El sistema legal XXX garantiza el acceso rápido y eficaz del detenido a un abogado (artículo XXX de la XXX y artículo XXX de la Ley de XXX). Tan pronto como el funcionario policial practica un arresto, está obligado a solicitar la presencia del abogado de la elección del detenido o del Colegio de Abogados para que designe uno del turno de oficio. Si el funcionario no cumple con esta obligación con la debida diligencia puede ser objeto de sanción penal y disciplinaria.
Además, durante el plazo que establece la ley para que dicho abogado efectúe su comparecencia en dependencias policiales, no se le pueden hacer preguntas al detenido, ni practicar con el mismo diligencia alguna. The XXX legal system guarantees a detainee rapid and effective access to a lawyer (article XXX of the Constitution and article XXX of the XXX Act). As soon as the police officer arrests an individual, he/she is obligated to request the presence of a lawyer either selected by the detainee or from the Bar Association, which will appoint one from its roster. If the police officer fails in this duty, he/she may be subject to criminal and disciplinary sanctions.
In addition to this, before the lawyer presents him/herself in the police station, the detainee can not be interrogated, nor conduct any judicial proceeding during this period as established by law. The detainee should also be informed that he/she has the right to remain silent and the right to a medical check from the time of his detention.

Disposiciones Generales Capítulo Único Naturaleza y Objeto
Artículo 1o.-
La presente Ley es de orden público e interés general y de aplicación en todo el territorio nacional y zonas en las que la Nación ejerce soberanía o jurisdicción y tiene como objeto crear la Agencia Nacional de Seguridad Industrial y de Protección al Medio Ambiente del Sector Hidrocarburos, como un órgano administrativo desconcentrado de la Secretaría de Medio Ambiente y Recursos Naturales, con autonomía técnica y de gestión.
La Agencia tiene por objeto la protección de las personas, el medio ambiente y las instalaciones del sector hidrocarburos a través de la regulación y supervisión de:
La Seguridad Industrial y Seguridad Operativa;
Las actividades de desmantelamiento y abandono de instalaciones, y
El control integral de los residuos y emisiones contaminantes.
La actuación de la Agencia se regirá por los principios de eficacia, eficiencia, honestidad, imparcialidad, objetividad, productividad, profesionalización, transparencia, participación social y rendición de cuentas.
La Agencia planeará y conducirá sus actividades con sujeción a lo dispuesto en esta Ley y los instrumentos que se emitan en el marco del sistema nacional de planeación democrática y las políticas que determine el Titular del Ejecutivo Federal para el logro de los objetivos y prioridades del desarrollo nacional, integral y sustentable, así como a los programas que establezcan las Secretarías del ramo en materia de Medio Ambiente y Energía.
En el ejercicio de sus funciones, tomará en consideración criterios de sustentabilidad y de desarrollo bajo en emisiones, así como atenderá lo dispuesto en la Ley General del Equilibrio Ecológico y la Protección al Ambiente, la Ley General para la Prevención y Gestión Integral de los Residuos, la Ley General de Desarrollo Forestal Sustentable, la Ley General de Vida Silvestre, la Ley de Bioseguridad de Organismos Genéticamente Modificados y demás ordenamientos aplicables.
Además de las definiciones contempladas en la Ley de Hidrocarburos y en la Ley General del Equilibrio Ecológico y la Protección al Ambiente, para los efectos de esta Ley se entenderá, en singular o plural, por:
Agencia:
Agencia Nacional de Seguridad Industrial y de Protección al Medio Ambiente del Sector Hidrocarburos;
Contingencia:
Situación de riesgo, derivada de actividades humanas o fenómenos naturales, que puede poner en peligro la integridad de la población, el medio ambiente o las instalaciones industriales;
Consecuencia:
Resultado real o potencial de un evento no deseado, medido por sus efectos en las personas, instalaciones y el medio ambiente;
Emergencia:
Situación derivada de actividades humanas o fenómenos naturales que al ocurrir, afectan la integridad de la población, el medio ambiente o las instalaciones industriales;
Evaluación estratégica:
Proceso sistemático de análisis que realiza la Agencia para emitir observaciones y recomendaciones en las materias de Seguridad Industrial, Seguridad Operativa y de protección ambiental en las iniciativas de políticas públicas, planes o programas de gobierno relacionadas con las actividades del Sector Hidrocarburos;
Externalidades:
Los impactos positivos o negativos que genera la provisión de un bien o servicio y que afectan o que pudieran afectar a una tercera persona o al medio ambiente.
