Source text - French Article I- 26: RETENUE DE GARANTIE
Il est prévu une retenue de garantie de sept pour cent (7%) du montant du marché augmenté, le cas échéant, du montant des avenants.
La retenue de garantie peut être remplacée, à la demande du Fournisseur, par une caution personnelle et solidaire constituée dans les conditions prévues par la réglementation en vigueur.
La retenue de garantie est restituée ou la caution qui la remplace est libérée à la suite d’une mainlevée délivrée par le Maître d’ouvrage dans un délai maximum de trois mois suivant la date de la réception définitive du marché.
Article I- 27: PENALITES POUR RETARD
A défaut d'avoir exécuté les prestations dans les délais prescrits, il sera appliqué au Fournisseur une pénalité, par jour calendaire de retard, de 1 %o (un pour mille) du montant des prestations exécutées en retard.
Cette pénalité sera appliquée de plein droit et sans mise en demeure, sur toutes les sommes dues au Fournisseur.
L’application de ces pénalités ne libère en rien le Fournisseur des obligations à sa charge et des responsabilités qu’il encourt au titre du présent marché.
Le montant cumulé de ces pénalités est plafonné à 10% du montant du marché modifié ou complété, éventuellement, par des avenants.
Lorsque le plafond des pénalités est atteint, l’autorité compétente est en droit de résilier le marché après mise en demeure préalable adressée au Fournisseur et sans préjudice de l'application des mesures coercitives qui s’imposent.
Article I- 28: IMPOTS ET TAXES
Le Fournisseur est réputé avoir parfaitement pris connaissance de la législation fiscale en vigueur au Maroc. Par conséquent, il supportera tous les impôts et taxes conformément à la législation en vigueur.
Pour le cas des sociétés étrangères non résidentes au Maroc, une retenue à la source au titre de l’impôt sur les sociétés, le cas échéant, fixée au taux de dix pour cent (10 %), sera prélevée sur le montant hors taxe sur la valeur ajoutée des prestations de services rendues par les sociétés étrangères dans le cadre du présent marché.
Article I- 29: CAS DE FORCE MAJEURE
Au titre du marché, force majeure signifie tout événement imprévisible, irrésistible et indépendant de la volonté des Parties.
Aucune Partie n’encourt de responsabilité pour n’avoir pas accompli ou avoir accompli avec retard une obligation au titre du marché, dans la mesure où un tel manquement ou retard résulte directement d événements intervenant à tout moment durant l’exécution du marché et présentant les caractéristiques de la force majeure.
Toutefois, la force majeure ne dispense pas l’une ou l’autre des parties de son obligation de payer les sommes dues avant la survenance de l’événement de la force majeure au titre du présent marché.
Article I- 30: RESILIATION DU MARCHE
La résiliation du marché peut être prononcée conformément aux dispositions prévues par le CCAG-T.
La résiliation du marché ne fera pas obstacle à la mise en œuvre de l’action civile ou pénale qui pourrait être intentée au Fournisseur du Marché en raison de ses fautes ou infractions.
Si des actes frauduleux, des infractions réitérées aux conditions de travail ou des manquements graves aux engagements pris ont été relevés à la charge du Fournisseur, Maître d’ouvrage, sans préjudice des poursuites judiciaires et des sanctions dont le Fournisseur est passible, peut par décision motivée, l'exclure temporairement ou définitivement de la participation aux marchés lancés par le Maître d’ouvrage.
Article I- 31: LUTTE CONTRE LA FRAUDE ET LA CORRUPTION
Le Fournisseur ne doit pas recourir par lui-même ou par personne interposée à des actes de corruption, à des manœuvres frauduleuses et à des pratiques collusoires, à quelque titre que ce soit, dans les différentes procédures de passation, de gestion et d’exécution du marché.
Le Fournisseur ne doit pas faire, par lui-même ou par personne interposée, des promesses, des dons ou des présents en vue d'influer sur les différentes procédures de conclusion du présent marché et lors des étapes de son exécution.
Les dispositions du présent article s’appliquent à l’ensemble des intervenants dans la réalisation du présent marché.
