The Magna Carta
One starting point is The Magna Carta of 1215. Historically , the magna carta represented a formal settlement between the Crown and the barons. The Charter represented settlement of the grievance of citizens and challenged the untrammelled powers of the King. The settlement provided for freedom of the Church, and the right of merchants to be free from exorbitant taxation. Today, the document’s importance lies in its declaration of the confirmation of the liberties enjoyed by “freemen of the realm” and their future protection, and in the protection to be given to the employment of those liberties by the requirement for trial by jury:
“No freemen shall be taken or imprisoned, or be diseased of his freehold, or liberties, or free customs, or be outlawed, or exiled, or any wise destroyed; nor will we pass upon him, nor condemn him, but by lawful judgment of his peers, or by the law of the land. We will sell to no man we will not deny of defer to any man either justice or right.”
While of little legal importance today- for much of the original Magna Carta has been repealed - the document has symbolic value as an early assertion of the limits of monarchical power and the rights of individuals.

Um ponto de partida é a Magna Carta de 1215. Historicamente a Magna Carta representa um acordo formal entre a Coroa e os Barões. O documento que está escrito representa o direito a reclamações dos cidadãos que desafiam o poder do rei que não era muito restrito. O acordo tinha como prioridade a liberdade da igreja, e o direito dos mercadores de serem livres de pagar taxas exorbitantes. Hoje em dia a importância dos documentos são sustentadas nestas declarações que confirmam a liberdade no qual beneficiam “ homens livres de tal domínio” e a futura proteção deles o qual será dada e que se regozijam no processo de requerimento dado pelos jurados.
“ Nenhum homem deverá ser preso ou pego, ou forçado a deixar o seu lar, sua liberdade, ou abandonar sua clientela, ou ser banido, ou exilado, ou em qualquer tipo de constrangimento; nem suas vontades sejam passadas por cima deles , nem será condenado, mas sim por julgamento legal dos seus nobres ou pelo direito de terra. Nós não venderemos a homem algum, nós não recusaremos ou adiaremos a qualquer homem o direito a justiça e a verdade.”
Apesar de pouca importância legal nos dias de hoje- o original da Magna Carta tem sido revogada- o documento tem apenas um valor simbólico como um fato recente dos limites do poder monárquico e direito dos individuais.
