Certificados de Origen. Establécense procedimientos para la aplicación y el control del cumplimiento de lo previsto por el Artículo 5º de la Resolución Nº 763/96 del ex Ministerio de Economía y Obras y Servicios Públicos. Cuestionario de Verificación de Origen.

VISTO el Expediente Nº S01:0388470/2005 del Registro del MINISTERIO DE ECONOMÍA Y PRODUCCIÓN, y
CONSIDERANDO:
Que el Acuerdo de Normas de Origen de la ORGANIZACIÓN MUNDIAL DEL COMERCIO (OMC), integra los Resultados de la Ronda Uruguay del ACUERDO GENERAL SOBRE ARANCELES ADUANEROS Y COMERCIO (GATT) de 1994 que fuera aprobado en nuestro país por la Ley Nº 24.425.
Que el objetivo de este Acuerdo es armonizar las reglas de origen no preferenciales a ser utilizadas para el control de importaciones sujetas a medidas de política comercial no preferencial, a fin que todos los países miembros de la ORGANIZACIÓN MUNDIAL DEL COMERCIO (OMC) apliquen una misma regla para determinar el origen de las mercaderías importadas.
Que encontrándose aún en trámite el mencionado proceso de armonización, cada país miembro de la citada Organización se encuentra habilitado para aplicar sus propias reglas de origen, independientemente de las que se establezcan en el país de exportación o del cual las mercaderías son procedentes.
Que hasta tanto concluya el programa de armonización en curso en la ORGANIZACIÓN MUNDIAL DEL COMERCIO (OMC), la REPUBLICA ARGENTINA aplica las disposiciones nacionales vigentes.
Que al respecto, la Ley Nº 22.415 (Código Aduanero), dispuso reglas para la determinación del origen de las mercaderías importadas para ser aplicadas en ausencia de disposiciones especiales, encontrándose facultado el MINISTERIO DE ECONOMÍA Y PRODUCCIÓN para establecer normas de origen para cierta especie de mercaderías a tenor de lo dispuesto por el Artículo 14, apartado 2 del citado cuerpo legal.
Que la Resolución Nº 763 de fecha 7 de junio de 1996 del ex–MINISTERIO DE ECONOMÍA Y OBRAS Y SERVICIOS PÚBLICOS establece la exigencia de presentación del certificado de origen para las mercaderías sujetas a distintos instrumentos de política comercial, tales como la aplicación de derechos antidumping, compensatorios, específicos y en los casos de medidas de salvaguardia.
Que el Artículo 5º de la resolución mencionada en el considerando anterior, dispone que se puede requerir que el certificado de origen indique que se ha cumplido la regla de origen aplicable a la mercadería correspondiente.
Que aun en los casos en que el origen de una mercadería se encuentre certificado por organismo habilitado en el país exportador, los criterios de calificación pueden diferir de los que se aplican en nuestro país, por lo que la sola presentación bajo el cumplimiento de los aspectos formales de un certificado de origen en el trámite de la importación, puede resultar insuficiente para determinar si en el país al que se atribuye el origen, se han cumplido las condiciones que permiten determinar si la mercadería en cuestión califica como originaria del mismo.
Que la elusión de las medidas antidumping y otras medidas de política comercial no preferencial se puede materializar mediante el envío de mercaderías a través de terceros países en los cuales no se efectúa una transformación sustancial de las mismas en los términos de las normas de origen aplicables en la REPUBLICA ARGENTINA.
Que la elusión mediante reexpedición, desviación o declaración falsa sobre el país de origen frustra la aplicación de las medidas de política comercial citadas en considerandos anteriores.
Que en muchos casos, el comercio internacional de mercaderías se realiza a través de países de tránsito, resultando necesario poder constatar el lugar de producción y los datos consignados en el mencionado certificado de origen.
Que por lo tanto, en caso de dudas sobre la validez de la certificación de origen, sobre la veracidad de los datos consignados en el certificado de origen exigido en los términos de lo dispuesto por la Resolución Nº 763 de fecha 7 de junio de 1996 del ex–MINISTERIO DE ECONOMÍA Y OBRAS Y SERVICIOS PÚBLICOS, o sobre las condiciones tenidas en cuenta para calificar a una mercadería como originaria de un determinado país, resulta necesario corroborar el origen declarado en el despacho de importación.