Article I- 32: REGLEMENT DES LITIGES ET LOI APPLICABLE
Tous litiges survenus à l'occasion de l'interprétation ou de l'exécution du marché seront, s'ils ne sont pas réglés à l'amiable, du ressort du tribunal de commerce de la ville de Casablanca.
Le présent marché est soumis au droit marocain qu’il s’agisse de sa signification, de son interprétation, de son exécution et des relations s’établissant entre les parties.
CHAPITRE - II: PRESCRIPTIONS TECHNIQUES
Ce chapitre décrit les spécifications particulières des Equipements à fournir.
Article II-1: CARACTERISTIQUES GENERALES / OPERATIONNELLES
Les RTG doivent répondre aux exigences suivantes :
Les RTG doivent être de type diesel-électrique avec 16 roues. Le groupe diesel-génératrice doit être de type à vitesses variables.
Les RTG sont de type single lift et doivent avoir une capacité de levage de 40T sous spreader. Ils doivent pouvoir manipuler des conteneurs de type 20 pieds, 30, 40 et 45 pieds.
Les RTG doivent permettre d’enjamber 7 rangées de conteneurs et une voie de chargement de véhicules (7+1). Les RTG doivent permettre de lever un conteneur de type high cube (9’6”) sur une pile de 5 conteneurs de type high cube (9’6”).
Les RTG doivent permettre de manutentionner des conteneurs à partir de la zone de stockage ou une position donnée à terre vers des remorques portuaires ou des remorques routières et vice versa.
Tous les mouvements de levage, de déplacement du chariot et de déplacement du RTG doivent être réalisables simultanément. Le déplacement du RTG peut être limité à des vitesses réduites lorsque le levage est opérationnel. La simultanéité des mouvements n’est pas exigée pour le cas des RTG pouvant assurer des micromouvements dans le sens de la translation des RTG.
Toutes les opérations nécessaires pour le chargement/déchargement des conteneurs telles que la mise en marché du moteur diesel, le contrôle, l’allumage de l’éclairage, le levage/la descente, la direction du chariot, le déplacement, la correction du déplacement du RTG, la rotation, etc., doivent être réalisables par un seul opérateur depuis la cabine de conduite.
Les RTG doivent pouvoir tourner leurs roues à 90° dans l’objectif de permettre leurs déplacements sans charge et à vitesse réduite vers d’autres blocs de conteneurs.
Les RTG doivent pouvoir tourner leurs roues de telle façon à pouvoir assurer une rotation à 180° par rapport à un axe vertical et à vitesse réduite.
Les RTG doivent être équipés d’un headblock.
Les spreaders peuvent être de type tout électrique ou électro-hydraulique.
Les RTG doivent être équipé d’un DGPS permettant d’assurer les fonctionnalités d’autopilotage de la translation et de localisation des conteneurs.
Les RTG doivent être équipés par un système de contrôle de balancement (électronique ou mécanique) et par un mécanisme de trim/skew des conteneurs.
Les RTG doivent être doté d’un système de gestion embarqué (Crâne Monitoring System) et accessible à distance (Remote Crâne Monitoring System).
Les équipements auxiliaires, les préchauffages et l’éclairage doivent pouvoir être alimentés en énergie électrique de l’extérieur par le biais d’une prise électrique située sur le terreplein.
Article II- 2: CONDITIONS DU SITE
Température :
Les RTG doivent être opérationnels sans aucunes limitations dans un environnement marin avec une température ambiante variant de 0°C à 40°C.
45°C doit être utilisée comme la température pour la conception et le choix de tous les équipements de climatisation.
Humidité :
Le taux à adopter est : 99%
Environnement :
L’atmosphère est de type marin, présentant un air comportant de la poussière dégagée par de proches terminaux vraquiers. La pluie n’est pas fréquente mais peut devenir par certaines périodes extrêmement lourdes. Des vents forts peuvent avoir lieu de temps en temps.
Les RTG doivent être conçus en tenant compte de ces conditions environnementales du site.
