Source text - English The idea that central banks should be independent from government has gained wide acceptance in the past few decades. Experience has shown that political interference in monetary policy often has undesirable economic consequences. But policymakers are still reluctant to grant independence to the agencies that regulate and supervise the financial sector. One reason is the fear that regulators and supervisors, with their wide-ranging responsibilities and their power to penalize those who do not comply with regulations, could become a law unto themselves.
To guard against this danger, regulatory and supervisory agencies must be held accountable for their actions. Accountability arrangements would enable the public to exercise oversight over the agencies, thereby encouraging the agencies to adhere to high standards of governance and performance and enhancing their legitimacy.
Translation - Spanish Durante las últimas décadas, se ha afianzado la idea de que los bancos centrales deberían ser independientes de los gobiernos. La experiencia demuestra que la interferencia oficial en la política monetaria suele tener consecuencias económicas indeseables. No obstante, los autoridades encargadas de la formulación de políticas aún se rehúsan a otorgar independencia a los organismos que regulan y supervisan el sector financiero. Uno de los motivos es el temor de que los reguladores y supervisores, al poseer un amplio espectro de responsabilidades y la potestad de penalizar a aquellos que no cumplen con las normas, no reconozcan ninguna autoridad superior.
Para protegerse de este peligro, los organismos reguladores y de supervisión deben rendir cuentas de sus actos. Los mecanismos de rendición de cuentas permitirían a los ciudadanos ejercer control sobre los organismos, lo cual alentaría a éstos a alcanzar altos niveles de gobernabilidad y desempeño y aumentaría su legitimidad. La elaboración de mecanismos de rendición de cuentas es más compleja y más difícil para los reguladores del sector financiero que para los bancos centrales. Sin embargo, es necesario contar con estos mecanismos para garantizar que los organismos reguladores y de supervisión se comporten con responsabilidad e imparcialidad ante todos los grupos de interés e impedir que alguno de éstos ejerza una influencia o control indebidos.

Source text - Spanish El procedimiento de crisis es una instancia de negociación que tramita por ante el Ministerio de Trabajo. Para iniciarlo es necesario acompañar cierta documentación de la empresa ( tres últimos balances, estatuto, listado de personal a quienes les afectaría el despido, nombre del sindicato que representa a los trabajadores)
Una vez presentado, el Ministerio de Trabajo fija audiencia en la cual cita a la empresa y al o los sindicatos representativos. No resulta obligatorio que la negociación y comunicación con el sindicato se efectúen sólo al momento de la audiencia ante el Ministerio de Trabajo ( hay que analizar estratégicamente el caso concreto de ésta empresa, sus empleados , el sindicato y circunstancias de hecho como que los empleados ya tengan conocimiento de alguna medida a adoptar por la empresa, ya hayan efectuado reclamos verbales por cuestiones laborales, etc), ya que varias cuestiones pueden comenzar a negociarse previamente al inicio del trámite con el sindicato, por ejemplo las medidas a adoptar y los montos a abonar. Es importante destacar que también puede negociarse la forma de abonar el monto, financiada o en pago único, siempre y cuando sea aceptada por el sindicato.
Desde éste punto de vista, el procedimiento de crisis se reduce sólo entonces a una instancia administrativa para darle legalidad al acuerdo, mediante la homologación ministerial, la cual tiene como efecto jurídico que una vez abonado el monto acordado, no podrán los trabajadores reiniciar un juicio contra la empresa por diferencias salariales ni por cualquier concepto laboral ( quedando siempre exceptuados conforme legislación vigente indemnizaciones por accidente de trabajo).
Translation - English The crisis procedure is a negotiation instance held before the Labor Department (Ministerio de Trabajo). In order to initiate such procedure, it is necessary to submit certain corporate documents (the last three balance sheets, corporate by-laws, list of people to be dismissed, and name of the Union representing the workers).
After submission of such documents, the Labor Department sets a hearing date and summons the company and the representative union/s. It is not compulsory for the negotiation and communication with the Union to be held only on the occasion of the Labor Department hearing (a strategic analysis should be conducted of this company's concrete case, its employees, the union and facts surrounding the case, such as whether the employees are already aware that a certain measure is to be taken by the company, that verbal complaints have already been made for labor reasons, etc.), since many issues can be arranged before starting negotiating with the Union, such as the steps to be taken and the amounts to be paid. It is important to highlight that the means of payment may also be negotiated: it may be a lump sum or a financed amount, provided the Union accepts it.
From this standpoint, the crisis procedure just comes down to an administrative instance to legitimate the agreement, by means of the ministerial approval; the legal effect of which being that once the agreed amount has been paid, the involved workers may not re-file a complaint against the company for any salary differences or any other labor-related issues (save for industrial injury benefits as per the current legislation).
