Explanation: Based on the definition of the term by the Mexican code on Recurso de amparo: "Principio de definitividad Este principio está regulado en las fracciones III y IV, del Artículo 107 de la Constitución Política de los Estados Unidos Mexicanos.. Consiste en la obligación que tiene el quejoso de agotar todos los recursos o medios de defensa existentes en la ley que rige el acto reclamado antes de iniciar la acción de amparo. Con este principio se obliga a los gobernados a impugnar los actos de autoridad utilizando los recursos ordinarios de modo que el amparo sea un medio que proceda sólo en forma extraordinaria. Estos recursos ordinarios o juicios, que es necesario agotar, deben tener por efecto modificar o revocar los actos que se impugnen, pues si no tienen ese fin, su utilización no es obligatoria." |
