BOARD RULES, CHAPTER XV
PROHIBITED DISCRIMINATION, UNLAWFULHARASSMENT, AND SEXUAL MISCONDUCT (TITLE IX)
15001. POLICY.
A. It is the policy of the Los Angeles Community College District is to provide a safe educational, employment and business environment free from Prohibited Discrimination, Unlawful Harassment, and Sexual Misconduct, as defined in the Administrative Regulations associated with this policy. Employees, students, or other persons acting on behalf of the District who engage in Prohibited Discrimination, Unlawful Harassment, or Sexual Misconduct as defined in the Administrative Regulations related to this policy or by state or federal law shall be subject to discipline, up to and including discharge, expulsion, or termination of contract.
B. The Los Angeles Community College District Board of Trustees condemns any act of Sexual Misconduct committed at any of its facilities or at any of its activities. The Los Angeles Community College District is committed to taking immediate and appropriate action upon learning of potential incidents of Sexual Misconduct.
C. Investigation of all complaints alleging violations of this Chapter shall be conducted under the auspices of the Office for Diversity, Equity and Inclusion. Implementation of temporary, interim sanctions shall be overseen by the Title IX Coordinator for that site, with the advice and consent of relevant administrators. Implementation of permanent sanctions shall be overseen by the College President or at the Educational Services Center (“ESC”) by the Deputy Chancellor as set forth in the Administrative Regulations which compliment this policy.

15002. ACADEMIC FREEDOM.
The Board of Trustees reaffirms its commitment to academic freedom, but recognizes that academic freedom does not allow Prohibited Discrimination. The discussion of ideas, taboos, behavior or language which is an intrinsic part of the course content shall in no event constitute Prohibited Discrimination, Unlawful Harassment, or Sexual Misconduct. It is recognized that an essential function of education is a probing of received opinions and an exploration of ideas which may cause some students discomfort. It is further recognized that academic freedom ensures the faculty's right to teach and the student's right to learn.

15003. DUTIES OF SUPERVISORS.
All Supervisors shall be responsible for maintaining a work environment consistent with this policy. Any Supervisor who becomes aware of a situation that could reasonably be perceived to be a violation of this policy has a duty to report that information to the Director, Office for Diversity, Equity and Inclusion.

15004. PROCEDURES, ADMINISTRATIVE REGULATIONS.
A. The specific rules and procedures for reporting allegations of Prohibited Discrimination, Unlawful Harassment, and Sexual Misconduct and for pursuing available remedies are incorporated in a separate Administrative Regulation issued under the authority of the Chancellor. Copies may be obtained on the District website and from the Office for Diversity, Equity and Inclusion. Such Administrative Regulation covers both Title 5 and Title IX compliance and includes foundational information, process, and definitions.
B. Former Board Rule XVI is incorporated into this Board Rule and related Administrative Regulations.

In open judicial sitting in Etchmiadzin on June 11, 2005 was examined the case according to the application of Anush Khariton Kuryachaya’s demand to recognize the citizen as missing
The applicant's representative Sergey Meghryan claiming the application said that the applicant Anush Kuryachaya married Novlet Vladimir Kuryachi in 1993, the marriage was registered in Paraqar’s village council in 28.07.1993. After marriage, they settled in the Russian city of Rostov, where two children were born: Shaqe Novlet Kuryachaya born in 28. 03. 1996 and Anna Novlet Kuryachaya born in 19. 12. 1993. In May 1997 they returned to Armenia and settled in the applicant's paternal home in village Paraqar of Armavir region. In 1997 their relationship declined drastically and Novlet left, settling in Yerevan, in their unknown address. Actually their marital relationship stopped. By 1999 Novlet was hosted by the applicant with the purpose to see his children once a month, but he stopped to see the children, since July 1999 and so far there is no information about his whereabouts. The applicant tried to find him, but could not, all her efforts to find him were in vain. At present in order to obtain an Armenian citizenship passport and exit visa, an applicant leaving for abroad with the children is required to submit their father's consent verified by the notary that because of his absence the applicant can't obtain.
The court was asked to recognize Novlet Vladimir Kuryachi as missing. Witnesses, applicant's neighbours Karine Hrach Esayan and Gor Sargis Tovmasyan gave evidence, that the applicant's husband actually divided in 1997, left the applicant’s house and since 1999 till now, no one, including them, have no information on his whereabouts.
After hearing the applicant's representative, witnesses and studying the materials of the case, the court finds the request justified, based on the requirements of article 44 of an Armenian Republic civil code and is subject to the satisfaction with the following reasons:
The investigation revealed the following:
According to the copies of marriage certificate 28.07. 1993 III-C N-410779, birth certificates 26.05. 1994 VIII-AH 314250 and 11. 06. 1998 I-AH N-34 1291 available in the case, the applicant Anush Kuryachay’s and Novlet Kuryachi’s marriage was registered in Paraqar’s village council in 28.07.1993 and they have two children: Shaqe Novlet Kuryachaya born in 28. 03. 1996 and Anna Novlet Kuryachaya born in 19. 12. 1993. In accordance with the explanation of applicant's representative and testimony of witnesses, Novlet Vladimir Kuryachi lived at 30 apartment of Komuna’s street of the village of Paraqar in Armavir region and there is no further information more than 6 years on his whereabouts.
According to the Court decision, in 93(3709) issue of the RA daily newspaper of 20.05.2005 a notice was published on declaring Novlet Vladimir Kuryachi as missing on starting proceedings, by asking all the citizens and organizations to inform their information about the location of the latter to the court of first instance of Armavir region, but such information has not been received.
According with the scrap 11. 06.2005 number 88-2/3-3496 of Etchmiadzin police department, Novlet Vladimir Kuryachi is not found in investigation and there is no information on his whereabouts in police authorities.
According to the article 44 of an RA civil code, the court can recognize the citizen as missing with an application of interested persons, if there is no information on his whereabouts at his residence within one year.
In this case, there is no information on Novlet Kuryachi’s whereabouts at his residence around 6 years. The outset of N. Kuryachi’s missing must be considered the 1st of august, 1999.
Based on the foregoing and guided by the articles 130-132 copies of an RA civil procedure, the court
Adjudicates
To grant the application.
To recognize the citizen Novlet Vladimir Kuryachi, born in 03.01 1956 , lived in village Paraqar of Armavir region as missing, considering the outset of absence the 1st of august, 1999.
In case of not complying the verdict voluntarily, it will be done through the service of Judicial Acts Compulsory Enforcement of debtor's account.
The following judgment can be appealed in Appeal Court of civil cases of RA within 15 days.
