Dans le droit fil de cette analyse le juge de l’impôt a pu considérer que l’anulation, par la chambre criminelle de la Cour de cassation de pièces saisies lors d’une perquisition, n’avait pas d’incidence sur la validité du redressement notifié par l’administration fiscale puisque cette dernière avait obtenu régulièrement communication des dites pièces détenues par l’autorité judiciaire. Et cette jurisprudence vaut également sous l’empire de l’article L 16 B du Livre des procedures fiscales.
