Source text - German § 6 Haftung
1. Ist der Auftragnehmer infolge nachweisbarer Erkrankung oder aus sonstigen wichtigen Gründen verhindert, die vertragliche Leistung zu erbringen, hat er bei Eintritt der Verhinderung die Auftraggeber auf schnellstem Wege über seine Verhinderung zu informieren und die Gründe auf Verlangen nachzuweisen.
2. Führt höhere Gewalt zur Verhinderung des Auftragnehmers bzw. zur Nichtdurchführung der vom Auftraggeber geplanten Veranstaltungen werden beide Vertragspartner von ihren Leistungspflichten befreit. Als höhere Gewalt gelten beispielsweise akute Erkrankung des Auftragnehmers, Streik im Transportwesen, kriegerische Ereignisse, Stromausfall, außerordentliche Schließung von Banken und Geldinstituten, Naturkatastrophen u.ä.
3. Wird die Vertragserfüllung aus Gründen unmöglich, die der Auftragnehmer oder die Auftraggeber zu vertreten haben, kann der andere Teil Schadensersatz wegen Nichterfüllung verlangen. Ferner wird der andere Teil von der ihm obliegenden Leistung frei. Bei teilweiser Unmöglichkeit, die der Auftragnehmer zu vertreten hat, erhält dieser lediglich einen seiner erbrachten Leistung entsprechenden Teil der vereinbarten Vergütung, während er eine von den Auftraggebern auf die Vergütung geleistete Vorauszahlung zurückzuerstatten hat, soweit diese den seiner erbrachten Leistung entsprechenden Betrag übersteigt. Gleiches gilt bei einer von den Auftraggebern zu vertretenden teilweisen Unmöglichkeit.
4. Verletzt einer der beiden Vertragspartner eine Pflicht aus diesem Vertrag, kann der andere Teil Ersatz des ihm aus der Vertragsverletzung entstehenden Schadens verlangen.
Translation - English §6 Liability
1. If the Contractor is unable to fulfill his contractual obligations due to verifiable illness or other important reasons, he shall inform the Client of his inability at the onset of the inability, using the he has given.
2. If force majeure or acts of God lead either to the Contractor facing insurmountable obstacles or to the inability of the Client to stage the performances as planned, both parties to this Contract are freed from their contractual obligations. Force majeure and acts of God include, but are not limited to, the Contractor’s acute illness, transportation strikes, acts of war, power outages, extra-ordinary closure of banks and financial institutions, natural catastrophes, and the like.
3. If the stipulations of this Contract are not fulfilled because of reasons that are under the control of the Contractor or the Client, the other party may ask for compensation for non-performance of contract. Furthermore, the other party will be freed of any remaining responsibilities. In the case of a partial breach of contract for which the Contractor is responsible, he shall be paid at a rate that is reduced in accordance with the severity of his diminished services from the originally agreed upon amount, including reimbursing the Client for any sums paid out in advance if such payments exceed the amount due to him in consideration of the reduced services he has rendered. The same shall apply to the Client if contractual obligations are not met due to matters that lie within his power to correct.
4. If either of the two parties fails in the duties stipulated in this Contract, the other party may request compensation for the amount of damages caused by this failure.