Article II- 3: PORTEE DES TRAVAUX
La Portée des travaux est évaluée de manière aussi raisonnable qu’il est possible de le déduire des documents du présent marché et comprend, en plus des prestations exigées par le présent marché, tous les éléments suivants:
Conception détaillée, fabrication de tous les Equipements nécessaires aux travaux,
Pré montage et essais de tous les Equipements sur le site du Fournisseur,
Transport sur le site du Maître d’ouvrage des Equipements,
Mise en service des Equipements,
Livraison des Equipements pour essais de réception,
Essais de réception des Equipements,
Préparation et fourniture de la documentation technique par le Fournisseur,
Formation du personnel du Maître d’ouvrage,
Correction des défauts pendant la période de garantie.
La Portée des travaux s’arrête aux éléments suivants qui sont à la charge du Maître d’ouvrage:
Prise femelle de l’alimentation électrique des auxiliaires des RTG.
Article II- 4: REUNION DE LANCEMENT DU PROJET
Afin d’éviter toute mauvaise compréhension des exigences du présent contrat par le Fournisseur, de lui permettre de présenter en détail sa conception des RTG et des autres Equipements et de clarifier les différents aspects du projet, une réunion sera tenue dans les locaux du Fournisseur dès que possible après l’adjudication du contrat.
Les ingénieurs concernés du Fournisseur doivent assister à cette réunion et présenter leurs conceptions aux représentants du Maître d’ouvrage.
Les conceptions présentées doivent être appuyés par des plans à l’échelle, croquis, conception similaire antérieure ou tous autres moyens que les ingénieurs du Fournisseur jugent convenables pour expüciter et expliquer les concepts adoptés par eux pour ce projet.
Les aspects à aborder lors de cette réunion concerneront : les sous-traitants, le système d’assurance qualité et intervention du maître d’ouvrage, le planning détaillé de la réalisation, la documentation, la conception des installations mécaniques, électriques et des structures.
Article II- 5: SPECIFICATIONS TECHNIQUES ET CRITERES DE CONCEPTION
II-5-1 Généralités
5-1-1 Codes de conception, normes techniques et réglementations
Tous les Equipement doivent être conformes aux normes, standards et réglementations suivants (éditions en vigueur à la date de mise en service) :
règles et réglementations marocaines,
F.E.M. (Fédération Européenne de la Manutention) 1.001 : Règles pour le calcul des appareils de levage,
FEM (Fédération Européenne de la Manutention) 1.004 : Recommandations pour le calcul des charges dues au vent sur les structures des appareils de levage,
directive 2006/42/CE du Parlement européen et du Conseil concernant le rapprochement des législations des Etats membres relatives aux machines,
directive 2006/95/CE du Parlement européen et du Conseil concernant le rapprochement des législations des Etats membres relatives au matériel électrique destiné à être employé dans certaines limites de tension,
directive 2004/ 108/CE relative à la compatibilité électromagnétique (CEM).
La norme IEC 60204-32 relative à la sécurité des machines notamment des installations électriques des engins de levage.
Les règles VDE et C.E.I, pour l'électricité,
Les normes ISO pour la mécanique, les structures, l'Assurance Qualité.
Sauf disponibilité d’une norme locale ou indication explicite d’une norme à respecter, les normes européennes sont à utiliser pour ce contrat.
En règle générale, des ensembles complets de directives doivent être appliqués.
En cas de divergences entre les normes et directives applicables, la règle est de toujours préférer les normes et les réglementations les plus strictes ou de s’en remettre au jugement du Maître d’œuvre.
Les critères mentionnés ici représentent le minimum de normes acceptables. Si le Fournisseur estime qu’une ou plusieurs des normes ci-dessus recommandées sont inadaptées ou insuffisantes pour l’usage prévu, il est de sa responsabilité d’adopter des critères plus stricts.
Tous les symboles et unités de mesure utilisés dans les dessins, les spécifications et les calculs doivent être choisis dans le système métrique.
