The meeting opened at 5.40 p.m. with Bastiaan Belder, Vice-Chairman, in the chair.
1. Adoption of draft agenda (PE 358.790)
The draft agenda was adopted.
2. Approval of minutes of meeting of 23 February 2005 (PE 356.206)
The minutes were approved.
3. Chairman's announcements
The Chairman said that:
· The EU Council on 25 April had adopted conclusions on the Middle East Peace Process in
which it expressed concern at the lack of dynamism in the implementation of the Sharm el
Sheikh agreement. The Council reiterated that the Roadmap remained the main tool for relaunching
the Peace Process.
· The Joint Committee of the Interim Association Agreement between the European
Commission and the Palestinian Liberation Organisation (for the benefit of the Palestinian
Authority) would meet on 11 May in Brussels.
· The 4th EU-Israel Association Committee had been held on 14 April in Jerusalem at
senior officials’ level. This was the first Association Committee to be held since Israel and
the EU concluded the European Neighbourhood Policy (ENP) Action Plan in late 2004.
· A work programme to reinforce the Euro-Mediterranean Partnership over the next five
years had been adopted on 12 April by the European Commission in advance of the
10th anniversary of the Barcelona Process. In the Communication, the Commission had
outlined proposals for tangible progress in three priority areas: Education; Sustainable
Economic Growth; and Human Rights and Democracy.
4. Exchange of views on the draft programme and the draft agenda of the forthcoming
visit of a delegation from the Knesset on 23-24 May 2005 in Brussels
The following points were discussed:
- the possibility of organising a meeting with the Committee on Foreign Affairs,
- the limited number of Israeli Members,
- better political balance between Members,
- the possibility of Israel joining the EU,
- inclusion of water and environmental problems in the agenda,
- introduction by members of themes to be discussed.
Mr Belder undertook to discuss these points with the Chairwoman of the delegation.

5. Other business
The Chairman said that he had received some petitions. As the situation had never
occurred before, he suggested that the delegation bureau be the first to discuss what
procedure to follow.
6. ´ Date and place of next meeting
The next meeting would be held on 23 and 24 May 2005 in Brussels and would be devoted to
the meeting with the delegation from the Knesset.
The meeting closed at 6.30 p.m.

Le Président informe les membres:

Les remarques suivantes ont été faites par plusieurs députés:
- la possibilité d'organiser une rencontre avec la commission AFET,
- le nombre limité des députés israéliens,
- un plus grand équilibre politique parmi les députés,
- la possibilité de l'adhésion d'Israël à l'UE,
- l'insertion dans l'agenda des problèmes de l'eau et de l'environnement,
- l'introduction, par les membres, des sujets à discuter.

délégation.
5. Questions diverses
Le Président informe les membres des pétitions qu'il a reçues. Comme cette situation se
présente pour la première fois, il propose que ce soit d'abord le Bureau de la délégation qui
discute de la procédure à suivre.
6. Date et lieu de la prochaine réunion
La prochaine réunion aura lieu les 23 et 24 mai 2005 à Bruxelles, et sera consacrée à la rencontre
avec une délégation du Knesset.
La réunion est clôturée à 18 h 30.

