We hereby open our Irrevocable Letter of Credit no. K M 05-04694 in the following terms in your favor for account of Lap Shun knitting Factory, Hong Kong (hereinafter referred to as “the accountee”) to the extent of US$31,200 say, United States Dollars Thirty One Thousand Two Hundred, only available by your draft(s) drawn on the accountee at sight for 100% invoice value covering shipment(s) as detailed below and subject to the conditions herein contained.
Signed invoices at least in quadruplicate.
Insurance policies (or certificates) shall be in negotiable form, in duplicate, endorsed to the order of Hang Seng Bank Ltd., Hong Kong, for full invoice value plus about 10% covering Marine Insurance as per Institute Cargo Clauses (All Risks) with claims payable in Hong Kong in the currency of draft(s) irrespective of percentage.
In case of container shipment, insurance is to include the risks of jettison.
Clean “Shipped on Board” Ocean Bills of Lading showing beneficiaries as shipper, in complete set of at least three signed copies made out to order of shipper and endorsed to the order of Hang Seng bank Ltd., Hong Kong, marked with this L/C number, “Freight prepaid”, and Notify: the accountee 682-684, Castle Peak Road, Kowloon Hong Kong evidencing shipment from Taiwan to HONG KONG. Transshipment is forbidden. Draft(s) drawn under this credit must be negotiated in Taiwan on or before December 15, 2005 after which date this credit expires.
Unless otherwise explicitly stated usance draft(s) (if called for) under this credit are to be negotiated at sight basis, usance interest for account of drawees.
All banking charges outside Hong Kong are for account of beneficiaries.
Negotiating bank is to forward all documents to us by one registered airmail.
We shall remit the face amount of the draft to the negotiating bank upon receipt of the relative documents conforming to the terms of this credit.
Beneficiaries certificate to the effect that one set of non-negotiable copies of shipping documents has been airmailed to the accountee immediately after shipment is required.
Negotiation of this credit is not restricted.
Shipments are required in two equal lots as follows: 1st lot most be effected not later than November 20, 2005.
2nd lot must be effected not later than November 30, 2005)
