Source text - English POSITIVE DISCRIMINATION AND ANTI-DISCRIMINATION LAW.
The superior act of law, which regulates the issue of discrimination, is the Constitution of the Republic of Poland. According to the provisions of art.32 of the Constitution, all persons shall be equal before the law. All persons shall have the right to equal treatment by public authorities. No one shall be discriminated against in political, social or economic life for any reason whatsoever .
Prohibition of discrimination at work is regulated to the largest extent in the Labour Code . It implements 31 directives of the European Community, including two discrimination directive – directive 2000/78/CE, establishing a general framework for equal treatment in employment and occupation, and directive 2000/43/CE, implementing the principle of equal treatment between persons irrespective of racial or ethnic origin.
According to art. 113 of the Polish Labour Code, “any discrimination in employment, direct or indirect, in particular because of sex, age, disability, race, religion, nationality, political views, trade union membership, ethnic origin, faith, sexual orientation and also because of employment for specified or unspecified period or full-time or part-time employment - is inadmissible."
Polish law not only prohibits any discrimination in workplace, but also admits introduction of temporary solutions by the state, intended at creating equal opportunities to employees disfavoured on the labour market . These solutions do not violate the principle of equal treatment in employment and are known as positive discrimination.
Translation - Spanish DISCRIMINACIÓN POSITIVA Y LEY ANTI-DISCRIMINACIÓN
El acto jurídico de mayor rango, que regula la cuestión de la discriminación, es la Constitución de la República de Polonia. Según las disposiciones del art.32 de la Constitución, todas las personas son iguales ante la ley. Todas las personas tendrán el derecho de igualdad de trato por las autoridades públicas. Nadie podrá ser discriminado en la vida política, social y económica por ninguna razón.
La prohibición de discriminación en el trabajo está regulada en gran medida en el Código de Trabajo . Implementa 31 directivas de la Comunidad Europea, incluyendo dos directivas de discriminación –directiva 2000/78/CE, que establece el marco general para la igualdad de trato en el empleo y ocupación, y la directiva 20/43/CE, que aplica el principio de la igualdad de trato entre personas con independencia del origen racial o étnico.
Según el art.113 del Código de Trabajo polaco, “cualquier discriminación en el trabajo, directa o indirecta, en particular por motivos de sexo, edad, discapacidad, raza, religión, nacionalidad, opinión política, pertenencia a una organización sindical, origen étnico, creencia religiosa, orientación sexual y por contrato laboral determinado o indeterminado o jornada completa o media jornada es inadmisible.”
La legislación polaca, además de prohibir cualquier discriminación en el lugar de trabajo, admite la introducción de soluciones temporales por parte del estado, con el objetivo de crear igualdad de oportunidades para los empleados en desventaja en el mercado de trabajo . Estas soluciones no violan el principio de igualdad de tratamiento en el empleo y se conocen como “discriminación positiva”.