5-1-2 Cycle de charge théorique
(i) Mécanisme de levage et du chariot
Pour les besoins de la conception des éléments du mécanisme de levage et de chariot, le cycle de charge théorique à utiliser doit être basé sur ce qui suit :
La charge utilisée est la charge nominale du RTG
Chaque mouvement accélère, fonctionne, décélère à son niveau maximal et à la vitesse pour laquelle le RTG est conçu.
Le mouvement de levage et du chariot peuvent être effectués simultanément.
La température ambiante est la valeur maximale exigée.
Le vent de service est à sa valeur maximale.
(ii) Mécanisme de déplacement du RTG
Pour les besoins de la conception des éléments du mécanisme de déplacement du RTG, le cycle de charge théorique suivant doit être utilisé :
il consiste à un déplacement du RTG sur une pente de 1% de :
300m contre le vent de service sans des arrêts intermédiaires, ou
1000m contre la moitié du vent de service sans des arrêts intermédiaires
Chaque cycle doit être effectué une fois sans provoquer un échauffement nuisible.
5-1-3 Critères pour le personnel chargé de la conception
Le Fournisseur doit affecter au minimum le personnel clés suivants à la conception des travaux :
un Chargé de projet,
un Ingénieur de structure,
un Ingénieur en mécanique,
un Ingénieur en électricité,
un Ingénieur système,
un Responsable de l’assurance Qualité.
Tous les calculs et analyses nécessaires à la conception doivent être effectués ou méticuleusement vérifiés par l’Ingénieur responsable qualifié.
Tout (éventuel) changement dans la désignation du personnel clé par le Fournisseur doit être communiqué au Maître d’ouvrage.
5-1-4 Manière d’exécution
Tous les Prestations doivent être réalisées soigneusement et dans les règles de l’art. Elles doivent respecter les bonnes pratiques modernes en matière de construction de machines de haute qualité. Tous les travaux doivent être réalisés par des ouvriers travaillant, chacun, dans sa propre spécialité.
Tous les soudeurs, soudeurs sur machine et assembleurs par points de soudure doivent avoir obtenu une qualification pour les matériaux, les processus et le type de soudure à effectuer selon les normes en vigueur.
Les certificats de qualification de chaque soudeur, soudeur sur machine et assembleur par points de soudure et de chaque procédure doivent être intégrés dans le système d’assurance Qualité.
5-1-5 Matériaux et liaisons
Tous les matériaux utilisés dans la fabrication des RTG doivent être neufs et de première main. Ils doivent être sélectionnés pour garantir la fiabilité et la longévité des RTG dans les conditions d’exploitation et environnementales usuelles. Les matériaux doivent être adaptés à l’exposition aux conditions environnementales locales ou efficacement protégés contre elles. Si les codes ou les conditions environnementales sur le Site du Maître d’ouvrage s’avèrent plus restrictifs que les critères donnés ici, les matériaux doivent satisfaire aux exigences les plus restrictives.
Tous les composants et matériaux des RTG doivent être résistants et d’une technologie éprouvée. Les prototypes ainsi que les mécanismes et les composants non éprouvés ou de première série sont non acceptés par le Maître d’ouvrage.
Les composants et les matériaux destinés à des services identiques, similaires ou associés doivent provenir d’un même et unique fabricant. Si ces composants et matériaux présentent également les mêmes caractéristiques nominales, ils doivent être interchangeables. Les composants doivent être normalisés dans toute la mesure du possible.
Le couple de serrage des boulons doit être adapté à l’usage prévu. Les boulons ne doivent pas subir de variations de contraintes.
Si le Maître d’œuvre vient à questionner la qualité ou l’origine de matériaux et des composants, quels qu’ils soient, utilisés pour la construction des RTG ou la qualité des travaux réalisés sur ou pour celui-ci, le Fournisseur supportera seul le coût raisonnable de faire la preuve que la qualité desdits matériaux et composants ou de l’exécution est conforme aux exigences du présent marché ou, si lesdits matériaux et composants ou l’exécution ne sont pas spécifiquement ceux indiqués dans le présent marché, qu’ils sont nonobstant de la qualité attendue.
