Source text - English Explaining Legal Translation
Legal translation bears the added burden of taking into account legal aspects that are not found in other texts. Legal translators must work not only between two languages and two cultures but between legal systems that are very different due to the strong sociocultural and historical influence exerted on them. This is aggravated by the fact that the systems are not even synonymous with countries: Common law, as the basis of the legal system, may apply in the United States, England, and Wales, but not in Scotland; nor entirely in the state of Louisiana, which has a mixed legal system due to the French influence there; Australia may use common law, but this has developed according to its own sociocultural context. In the United States, the division of federal law and state law also complicates the task. Roman law extended from Spain to much of South America, where it evolved differently within each system and is subject to the linguistic variations of each country. This added complexity is partly to blame for the neglected field of legal terminology.
Other fields, such as the sciences, provide universal concepts that can be managed easily in large databases: oxygen is oygène is oxígeno. Legal concepts are much more challenging. Marriage, for example, may seem to be an easy term to translate. The conceptual content, however, is not even identical in the United Kingdom, where the legal age for marriage in England and Wales is 18, or 16 with parental consent, and in Scotland, where such consent is not required and citizens may marry at 16. Likewise, the requirements to file for divorce vary enormously from one system to another, or even within the same system—requiring different or no periods of prior separation, for example. These differences in conceptual content pervade legal translation, requiring a quasi-expert understanding of the law and considerable research skills on the part of the translator, who cannot possibly be an expert in all the legal systems, nor all the fields of law, in the texts to be translated. Legal translators are not permitted the luxury of becoming experts in a narrow field, but must be prepared to face myriad areas of not only the law but many other fields in the texts they translate.
These differences in legal systems and legal concepts are particularly problematic for certain languages covering a plethora of legal systems and countries, such as English, Spanish, and Arabic. As if this complexity were not enough, consider the use of English as a lingua franca in legal translation. International business often resorts to English as the common language; hence, commercial documents from Portugal for China will often be in English. Here, translations are needed that embrace the correct use of legal English (which legal English?) and simultaneously consider the legal differences between the two systems involved but that are represented by the language of another legal system. This is not always an easy task. The EU is acutely aware of the problems of the interconnections of law, language, and culture as the EU countries include Roman and common law systems. Recent developments in the EU, partly due to the problems created by translating from English as a lingua franca, have prompted a move toward the creation of a neutralized EU legal culture and EU legal language with uniform concepts that will not be constricted to concepts from either Roman or common law (Sarcevic, 2015).
Legal translation is the label given to the translation of not only legislative texts and international treaties but court documents and administrative, commercial, and financial texts. Because the law affects almost every part of people’s lives, legal documents have a universal nature with content that may involve almost any field, from treaties on environmental issues to a love letter or suicide note in a court case. Although greater attention has been paid to the translation of legislation in the past, much of legal translators’ work is concerned with the much more mundane world of administrative documents. The growing demand for the translation of administrative documents for different authorities is, in part, due to increased population mobility in the 21st century. The authorities process citizens on the basis of the information they receive in these documents, and the subsequent decisions taken on this basis will affect citizens’ personal and professional lives.
Translators have long been considered third parties outside the direct communication between
the original text author and the target text receiver. As such, communication between all the parties in the communicative act has excluded the role of translators for centuries. This has changed considerably in recent decades, and translators now form an integral part of the communication process. Translators are central figures who work in a social context, where the importance of their role may vary according to their interaction with the other agents involved (author, initiator/client, receiver). The position of translators is, in fact, a privileged one, as they are familiar with the possible obstacles in the communication process due to cultural and linguistic differences between the agents involved. Therefore, if translators intervene and participate on an equal footing with the other agents, they will assume a more active and more visible role in society.