Source text - English The European Commission has set out its plans for boosting cooperation between national research funding programmes. The new 'Joint Programming' scheme is designed to ensure that public research funds are used as efficiently as possible, and help Europe tackle shared problems more effectively. The first Joint Programming Initiatives should be launched by 2010.
Just 15% of public research funds in Europe are allocated at the European level, either through the EU's own framework programmes, or through intergovernmental organisations such as CERN (the European Organisation for Nuclear Research) or pan-European schemes like EUREKA. The remaining 85% is locked up in programmes which are designed and implemented nationally.
Currently, there is little collaboration between these national research programmes, although many of the challenges they address are shared by all European countries.
'Challenges such as food safety, healthcare, marine ecosystems and biodiversity, climate change and energy are not confined to Member States borders, so research should be done jointly, and not simply nationally,' explained EU Science and Research Commissioner, Janez Potocnik.
'National programmes are obviously necessary; however, in certain areas of strategic public interest, they can result in duplication and may lead to a shortfall in the critical mass of resources needed to make a significant impact. As we have difficulties in increasing our research investment to the Lisbon target of 3% of our GDP, we should increase the impact of our national investments by acting jointly.'
The new Joint Programming Initiatives will see Member States combine resources and monitor and review progress together. Membership of the initiatives will be entirely voluntary, and the emphasis will be on pooling public research funds (unlike the Joint Technology Initiatives, which combine public and private research funds).
Member States wishing to work together on a given issue will first have to set out a common, long term vision for the agreed area. On the basis of this, a Strategic Research Agenda (SRA) will be drawn up, which should contain clear, measureable and realistic objectives. Finally, the SRA will be implemented; in this stage, all Member States involved will be expected to align their national research programmes to the SRA.
The European Commission's role in all of this will be that of facilitator, although EU funds may be made available to certain initiatives depending on their added value and European dimension.
According to the European Commission, Joint Programming will enable researchers to find common answers to common problems.
'Joint Programming has the potential to become a mechanism at least as important as the framework programmes in the European research landscape and to change the very way in which Europeans think about research,' commented Commissioner Potocnik.
The plans will now be discussed by Europe's research ministers, who are expected to endorse the concept and objectives of Joint Programming by the end of the year. The ministers will then appoint a group of experts to identify the areas for which Joint Programming is most suitable.
This selection will be made on the basis of clear criteria; for example, the challenge to be addressed must be pan-European or global in scale, yet be sufficiently focused so that clear objectives can be set. Publicly funded research must be key to addressing the problem, and the initiative should help to overcome fragmentation and duplication of research efforts in the field concerned.
Eventually, the Council will officially launch the JPIs and monitor their progress.
The Joint Programming scheme is just one of five launched by the Commission as part of its plans to reinvigorate the European Research Area (ERA). The others concern the management of intellectual property by public research organisations; research mobility and research careers; pan-European research infrastructures; and international science and technology cooperation.