5-1-6 Durée de vie
Tous les RTG doivent être conçus pour un fonctionnement en continu dans les conditions environnementales usuelles.
Tous les RTG doivent être conçus pour la durée de vie indiquée en cycles de levage.
Durée de vie pour les structures principales
Cycles de levages Cycles 2.000.000
Un cycle de levage est un déplacement d’un conteneur d’une remorque vers la zone de stockage ou l’inverse y compris le mouvement de retour au point de départ.
5-1-7 Charges à lever
Les RTG doivent avoir une charge utile sécurisée sous le spreader telle que donnée dans le tableau ci-dessous :

Les RTG doivent être capable de compenser une excentricité de charge de 10 % dans l’axe longitudinal comme dans l’axe transversal du conteneur.
5-1-8 Classification des RTG et des mécanismes
La classification des RTG et des mécanismes doit être conforme à la norme F.E.M. 1.001, 3,cmc édition. Elle ne doit pas être inférieure aux valeurs des Tableaux suivants.

La durée d’utilisation en heures des mécanismes est la valeur supérieure de la classe d’utilisation demandée (Tj) telle que définie par la FEM.
5-1-9 Charges maximales, stabilité et contraintes admissibles
Les charges à prendre en compte doivent comprendre, mais sans limitation à celles-ci, toutes les charges prévues par la norme F.E.M. 1.001, 31cmc édition. Les charges dues aux effets de température, aux contraintes de montage et autres, selon l’expérience du Fournisseur, doivent être incluses dans l’analyse lorsqu’elles sont susceptibles d’engendrer des contraintes significatives. Si l’analyse rationnelle montre l’existence de charges supérieures à celles spécifiées, ces charges supplémentaires doivent être prises en considération.
Charges maximales
La structure des RTG doit être conçue pour supporter toutes les charges maximales et les combinaisons de charges maximales aux niveaux de contraintes admissibles.
Les facteurs d’impact peuvent être calculés sur la base de l’expérience du concepteur ou déterminés par analyse dynamique, à l’appréciation du Fournisseur. L'expérience doit être démontrée par des preuves telles que des rapports d'essais.
Stabilité minimale des RTG
La conception des RTG doit lui permettre de rester stable dans toutes les conditions indiquées par la norme F.E.M. 1.001, 3,èmc édition.
Contraintes admissibles
Les contraintes admissibles pour les conditions d’exploitation, les conditions de surcharge, les conditions en situation arrimée et la fatigue doivent être conformes aux spécifications de la norme F.E.M. 1.001, 3lcmc édition.
Les contraintes de base doivent être calculées pour les conditions maximales suivantes :
Charge nominale (40T) agissant sur l’axe central du spreader et du chariot et positionnée sur les positions les plus critiques,

Translation - English Article I- 26: WITHHOLDING OF WARRANTY
It is expected to have a holdback of seven percent (7%) of the amount of the increased contract, if any, of the amount of amendments.
The holdback may be replaced at the request of the Supplier, by a personal and joint warranty constituted as per the conditions set by the applicable regulations.
The holdback is restored or the warranty which replaces it is released following a release issued by the project Manager within a maximum period of three months from the date of final acceptance of the contract.
Article I-27: PENALTIES FOR DELAY
Failure to perform the services on prescribed time will result in a penalty on the Supplier for each calendar day of delay, by 1% o (one per thousand) of the amount of services performed late.
This penalty will be applied automatically and without notice on all sums due to the Supplier.
The application of these penalties does not relieve the Supplier from his obligations and responsibility that he incurs under this contract.
The cumulative amount of these penalties is capped at 10% of the amended or supplemented contract, possibly through amendments.
When the limit of penalties is reached, the competent authority is entitled to terminate the contract after a prior notice is sent to the Supplier and without prejudice to the application of the required coercive measures.
Article I-28: TAXES
The Supplier is deemed to have fully read the tax laws in force in Morocco. Therefore, he will pay all taxes in accordance with the legislation in force.