Que la constatación del origen de una mercadería resulta necesaria para determinar el correcto tratamiento arancelario a dispensar a las importaciones de la misma, por lo que puede resultar necesario disponer el inicio de un proceso de verificación de origen no preferencial.
Que asimismo, resulta conveniente establecer los procedimientos para la aplicación y el control del cumplimiento de lo previsto por el Artículo 5º de la Resolución Nº 763 de fecha 7 de junio de 1996 del ex–MINISTERIO DE ECONOMÍA Y OBRAS Y SERVICIOS PÚBLICOS.

Buenos Aires, June 26, 2007
IN LIGHT OF File No. S01:0388470/2005 on record of the MINISTRY OF ECONOMY AND PRODUCTION, and;
WHEREAS the Agreement on Rules of Origin of the WORLD TRADE ORGANIZATION (WTO) is part of the Results of the Uruguay Round of the GENERAL AGREEMENT ON TARIFFS AND TRADE (GATT) 1994, as approved in our country under Law No. 24,425;
WHEREAS the purpose of this Agreement is to harmonize the non-preferential rules of origin to be used in controlling exports subject to non-preferential trade measures in order for each country member of the WORLD TRADE ORGANIZATION (WTO) to apply the same rule on determining the origin of imported goods;
WHEREAS the harmonization process mentioned above is still pending, each member country of the aforementioned Organization is authorized to apply its own rules of origin, regardless of those established by either the export country or the country where goods come from;
WHEREAS until the harmonization program still pending in the WORLD TRADE ORGANIZATION (WTO) is completed, the ARGENTINE REPUBLIC shall apply its own current rules;
WHEREAS Law No. 22,415 (Customs Code) provides for rules on determining the origin of imported goods to be applied unless special rules apply, while the MINISTRY OF ECONOMY AND PRODUCTION is authorized to establish rules of origin as to certain types of goods under Section 14(2) thereof;
WHEREAS Resolution No. 763, issued on June 7, 1996 by the former MINISTRY OF ECONOMY AND PUBLIC WORKS, requires that a certificate of origin be submitted regarding goods subject to various trade instruments, including those related to antidumping rights, compensatory rights, specific rights, and protection measures;
WHEREAS Section 5 of the Resolution mentioned above provides that a certificate of origin may be required to specify whether the rule of origin applicable to the appropriate goods has been complied with or not;
WHEREAS even if the origin of goods has been certified by the authorized office in the export country, the rating criteria may differ from those applied in our country, thus the sole presentation complying with the formalities of a certificate of origin during the import process may not be sufficient to determine whether the rules in the alleged country of origin to determine if those goods come from any such country have been complied with or not;
WHEREAS avoidance of antidumping measures and other non-preferential trade measures may turn into shipping goods through third countries where such goods have not been substantially modified under the rules of origin applicable in the REPUBLIC OF ARGENTINA;
WHEREAS avoidance by means of reshipment, deviation, or misrepresentation as to the country of origin frustrates the application of the aforementioned trade measures;
WHEREAS on many occasions international trade is conducted in transit countries, hence it becomes necessary to verify the place of production and the information stated in the referred certificate of origin;
WHEREAS in the event of uncertainty regarding the validity of the certificate of origin, the veracity of the information stated therein, as required under Resolution No. 763, issued on June 7, 1996 by the former MINISTRY OF ECONOMY AND PUBLIC WORKS, or else regarding the conditions to be considered when rating goods as coming from a certain country, it is necessary to verify the origin stated in the clearance certificate;
WHEREAS verification of the origin of goods becomes necessary for determining the adequate tariff treatment to be afforded to their import, and as a result, it may be necessary to order that a verification of non-preferential origin process be commenced;
WHEREAS it is also convenient to establish the procedures for enforcement and obedience control of Resolution No. 763 Section 5, as issued on June 7, 1996 by the former MINISTRY OF ECONOMIC AND PUBLIC WORKS;