Au lieu de se limiter à une portée nationale, la recherche doit donc être réalisée à l'échelle communautaire», explique Janez Potocnik, le commissaire européen en charge de la science et de la recherche.
«Des programmes nationaux sont à l'évidence nécessaires; mais, dans certains domaines d'intérêt stratégique et public, ils peuvent conduire à des redondances et à une dispersion des ressources, et empêcher d'atteindre la masse critique nécessaire à un impact significatif. Nous avons des difficultés à augmenter notre investissement dans la recherche pour atteindre l'objectif de Lisbonne, fixé à 3% du PIB. Nous devons donc augmenter l'impact des investissements nationaux en agissant de manière conjointe.»
Les nouvelles initiatives de programmation conjointe (JPI pour Joint Programming Initiatives) devraient donc se traduire par une association des ressources des États membres et un suivi de l'évolution commun. La participation aux initiatives se fera de manière totalement volontaire, l'accent étant mis sur la mise en commun des fonds publics de recherche (à la différence des initiatives technologiques conjointes, qui associent des fonds publics et privés).
Les États membres qui souhaitent collaborer sur un thème donné devront d'abord en définir une vision commune et à long terme. Cette base servira à élaborer un agenda stratégique de recherche (ASR), qui devra présenter des objectifs clairement définis, mesurables et réalistes. Enfin, l'ASR sera mis en place. Lors de cette étape, tous les États membres concernés devront aligner leurs programmes nationaux de recherche avec l'ASR.
Le rôle de la Commission européenne consistera à faciliter le processus, même si des fonds de l'UE pourront être mis à la disposition de certaines initiatives, en fonction de leur valeur ajoutée et de leur dimension européenne.
D'après la Commission européenne, la programmation conjointe devrait permettre aux chercheurs de trouver des réponses communes à des problèmes communs.
«Pour la recherche européenne, la programmation conjointe a le potentiel de devenir au moins aussi importante que les programmes-cadres, et de changer la vision que les Européens ont de la recherche», commente le commissaire Potocnik.
Ces plans vont maintenant être étudiés par les ministres européens de la recherche, qui devraient avaliser le concept et les objectifs de la programmation conjointe d'ici la fin de l'année. Ensuite, les ministres nommeront un groupe d'experts chargé d'identifier les domaines auxquels la programmation conjointe est le mieux adaptée.
Ce choix sera fait sur la base de critères bien définis. Source text - English The Air-Intake Probe
Prior to the accident, Spanair reported that there was overheating of an air-intake probe. It has been reported by media that this was significant. As a result, it would be prudent to explain to you exactly what the air-intake probe is an what its relevance is to Spanair accident.
Another name for the air-intake probe is an outside air temperature (OAT) gauge, part of the air data computer (ADC). The ADC uses a number of components to calculate pressure and temperature of the outside air including air-intake probes. The output of these devices provides air data information necessary for safe, effective operation of the aircraft. The calculation of the pressure and temperature can result in assessing factors including:
- Speed (Mach, as well as indicated, true, calibrated, and equivalent airspeeds)
- Altitude
- Rates of climb or descent (altitude rate)
- Angle-of-attack (AOA) – the angle of the wing with respect to the flow of air
- Angle-of-sideslip (AOS) – effectively the angle of yaw.
Depending upon the specific design of the aircraft, there are varying numbers of these probes located on the outside of the fuselage, and they are often located around the cockpit, as was the case in Spanair’s MD-82. While failure of the entire ADC would most likely be an event which would have prevented a secondary attempted departure, there is redundancy built into this system, hence, a single probe failure would not compromise the safety of the aircraft. Spanair have confirmed that the faulty probe was turned off in accordance with MD-82 technical procedures. At this stage it can be assumed that the ADC was safe for flight and that it is very unlikely that the air intake probe failure influenced the catastrophic mechanical failure that appears to have taken place in the left engine.
However, the aborted first take off and additional ground running of the engines in the hot temperatures at Madrid may have aggravated an undiagnosed problem in the engines.
Possible Scenarios
At present there is differing opinion between eye witness accounts, video footage and official press statements as to the extent of the engine failure and/or pilot error.
Given that the CCTV footage also appears to show that the aircraft struggled to gain altitude, this would most likely have been caused by incorrect flap selection by the pilot, or loss of power in the engines.
In the event that there was incorrect flap selection by the pilots, the aircraft could have exhibited the movements observed by eyewitnesses. The purpose of takeoff flap is to alter the shape of the wing so that it provides more lift and has a lower stalling speed. Stalling speed is the speed below which the airflow over the wing becomes disturbed and lift is lost. In simple terms it is dependant on the speed of the aircraft and the shape of the wing. For a given wing shape (e.g. clean without flaps selected) if the speed of the airflow over the wing reduces, the angle of the wing to the relative airflow has to be increased to maintain lift. If the speed continues to reduce the wing will reach an angle of around 15 degrees to the relative airflow at which point the airflow over the top of the wing becomes disturbed and lift is lost. The speed at which this occurs is the stalling speed.

Elles sont souvent situées autour du cockpit, comme c’était le cas pour le MD-82 de Spanair. Si tous les ADC avaient été défectueux, cela aurait probablement empêché une deuxième tentative de décollage, mais ce système est redondant et ce n’est pas un seul et unique dysfonctionnement de sonde qui viendrait compromettre les conditions de sécurité de l’aéronef. La Spanair avait confirmé que la sonde défectueuse était éteinte conformément aux procédures techniques du MD-82. On peut imaginer qu’à ce stade, les ADC sont bons pour le vol et il est très improbable qu’un dysfonctionnement de la sonde de température d’air influe sur le problème technique catastrophique qui s’est apparemment produit dans le moteur gauche.
Cependant, l’échec de la première tentative de décollage et le temps supplémentaire de fonctionnement des moteurs au sol ainsi que la forte chaleur de Madrid ont peut-être aggravé un problème insoupçonné dans les moteurs.
Scénarios possibles
Les opinions divergent selon que l’on entende les témoignages, que l’on voie les images ou que l’on lise les déclarations de presse jusqu’à la question de savoir s’il y a eu une panne de moteur et/ou une erreur du pilote.
Étant donné que les images de CCTV confirment que l’avion a eu beaucoup de mal à prendre de l’altitude, on peut penser qu’il y a eu un mauvais positionnement des volets de la part du pilote, ou qu’il s’est produit une perte de puissance dans les moteurs.
Dans le cas d’un mauvais positionnement des volets de la part des pilotes, l’avion aurait pu effectuer les mouvements observés par les témoins. On actionne les volets de décollage afin de modifier la forme de l’aile pour augmenter la portance et ralentir la vitesse de décrochage. La vitesse de décrochage correspond à la vitesse en-dessous de laquelle les filets d'air qui passent au-dessus de l’aile se perturbent et on perd la portance. En d’autres termes plus simples, elle dépend de la vitesse de l’avion et de la forme de l’aile. Pour une forme d’aile donnée (par exemple pour une aile lisse, dont les volets ne sont pas déployés) si la vitesse de l’air qui passe au-dessus des ailes diminue, l’angle de l’aile par rapport au courant d’air doit être accentué pour maintenir la portance. Si la vitesse continue à baisser, l’aile atteint un angle d’environ 15 degrés par rapport au courant d’air à tel point que l’air qui s’écoule au-dessus de l’aile se perturbe et on perd la portance. La vitesse à laquelle ce phénomène se produit s’appelle la vitesse de décrochage.