In the case of non-resident foreign companies in Morocco, a withholding tax under the income tax, if any, fixed at a rate of ten percent (10%) will be charged on the amount excluding tax the value added benefits of services rendered by foreign companies as part of this contract.
Article I-29: ACTS OF GOD
Under the contract, force majeure means any event which is unforeseeable, irresistible and beyond control of the Parties.
Neither Party shall be liable for not having done or accomplished with delay an obligation under the contract, to the extent that such failure or delay results directly from events occurring at any time during the contract performance and presenting the characteristics of force majeure.
However, force majeure does not exempt one party or the other from its obligation to pay the amounts due before the occurrence of the event of force majeure under this contract.
Article I-30: TERMINATION OF THE CONTRACT
The termination of the contract may be decided in accordance with the provisions of the GCC-T.
The termination of the contract does not preclude the implementation of civil or criminal proceedings that may be brought against the Contract Supplier because of his mistakes or violations.
If fraudulent acts, repeated violations of working conditions or serious breaches of commitments were raised against the Supplier, the project Manager may, without prejudice to any prosecutions and sanctions for which the Supplier is liable, by motivated decision, temporarily or permanently exclude him from participation in procurement launched by the project Manager.
Article I-31: FIGHTING FRAUD AND CORRUPTION
The Supplier shall not resort in person or through an intermediary to acts of corruption, fraudulent maneuvers and collusive practices in any capacity whatsoever in the different procedures of award, management and implementation of the contract.
The Supplier shall not, in person or through an intermediary, make promises, donations or gifts in order to influence the different procedures of conclusion of this contract and during the stages of its implementation.
The provisions of this Article shall apply to all stakeholders in the implementation of this contract.
Article I-32: SETTLEMENT OF DISPUTES AND APPLICABLE LAW
All disputes arising in connection with the interpretation or execution of the contract will be, if they are not settled amicably, of the competence of the Commercial Court of the city of Casablanca.
This contract is subject to Moroccan law whether for its meaning, its interpretation, its execution and for the relations established between parties.
CHAPTER - II: TECHNICAL PROVISIONS
This chapter describes the particular specifications of equipment to be supplied.
Article II-1: GENERAL CHARACTERISTICS / OPERATING
RTG shall meet the following requirements:
• RTG must be diesel-electric type with 16 wheels. The diesel-generator group must be of the type with variable speed.
• RTG are single lift type and must have a lifting capacity of 40T under the spreader. They must be able to handle the type of containers of 20, 30, 40 and 45 feet.
• RTG must allow the spanning of seven rows of containers and a vehicle loading track (7 + 1). The RTG should allow the lifting of a container of high cube type (9'6 ") on a stack of five containers of high cube type (9'6").
• The RTG should allow the handling of containers from the storage area or a given position on the ground to port trailers or truck trailers and vice versa.
• All movements of lifting, of movement of the carriage and RTG movement must be achievable simultaneously. Moving the RTG can be limited at low speeds when the lifting is operational. The simultaneity of movements is not required in the case when RTG can provide micro-movements in the direction of the translation of the RTG.
• All the operations necessary for loading / unloading of containers such as turning on diesel engine, control, switching on the lights, the lifting / lowering, the direction of the truck, moving, correction of movement of RTG, rotation, etc., should be achievable by a single operator from the cab.
• RTG must be able to turn their wheels to 90 ° with the aim of allowing their movements without load and at low speed towards other blocks of the container.
• RTG must be able to turn their wheels so as to ensure a rotation of 180 ° with respect to a vertical axis and at reduced speed.
• RTG shall be equipped with a headblock.
• The spreaders can be of the type fully electrical or electro-hydraulic.
• RTG must be equipped with a DGPS to ensure the functionality of the auto-piloting of translation and localization of containers.
• RTG must be equipped with a swing control system (electronic or mechanical) and a trim mechanism / skew of containers.
• RTG must be equipped with an onboard management system (Skull Monitoring System) and accessed remotely (Remote Crane Monitoring System).
• Auxiliary equipment, preheating and the lighting must be able to get supplied with electric power from the outside through an outlet situated on the full earth.
