La ineficacia sobrevenida de la obligación de arbitrar deriva de los términos de los artículos 1, 3, 4 (I), 89, 121, 122 y 123 de la LCM, pues los créditos que reclama el demandante son créditos concursales, por haber sido propuestos para el *reconocimiento* del juez federal en el concurso mercantil seguido en contra de XXX, y a la fecha se encuentran ya reconocidos por dicho juez, lo que implica el sometimiento a la jurisdicción del juez de distrito mexicano, excluyendo de esta manera la competencia del Tribunal Arbitral.