There are two principle claims that every passenger or their family has:1. A claim against Spanair:This claim is a strict liability claim. This means that Spanair must pay money to all passengers or their families regardless of whether they did anything wrong. Passengers or their families are GUARANTEED TO RECEIVE SOME MONEY FROM SPANAIR. This claim is explained in section 1, below.2. A claim against the aircraft manufacturer or a component manufacturerCompensation awarded for this type of claim is often significantly larger than for the claim against Spanair, however, the claim can only be brought if sufficient evidence exists. This claim is explained in section 2, below.SECTION 1The Spanair Claim: On what grounds do I have a claim?There are a number of treaties that govern air travel throughout the world, providing favourable remedies to those injured or the families of those killed in air accidents. Normally these treaties specifically relate to international and not domestic air travel. Spanair flight JK5022 was a domestic flight from Madrid to Las Palmas. However, as a member of the EU, Spain has adopted EC regulation 2027/97. This regulation applies the treaties governing international air travel to air travel within a single Member state. Therefore, it is necessary to explain the rights under these treaties in order to explain the rights that passengers and their families have. The relationship between passengers and carriers, such as Spanair, has most recently been set out in an international treaty entitled the Montreal Convention. The Montreal Convention sets out certain obligations and liabilities that Spanair owes to its passengers. In particular (and apologies for the law), Article 17 of the Montreal Convention states the following:-“The carrier is liable for damages sustained in case of death or bodily injury of a passenger upon condition only that the accident which caused the death or injury took place on board the aircraft or in the course of any of the operations of embarking or disembarking.”This liability is a so-called “strict liability” meaning that passengers do not have to prove any fault on the part of Spanair. Spanair must pay passengers without the passengers needing to prove that they did anything wrong.Advance PaymentsEC Regulation 2027/97 sets out a requirement on Spanair to make advance payments to passengers or their families to meet immediate economic needs proportional to the hardship suffered. These payments should be made within 15 days from the date that the passenger has been identified. These payments DO NOT AFFECT YOUR CLAIM and you can accept them without fear of consequences. However, you should be careful if you are asked to sign anything in case the document purports to settle jurisdiction of your claim or relieves them of any liability. We would be happy to review any documents that you are asked to sign to ensure that they are not prejudicial to your claim.EC regulation 2027/97 and the Montreal Convention, employ a currency entitled Special Drawing Rights (SDRs). This is a unit of currency defined by the International Monetary Fund to currently be equal to approximately €1.067 Euro per SDR. The minimum advance payment that Spanair can make is 16,000 SDRs which equals approximately €17,070 Euros.

Ils offrent aux personnes blessées ou aux familles des personnes tuées dans les accidents d’avions des possibilités de recours. Normalement, ces traités portent spécifiquement sur le transport aérien international et non sur le transport aérien intérieur. Le vol JK5022 de Spanair était un vol intérieur de Madrid à Las Palmas. Le règlement CE 2027/97 oblige la Spanair à indemniser les passagers ou leur famille de manière anticipée afin qu’ils puissent subvenir immédiatement aux besoins économiques liés au préjudice subi. Ces paiements doivent être effectués dans les 15 jours à compter de la date à laquelle le passager a été identifié. Ces paiements N’ALTÈRENT EN AUCUN CAS VOTRE DEMANDE D’INDEMNISATION et vous pouvez les accepter sans crainte.