Article II-2: SITE TERMS
• Temperature:
Ο RTG must be operational without any limitations in a marine environment with ambient temperatures ranging from 0 ° C to 40 ° C.
Ο 45 ° C should be used as the temperature for the design and selection of all the air conditioning equipment.
• Humidity:
Ο The rate to be adopted is: 99%
• Environment:
Ο The atmosphere is of marine type with an air containing dust given off by nearby bulk terminals. The rain is not common but can become in some extremely heavy periods. Strong winds may occur from time to time.
RTG must be designed taking into account the environmental conditions of the site.
Article II-3: SCOPE OF WORK
The Scope of Work is assessed in a reasonable way that it is possible to deduce it from the documents of this contract and includes, in addition to the services required by this contract, the following items:
• Detailed design, manufacturing of all equipment necessary for the work,
• Pre assembly and testing of all equipment on the Supplier's site,
• Transport of equipment on the site of project Manager,
• Commissioning of equipment,
• Delivery of equipment for receiving tests,
• Receiving tests of equipment,
• Preparation and supply of technical documentation by the Supplier,
• Training of staff by the project Manager,
• Correction of defects during the warranty period.
The Scope of Work stops at the following elements which are the responsibility of the Client:
• Socket for power supply to accessories of RTG.
Article II-4: MEETING ON PROJECT LAUNCHING
To avoid any misunderstanding of the requirements of this contract by the supplier, and to allow him to present in detail the design of RTG and other equipment and to clarify the different aspects of the project, a meeting will be held at the premises of the Supplier as soon as possible after contract award.
The concerned engineers of the Supplier must attend the meeting and present their views to representatives of the project Manager.
The designs submitted must be supported by scale drawings, sketches, previous similar design or any other means that engineers of the Supplier deem appropriate to explain the concepts adopted by them for this project.
The issues to be addressed at this meeting will concern: subcontractors, quality assurance system and intervention of the client, the detailed scheduling of implementation, documentation, and design of mechanical and electrical structures.
Article II-5: TECHNICAL SPECIFICATIONS AND DESIGN CRITERIA
II-5-1 General
5-1-1 Design codes, standards and technical regulations
All equipment must comply with the following norms, standards and regulations (current editions on the date of commissioning):
• Moroccan rules and regulations,
• FEM (European Federation of Materials Handling) 1001: Rules for the design of lifting apparatus,
• FEM (European Federation of Materials Handling) 1004: Recommendations for calculating wind loads on structures of lifting equipment,
• Directive 2006/42 / EC of the European Parliament and of the Council concerning the approximation of the laws of the Member States relating to machinery,
• Directive 2006/95 / EC of the European Parliament and of the Council on the approximation of the laws of the Member States relating to electrical equipment designed for use within certain voltage limits,
• Directive 2004/108 / EC on electromagnetic compatibility (EMC).
• IEC 60204-32 relating to machinery safety including electrical installations hoists.
• The VDE and IEC rules for electricity,
• ISO standards for mechanic, structures, Quality Assurance.
• Unless availability of a local standard or explicit indication of a standard to be met, the European standards are to be used for this contract.
Generally, complete sets of guidelines shall be applied.
In case of differences between the applicable standards and guidelines, the rule is to always prefer the highest standards and regulations or rely on the judgment of the Project Manager.
The criteria mentioned here are the minimum acceptable standards. If the Supplier believes that any of the above recommended standards are inadequate or insufficient for the intended use, it is his responsibility to adopt more stringent criteria.
All symbols and units of measurement used in the drawings, specifications and calculations shall be selected in the metric system.
5-1-2 Theoretical load cycle
(i) Mechanism of lifting and of the carriage
For the purposes of the design of elements of the lifting and carriage mechanisms, the theoretical duty cycle to be used must be based on the following:
• The load used is the nominal load of RTG
• Every movement accelerates, runs and then decelerates at its maximum level and the speed for which RTG is designed.
• The lifting movement of the carriage can be performed simultaneously.
• The ambient temperature is the required maximum value.
• The wind of service is at its maximum value.