Las externalidades ocurren cuando el costo pagado por un bien o servicio es diferente del costo total de los daños y beneficios en términos económicos, sociales, ambientales y a la salud que involucran su producción y consumo;
Instalación:
El conjunto de estructuras, plantas industriales, equipos, circuitos de tuberías de proceso y servicios auxiliares, así como sistemas instrumentados, dispuestos para un proceso productivo o comercial específicos, incluyendo, entre otros, pozos para la exploración y extracción de hidrocarburos, plataformas, plantas de almacenamiento, refinación y procesamiento de hidrocarburos en tierra y en mar, plantas de compresión y descompresión de hidrocarburos, sistemas de transporte y distribución en cualquier modalidad, así como estaciones de expendio al público;
Regulados:
Las empresas productivas del Estado, las personas físicas y morales de los sectores público, social y privado que realicen actividades reguladas y materia de la presente Ley;
Riesgo:
Es la probabilidad de ocurrencia de un evento indeseable medido en términos de sus consecuencias en las personas, instalaciones, medio ambiente o la comunidad;
Riesgo crítico:
Riesgo que implica un peligro inminente y requiere acción inmediata para reducirse a condiciones aceptables sin limitar el costo de su solución;
Sector Hidrocarburos o Sector:
Las actividades siguientes:
El reconocimiento y exploración superficial, y la exploración y extracción de hidrocarburos;
El tratamiento, refinación, enajenación, comercialización, transporte y almacenamiento del petróleo;
El procesamiento, compresión, licuefacción, descompresión y regasificación, así como el transporte, almacenamiento, distribución y expendio al público de gas natural;
El transporte, almacenamiento, distribución y expendio al público de gas licuado de petróleo;
El transporte, almacenamiento, distribución y expendio al público de petrolíferos, y
El transporte por ducto y el almacenamiento, que se encuentre vinculado a ductos de petroquímicos producto del procesamiento del gas natural y de la refinación del petróleo;
Secretaría:
Secretaría de Medio Ambiente y Recursos Naturales;
Seguridad Industrial:
Área multidisciplinaria que se encarga de identificar, reducir, evaluar, prevenir, mitigar, controlar y administrar los riesgos en el Sector, mediante un conjunto de normas que incluyen directrices técnicas sobre las instalaciones, y de las actividades relacionadas con aquéllas que tengan riesgos asociados, cuyo principal objetivo es preservar la integridad física de las personas, de las instalaciones, así como la protección al medio ambiente;
Seguridad Operativa:
Área multidisciplinaria que se encarga de los procesos contenidos en las disposiciones y normas técnicas, administrativas y operativas, respecto de la tecnología aplicada, así como del análisis, evaluación, prevención, mitigación y control de los riesgos asociados de proceso, desde la fase de diseño, construcción, arranque y puesta en operación, operación rutinaria, paros normales y de emergencia, mantenimiento preventivo y correctivo.
También incluye los procedimientos de operación y prácticas seguras, entrenamiento y desempeño, investigación y análisis de incidentes y accidentes, planes de respuesta a emergencias, auditorías, aseguramiento de calidad, pre-arranque, integridad mecánica y administración de cambios, entre otros, en el Sector;
Sistema de Administración:
Conjunto integral de elementos interrelacionados y documentados cuyo propósito es la prevención, control y mejora del desempeño de una instalación o conjunto de ellas, en materia de Seguridad Industrial, Seguridad Operativa y de protección al medio ambiente en el Sector, y
Supervisión:
Acto de autoridad mediante el cual la Agencia verifica, inspecciona y, en su caso, comprueba el cumplimiento de las disposiciones legales, reglamentarias y normativas en las materias objeto de esta Ley.
En lo no previsto por la presente Ley, se aplicarán de manera supletoria las disposiciones contenidas en la Ley de Hidrocarburos, la Ley General del Equilibrio Ecológico y la Protección al Ambiente, la Ley General para la Prevención y Gestión Integral de los Residuos, la Ley General de Desarrollo Forestal Sustentable, la Ley de Bioseguridad de Organismos Genéticamente Modificados, y la Ley Federal de Procedimiento Administrativo.

General Provisions
Single Chapter
Nature and Object
Article 1o.-
The current Law is of public order and federal interest, and is to be applied in all national territory and zones where the Nation exerts sovereignty or jurisdiction and its objective is to create the National Agency of Industrial Safety and Environmental Protection of the Hydrocarbons Sector, as an administrative body apart from the Ministry for the Environment and Natural Resources, with technical and management independence.
The Agency seeks to protect people, the environment and the installations of the hydrocarbons sector via the regulation and supervision of:
Industrial and Operational Security;
Dismantling and abandonment of installations and
The integral control of waste products and contaminating emissions.
The Agency’s intervention will be regulated by the principles of effectiveness, efficiency, honesty, impartiality, objectivity, productivity, professionalisation, transparency, social participation and the surrendering of accounts.
