agree  LiaBarros: I agree with your translation but not with your commentary. It's important in this case let it clear that the article 339 is an operative norm, I think. This is not implied.

I think your translation, although it doesn't sound quite right to you, seems to be what is generally used. If you do a Google search on "Constitution" and "operative standard" this is used more often than "operative norm".