(ii) RTG motion mechanism
For the purposes of the design elements of the movement mechanism RTG, the following theoretical charge cycle must be used:
• it consists in a movement of the RTG on a slope of 1%:
• 300m against the wind of service without intermediate stops or
• 1000m against half the wind of service without intermediate stops
• Each cycle must be performed once without causing harmful heating.
5-1-3 Criteria for staff responsible for the design
The Supplier must appoint at least the following key staff in the design of work:
• a Project Manager,
• a structural engineer,
• a mechanical engineer,
• an electrical engineer,
• a system engineer,
• a Quality Assurance Manager.
All calculations and analyzes necessary for the design must be done or meticulously checked by competent Engineer in charge.
All (possible) changes in the appointment of key personnel by the Supplier must be communicated to the project Manager.
5-1-4 Manner of Execution
All services must be carried out carefully and within the rules of art. They must comply with good practice in modern high-quality construction machinery. All work must be performed by workmen, each in their own specialty.
All welders, welders on machine and assemblers by welding points must have obtained a qualification for materials, processes and the type of welding to be performed according to the standards in force.
The qualification certificates of each welder, welder on machine and assembler by welding points and each procedure must be integrated into the quality assurance system.
5-1-5 Materials and links
All materials used in the manufacturing of RTG must be new and of first hand. They must be selected to ensure the reliability and longevity of the RTG in operating conditions and environmental standards. The materials must be adapted to exposure to local environmental conditions or effectively protected against them. If the codes or environmental conditions on the Site of the project Manager are more restrictive than the criteria given here, the materials must meet the more restrictive requirements.
All components and materials of RTG shall be tough and of proven technology. The prototypes and the mechanisms and untested or first series components are not accepted by the project Manager.
Components and materials for identical, similar or related services must come from one and the same manufacturer. If these components and materials also have the same nominal characteristics, they must be interchangeable. The components must be standardized as far as possible.
The bolt tightening torque must be adapted to the intended use. The bolts must not be subjected to stress variations.
If the Project Manager is to question the quality or origin of materials and components, whatever they are, used for the construction of RTG or quality of the work or performed on or for the latter, the Supplier shall bear alone the reasonable cost to demonstrate that the quality of those materials and components or workmanship meets the requirements of this contract or, if such materials and components or performance are not specifically those indicated in this contract, they are still of the expected quality.
5-1-6 Lifetime
All RTG must be designed for continuous operation under the usual environmental conditions.

The duration of use in hours of mechanisms is the higher value of the use class requested (Tj) as defined by the GEF.
5-1-9 Maximum loads, permissible stability and constraints
The loads to be considered shall include, but not limited thereto, all charges under the FEM 1.001 standard 31cmc edition. The loads due to temperature effects, the mounting constraints and others, according to the experience of the supplier, must be included in the analysis if they are likely to generate significant constraints. If rational analysis shows the existence of loads greater than those specified, these additional loads must be considered.
Maximum loads
RTG structure must be designed to withstand all maximum loads and combinations of maximum loads at allowable stress levels.
Impact factors can be calculated on the basis of the experience of the designer or dynamic analysis determined at the discretion of the Supplier. The experience must be demonstrated by evidence such as test reports.
Minimum stability RTG
The design of RTG must allow it to remain stable in all conditions set by the FEM 1.001 standard, 3, EMC edition.
Allowable stresses
The allowable stresses for operating conditions, overload conditions, conditions in the stowed position and fatigue must comply with the specifications of the standard FEM 1.001, 3rd edition.
• Basic Constraints must be calculated for the following maximum conditions:
• Nominal load (40T) acting on the central axis of the spreader and carriage and positioned on the most critical positions,
• 35.5t at a maximum eccentricity acting on the spreader and the truck positioned on the most critical positions,
* The calculation of fatigue / battery charge:
• The fatigue calculation should be based on a period of 2000000 lifting cycle with an average load of at least 25t acting on the center of the spreader and carriage.
Allowable wind speed
The defined allowable wind speeds must be neither lower nor at the values given in the table below, nor the values defined by FEM 1001.