The Agency will plan and conduct its activities taking this Law into consideration and the instruments that are issued in the guidelines of the National system for democratic planning and the policies which determine the Head of the Federal Executive Branch for the achievement of the objectives and priorities of integral and sustainable national development, as well as the programs which establish the relevant Ministries for matters of Environment and Energy.
While carrying out its functions, low-emission sustainability and development criteria will be taken into account, as well as what is outlined in the General Law on Ecological Balance and Environmental Protection, The General Law for the Prevention and Comprehensive Management of Wastes, The General Law on Sustainable Forestry Development, The General Law on Wildlifeife, the Law of Biosafety for Genetically Modified Organisms and other applicable rulings.
As well as the definitions outlined in the Hydrocarbons Law and the General Law on Ecological Balance and Environmental Protection, the following will be understood in both singular and plural form:
Agency:
National Agency of Industrial Safety and Environmental Protection of the Hydrocarbons Sector
Possibility:
Situation of risk, caused by human activity or natural causes that may put public integrity, the environment or industrial installations in danger;
Consequence:
Real or potential undesired event, measured by its effects on people, installations and the environment;
Emergency:
Situation caused by human activity or natural causes that, when it happens, its affect the integrity of the population, the environment or industrial installations;
Strategic Evaluation:
Systematic Analysis process carried out by the Agency to issue observations and recommendations when it comes to Industrial and Operational Security and protection of the environment in the initiatives of public policies, plans or government programs related to the activities of the Hydrocarbons Sector;
Externalities:
The positive or negative impacts resulting from a product or service that affects, or might affect a third party or the environment.
Externalities occur when the cost paid for a product or service is different from the total cost of the economic, social, environmental and health damages and benefits that their production and consumption;
Installation:
The ensemble of structures, industrial plants, equipment, process piping circuits and support services, as well as arranged systems used for a specific productive or commercial process including, among others, wells for exploration and extraction of hydrocarbons, platforms, storage plants, refinement and processing of hydrocarbons both on land and at sea, compression and decompression hydrocarbon plants, transport and distribution systems of all types, as well as public sales systems ;
Regulated Parties:
The State-owned productive companies, the people and legal entities of the public, social and private sector who carry out regulated activities related to the current Law;
Risk:
The probability of the occurrence of an undesired event, measured in terms of the possible consequences for people, installations, the environment or the community;
Critical Risk:
A risk that implies imminent danger and requires immediate action to reduce itself to acceptable condition without restricting the cost of such a solution;
Hydrocarbons Sector, or Sector:
The following activities:
The recognition and superficial exploration and extraction of hydrocarbons;
The treatment, refinement, sale, commercialisation, transport and storage of petrol;
The processing, compression, liquefaction, decompression and regasification, as well as the transport, storage, distribution and public sale of natural gas;
The transport, storage, distribution and public sale of molten petrol gas;
The transport, storage, distribution and public sale of petroleum products, and
Pipeline transportation and storage which is linked to petrochemical product pipelines of the process of natural gas and the refinement of petrol ;
Secretary :
Ministry of the Environment and Natural Resources;
Industrial Security:
Multidisciplinary area which is in charge of identifying, reducing, evaluating, mitigating, controlling and administering the risks in the Sector via an ensemble of regulations which include technical directories about the installations and the activities related to those which come with associated risks, whose principle objective is to preserve the physical integrity of the people and the installation, as well as protecting the environment;
Operational Security:
Multidiscipline area which is in charge of the processes contained in the provisions and technical, administrative and operational rules related to the applied technology, as well as the analysis, evaluation, prevention, mitigation and control of risks associated with the process, including the design phase, construction, assembly, initial operation, general operation, normal and emergency stoppages and preventative and corrective maintenance.
It also includes the operational and secure practice procedures, training and performance, investigation and analysis of incidents and accidents, response plans for emergencies, audits, quality assurance, pre-assembly, mechanic integrity and change management, among others, within the Sector;
Administration System:
Integral ensemble of inter-related elements and documents whose purpose is the prevention, control and improvement of performance of an installation, or ensemble of installations in terms of Industrial and Operational Security and protection of the environment in the Sector and
Supervision:
Authority Act via which the Agency verifies, inspects and, where necessary, checks the adherence to the legal provisions, rules and guidelines which are the object of this Law.
Anything not mentioned in this Law is covered, by extension, by the provisions outlined in the Law on Hydrocarbons, the General Law on Economic Balance and Environmental Protection, the General Law for the Prevention and Comprehensive management of Wastes, The General Law on Sustainable Forestry Development, the Law of Biosecurity of Genetically Modified Organisms and the Federal Law of Administrative Procedure.
