Me parece que es "evidencia circumstancial"
Estoy de acuerdo con Patricia Lutteral, pues aunque no soy experto en el tema, ya en varios textos legales de mi país he podido ver la diferencia que se hace específicamente entre "elementos materiales y de juicio", esto es, evidencia concreta y evidencia circumstancial (que no es evidencia física sino el producto del razonamiento de quien la aporta).
