Quanto ai rilievi riguardanti la dichiarazione degli indagati di non avvalersi della facoltà di assistenza di un difensore alle operazioni di perquisizione e all'atto del sequestro, rilievi incentrati sul fatto che si tratterebbe di dichiarazione non supportata da adeguata consapevolezza proprio in ragione della mancata conoscenza della lingua italiana da parte degli indagati e dell'assenza di un interprete, è sufficiente osservare che l'art. 356 c.p.p. prevede unicamente la facoltà del difensore di assistere, se presente, a tali atti senza diritto però di essere preventivamente avvisato non potendo questi atti subire rallentamento: ne discende che se il difensore non è presente non occorre una dichiarazione di rinuncia alla sua assistenza affinché la polizia giudiziaria possa procedere nelle operazioni.
