Source text - Polish ARTYKUŁ 6. PERSONEL WYKONAWCY I PODWYKONAWCY
6.1 Nie później niż w DNIU ROZPOCZĘCIA, WYKONAWCA pisemnie wyznaczy kompetentną oraz doświadczoną osobę posiadająca niezbędne kwalifikacje do pełnienia funkcji PRZEDStAWICIELA WYKONAWCY ze strony WYKONAWCY. Osoba ta będzie posiadać uprawnienia do kierowania robotami drogowymi bez ograniczeń zgodnie z wymogami ustawy Prawo budowlane i posadająca aktualne zaświadczenie o przynależności do Okręgowej Izby Inżynierów Budownictwa. Osoba ta będzie odpowiedzialna za zagadnienia administracyjne, nadzór oraz koordynację wykonywania zobowiązań WYKONAWCY wynikających z KONTRAKTU.
6.2 INWESTOR wyraża zgodę na zawarcie umów z PODWYKONAWCAMI wyszczególnionymi w Załączniku Nr 5 („Lista Podwykonawców”).
6.3 Zawarcie przez WYKONAWCĘ umów z PODWYKONAWCAMI innymi niż wymienieni na Liście Podwykonawców jest możliwe wyłącznie za uprzednia zgodą INWESTORA wyrażoną na piśmie.
6.4 Wyrażenie przez INWESTORA zgody, o której mowa w punkcie 1 i 2 powyżej nie zwalnia WYKONAWCY z odpowiedzialności ani obowiązków przewidzianych KONTRAKTEM, w związku, z czym WYKONAWCA pozostanie odpowiedzialny za wszelkie działania, błędy, zaniechania i zaniedbania ze strony każdego z PODWYKONAWCÓW.
Translation - English ARTICLE 6. CONTRACTOR AND SUBCONTRACTOR PERSONNEL
6.1 No later than the COMMENCEMENT DATE, the CONTRACTOR will nominate in writing a competent and experienced person with suitable qualifications to fulfil the function of CONTRACTOR REPRESENTATIVE. This person will have unlimited authority to supervise road works in accordance with the requirements of the Construction Law and must have a valid certificate showing that (s)he is a member of a District Chamber of Construction Engineers. This person will be responsible for administrative issues and will supervise and coordinate the CONTRACTOR’s performance of its obligations under the CONTRACT.
6.2 The INVESTOR must agree to the conclusion of agreements with the SUBCONTRACTORS listed in Attachment 5 (“List of Subcontractors”).
6.3 The conclusion by the CONTRACTOR of agreements with SUBCONTRACTORS other than those listed in the List of Subcontractors is possible exclusively upon the INVESTOR's prior agreement expressed in writing.
6.4 The INVESTOR's agreement referred to in clauses 1 and 2 above does not release the CONTRACTOR from liability or from its obligations hereunder, and accordingly the CONTRACTOR will be liable for all actions, mistakes, interruptions or negligence on the part of each of the SUBCONTRACTORS.