Dịch thuật pháp lý mang gánh nặng thêm vào có tính đến các khía cạnh pháp lý không được tìm thấy trong các văn bản khác. Các dịch giả pháp lý phải làm việc không chỉ giữa hai ngôn ngữ và hai nền văn hoá mà giữa các hệ thống pháp luật rất khác nhau do ảnh hưởng mạnh mẽ từ văn hoá và lịch sử. Điều này càng trầm trọng hơn bởi thực tế là các hệ thống thậm chí không đồng nghĩa với các quốc gia: Thông luật, là hệ thống luật pháp cơ bản, có thể áp dụng ở Hoa Kỳ, Anh và xứ Wales, nhưng không phải ở Scotland; cũng không phải toàn bộ ở bang Louisiana, nơi có hệ thống luật pháp hỗn hợp do ảnh hưởng của Pháp ở đó; Úc có thể sử dụng thông luật, nhưng điều này đã phát triển theo bối cảnh xã hội học của riêng mình. Article 1: International Court of Arbitration
1)
The International Court of Arbitration (the “Court”) of the International Chamber of Commerce (the “ICC”) is the independent arbitration body of the ICC. The statutes of the Court are set forth in Appendix I.
2)
The Court does not itself resolve disputes. It administers the resolution of disputes by arbitral tribunals, in accordance with the Rules of Arbitration of the ICC (the “Rules”). The Court is the only body authorized to administer arbitrations under the Rules, including the scrutiny and approval of awards rendered in accordance with the Rules. It draws up its own internal rules, which are set forth in Appendix II (the “Internal Rules”).
3)
The President of the Court (the “President”) or, in the President’s absence or otherwise at the President’s request, one of its Vice-Presidents shall have the power to take urgent decisions on behalf of the Court, provided that any such decision is reported to the Court at its next session.
4)
As provided for in the Internal Rules, the Court may delegate to one or more committees composed of its members the power to take certain decisions, provided that any such decision is reported to the Court at its next session.
5)
The Court is assisted in its work by the Secretariat of the Court (the “Secretariat”) under the direction of its Secretary General (the “Secretary General”).
Article 3: Written Notifications or Communications; Time Limits
1)
All pleadings and other written communications submitted by any party, as well as all documents annexed thereto, shall be supplied in a number of copies sufficient to provide one copy for each party, plus one for each arbitrator, and one for the Secretariat. A copy of any notification or communication from the arbitral tribunal to the parties shall be sent to the Secretariat.
2)
All notifications or communications from the Secretariat and the arbitral tribunal shall be made to the last address of the party or its representative for whom the same are
intended, as notified either by the party in question or by the other party. Such notification or communication may be made by delivery against receipt, registered post, courier, email, or any other means of telecommunication that provides a record of the sending thereof.
3)
A notification or communication shall be deemed to have been made on the day it was received by the party itself or by its representative, or would have been received if made in accordance with Article 3(2).
4)
Periods of time specified in or fixed under the Rules shall start to run on the day following the date a notification or communication is deemed to have been made in accordance with Article 3(3). When the day next following such date is an official holiday, or a non-business day in the country where the notification or communication is deemed to have been made, the period of time shall commence on the first following business day. Official holidays and non-business days are included in the calculation of the period of time. If the last day of the relevant period of time granted is an official holiday or a non-business day in the country where the notification or communication is deemed to have been made, the period of time shall expire at the end of the first following business day.

