An additional note that does not necessarily apply in this case: when this phrase has to do with real estate, an appropriate translation would be: first mortgage (rights) as opposed to second mortgage (rights).

i.e. if this defence or plea is waived, the guarantor accepts primary liability.

Using Roman civil law terms like excussio(n) is not very helpful.
