGSU GEOLOGY & ENGENEERING, marca completou o período das referidas férias.
Cláusula Nr.11
(Relação Judicial de Extensão de Trabalho)
1. Contrato de trabalho pode ser cancelado a qualquer momento para:
a. Faz com que objetivos, estranha a vontade das partes.
b. Resolução para acordo mútuo entre as partes.
c. Rescisão unilateral de quaisquer partes nos termos com efeitos da lei geral de trabalho.
2. 2. O contrato e a lei geral do trabalho, a extinção da relação de trabalho judicial é justa para uma disciplina sob o artigo nº. 223 e a seguinte lei geral de trabalho, isenta a JIANGSU GEOLOGY & ENGINEERING para pagamento de qualquer compensação de indenização do trabalhador.
Cláusula Nr.12
(Resolução de Litígios, Foro Convencional e Legislação Aplicável)
1. Para a resolução de eventuais litígios em curso da interpretação ou execução do contrato será competente no escritório do Tribunal Provincial de Luanda.
2. Todos estes regulados por este contrato foram aplicados na lei geral do trabalho.
3. A validade, interpretação da aplicação do contrato, bem como qualquer litígio entre as partes do contrato deve ser em todos os aspectos exclusivamente regido e interpretado em um acordo da lei da República de Angola.
4. O contrato expressa a vontade das partes contratantes ou qualquer outro acordo hipotético ou entendimento contraditório com este termo.
Tendo triplicado e todo o entendimento assinado pelas partes, dado a eles uma cópia na área de trabalho do Centro de JIANGSU GEOLOGY & ENGENEERING para o procedimento judicial normal e efeito.