Điều 3: Thông báo bằng văn bản hoặc Thông tin liên lạc; Thời hạn

Tất cả bản tự bảo vệ và các thông tin khác bằng văn bản do bất kỳ bên nào đệ trình, cũng như tất cả các tài liệu đính kèm theo sẽ được cung cấp một số bản sao đủ để cung cấp một bản sao cho mỗi bên, cộng thêm một bản cho mỗi trọng tài, và một cho Ban Thư ký. ARTICLE 1: SCOPE OF WORKS
1.1. Party A hereby agrees to hire Party B to carry out the Supply and Install
Airconditioning system, Supply & Exhaust Air system works ( include Air-cond and
Suplly & exhaust air system) for Party A’s showroom HARLEY-DAVIDSON OF
ĐANANG located at No.4, NVA Street, Ward 6, District 4, Ho Chi Minh City ( Site).
ARTICLE 6: FORCE MAJEURE
The force majeure (exemption) clause of International Chamber of Commerce (ICC publication No.421) is hereby incorporated in this Contract.
6.1 If a party fails to perform all or part of its obligations under this Contract due to an event of Force Majeure (meaning an event beyond the reasonable control of the affected party that is unforeseeable, or unavoidable and beyond remedy if foreseen, and which happens after the execution of this Contract and renders the full or partial performance of this Contract impossible or impracticable). Events of Force Majeure include but are not limited to floods, fires, draughts, typhoons, earthquakes, and other acts of God, traffic accidents, strikes, insurrections, turmoil and war (whether declared or not) and any action or inaction of any governmental authority. The performance of such obligations shall be suspended during the period during which such performance is affected by the event of Force Majeure.
6.2 The Party claiming to be affected by an event of Force Majeure shall notify the other
Party in writing of the occurrence of such event as soon as possible.
ARTICLE 7: ARBITRATION
All disputes arising in connection with the execution of this contract will be settled by the two sides in the sprit of amicable agreement. Should it be impossible to solve such a dispute, the claim may be referred to at the arbitration in Vietnam in accordance with the International Commercial Arbitration rules. The award rendered by the arbitrator(s) shall be final and binding upon both parties concerned.

6.1 Nếu một bên từ chối thực hiện tất cả các cam kết của mình trong Hợp đồng này với lý do Bất Khả Kháng (có nghĩa là một sự kiện ngoài tầm kiểm soát của các bên liên quan mà không thể lường trước được, hoặc không thể phòng tránh và ngoài khả năng nhận biết trước, và nó xảy ra sau khi thực hiện Hợp đồng này và liên quan đến toàn bộ hay từng phần của Hợp đồng này (không thể và không thể thực hiện được). Những sự việc Bất Khả Kháng bao gồm nhưng không giới hạn đối với lũ lụt, hỏa hoạn, hạn hán, bão, động đất và những hiểm họa tự nhiên khác, tai nạn giao thông, đình công, nổi dậy (khởi nghĩa) và chiến tranh (có tuyên chiến hay không) và bất kỳ hoạt động hoặc không hoạt động của cơ quan Chính Phủ. ĐIỀU 7 : TRỌNG TÀI
Mọi tranh chấp phát sinh liên quan đến hợp đồng này sẽ được giải quyết giữa hai bên trên tinh thần hợp tác, hòa giải. Trong trường hợp, hai bên không thể giải quyết được mọi tranh chấp có thể được đưa ra Trọng tài tại Việt Nam theo quy tắc tố tụng trọng tài thương mại quốc tế. Phán quyết trọng tài sẽ là quyết định cuối cùng và ràng buộc các bên.

I am a lawyer assistant now. I love translating legal documents. I have some years experience in this field. I found that my interest in translation by accident when I supported my boss in translating his business documents.
I would like to share with you some of my experience in translation:
- From 2012 to 2015: I worked at a law office. At that time, I translated some legal administrative documents from Vietnamese to English and vice versa. But they were so simple, such as: ID certification, Married certification, certificates of land use rights, ownership of house and other properties tied to the ground, reference, contracts...
- From 2015 to present: I have gotten a lot of experiences in translation. Our senior lawyer become legal experts and consultance in some big cases in Vietnam in particular, the dispute in FIDIC contract of some Project in Vietnam resolved by international arbitration and Vietnamese courts. For example:
The dispute between Claimant is a Singapore Main Contractor and the Respondent is a Vietnam company in Construction of Aviation Fueling Facilities at Tan Son Nhat International Airport.
The dispute between Chinese Main Contractors and Vietnamese Employer in a Construction of Hydro power Project in a highland province of Vietnam.
Thanks to work with two cases I can get a lot of experience in translating FIDIC contracts and documents in arbitration, reference, Vietnamese law and international arbitration rules.
Moreover, I also have a lot of experiences in translation kind of Contract. For example: labour contract, distribute agreement, sale contract, confidencial agreement...
In conclusion I think how much a translator knows is no longer as important as knowing how to find reliable information and filter, select, and use it correctly.
