Le partenaire co-contractant s’engage à ne recourir à aucune interférence ni pratique immorale ou déloyale dans le but d’avantager ses offres par rapport aux autres concurrents.
Le partenaire co-contractant s’interdit, conformément à la loi de promettre d’offrir ou d’accorder à un agent public, directement ou indirectement, soit pour lui-même ou pour une autre personne ou entité, des cadeaux des voyages d’information ou de formation, des prises en charge etc., ou tout autre avantage quelle que soit sa nature ou sa valeur, dans le but de faciliter ou privilégier le traitement de son dossier au détriment de la concurrence loyale.
En cas de découverte d’indices concordants de partialité ou de corruption, avant, durant ou après le processus de contractualisation, des mesures coercitives seront prises à l’encontre des contrevenants pouvant aller jusqu’à l’inscription sur liste noire des opérateurs, la résiliation du contrat et/ou des poursuites judiciaires.

Druhý zmluvný partner sa zaväzuje, že sa neuchýli k žiadnemu zasahovaniu ani k nemorálnym alebo nečestným praktikám za účelom zvýhodnenia vlastnej ponuky pred ostatnými konkurentmi.
Druhý zmluvný partner sa vzdáva, v súlade so zákonom, sľubov ponúknuť alebo odsúhlasiť verejnému činiteľovi, priamo alebo nepriamo, sám alebo za inú osobu alebo entitu, informačné alebo vzdelávacie cesty, zaopatrenie atď. alebo akékoľvek iné výhody akejkoľvek povahy alebo hodnoty za účelom podporovať alebo privilegovať zaobchádzanie s jeho spisom na úkor čestnej konkurencie.
V prípade indícií svedčiacich o zaujatosti alebo korupcii pred, počas alebo po skončení procesu zmluvných úprav sa uplatnia donucovacie opatrenia voči porušovateľom, ktoré môžu viesť až k zápisu na čiernu listinu dodávateľov, k zrušeniu zmluvy a/alebo trestnému stíhaniu.
