Source text - Portuguese Tanto a doutrina quanto a jurisprudência não possuem posições unânimes quanto à possibilidade de responsabilizar penalmente a pessoa jurídica por crimes ambientais. Tal divergência se dá em razão de a pessoa jurídica não possuir vontade, que por sua vez é elemento fundamental para o conceito de crime. Logo, de acordo com os conceitos clássicos penais, a pessoa jurídica não poderia cometer crimes pela ausência de dolo ou culpa, tratando-se de uma ficção jurídica. Porém, há quem defenda a imputabilidade penal da pessoa jurídica em crimes ambientais por ser o meio ambiente direito fundamental à sadia qualidade de vida, devendo ser protegido de todas as suas ameaças e agressões, seja cometida por pessoa física ou jurídica. O presente trabalho tem por objetivo informar a população empresária, não somente acerca das consequências penais que sofrem as pessoas jurídicas poluidoras do meio ambiente, mas também do atual posicionamento dos tribunais superiores acerca do tema.
Translation - English Both legal theory and case law do not hold unanimous positions in relation to the likelihood of making the legal entity criminally responsible for environmental crimes. Such conflict has to do with the lack of manifestation of intent by the legal entity, which in turn, it is a crucial factor in the concept of crime. Thus, according to conventional criminal concepts, the legal entity could not commit crimes by absence of criminal intent or negligence, namely a legal fiction. However, one may defend the criminal charge of a legal entity for environmental crimes, since the environment is a fundamental right for a better quality of life, needing to be protected from all threats and attacks committed either by an individual or a legal entity. Along these lines, the following work aims at informing entrepreneurs not only about the criminal consequences that the legal entities who pollute the environment suffer, as well as about the current position of all higher courts about the matter.
