Source text - Portuguese Os caminhos percorridos pela integração regional do Mercosul têm avançado em governança, porém árduo tem sido o processo em busca de progresso, segurança coletiva e harmonia entre os Estados-membros. Neste contexto, uma série de questões interdisciplinares influenciam o desenvolvimento e o avanço da integração, principalmente no que diz respeito ao binômio comércio e desenvolvimento sustentável. A partir deste cenário, tem-se o seguinte problema de pesquisa: considerando as implicações no âmbito do Mercado Comum do Sul e o contexto econômico em que foi desenvolvido, em que extensão se dá a proteção ambiental no âmbito do Mercosul a partir de uma análise institucional, normativa e jurisdicional? Assim, o objetivo geral da pesquisa é investigar como se desenvolve o tratamento conferido ao meio ambiente para, através das lentes jurídico-institucionais Mercosulinas, compreender quais os desafios enfrentados pelo Direito Ambiental no contexto da organização internacional do Mercosul. A pesquisa apresenta-se e desenvolve-se a partir de três objetivos específicos: (a) investigar como o Mercosul trata o meio ambiente institucionalmente, ou seja, como os órgãos que compõem o Mercosul lidam de maneira mais incipiente ou mais transformadora a proteção e regulação ambiental; (b) analisar o Direito do Mercosul em relação à regulação e a proteção ao Meio ambiente na construção de uma agenda ambiental e vinculante aos Estados-partes; (c) analisar de que modo o Tribunal Permanente de Revisão do Mercosul, enquanto Corte Jurídica responsável pela apreciação de controvérsias entre os Estados-partes, tem atuado sobre os conflitos de natureza ambiental e a formação jurisdicional decorrente. Adotou-se o método investigativo, mediante o método hipotético-dedutivo de aprendizagem, e a técnica da pesquisa exploratória e bibliográfica. Conclui-se que a proteção jurídico-ambiental no âmbito do Mercosul se revela, progressivamente, protetiva do meio ambiente, tanto nos órgãos próprios da estrutura Institucional do Mercosul como na interpretação e na aplicação das normas do direito mercosulino pela sua Corte Jurídica: o Tribunal Permanente de Revisão do Mercosul.
Translation - English The paths taken by Mercosur's regional integration have advanced in terms of governance, but the process in search of progress, collective security, and harmony among the Member States has been arduous. In this context, a series of interdisciplinary issues influence the development and advancement of integration, especially with regard to the binomial trade and sustainable development. From this scenario, we have the following research question: Considering the implications in the scope of the Southern Common Market and the economic context in which it was developed, to what extent does the environmental protection occur within the scope of Mercosur from an institutional, normative, and jurisdictional analysis? Thus, the general objective of this research is to investigate how the treatment given to the environment is developed, so that, through Mercosur's legal-institutional view, understand the challenges faced by Environmental Law in the context of the international organization of Mercosur. The research is presented and developed from three specific objectives: (a) to investigate how Mercosur treats the environment institutionally, that is, how the bodies that make up Mercosur deal with the protection and environmental regulation, in a way that is more incipient or more transforming; (b) analyze Mercosur Law in regards to the regulation and protection of the Environment in the construction of a binding environmental agenda for the States Parties; (c) analyze how the Mercosur’s Permanent Review Court, as the Legal Court responsible for the assessment of disputes between the States Parties, has acted on conflicts of an environmental nature and its jurisdictional results. The investigative methodology was adopted through the hypothetico-deductive learning method and the technique of exploratory and bibliographic research. The conclusion is that the environmental legal protection in the scope of Mercosur reveals itself to be progressively protective of the environment, both in the bodies of the Mercosur Institutional structure and in the interpretation and application of the rules of Mercosur law by its Legal Court: the Permanent Review Court.
