French to English Bus/Financial
"Documents d’urbanisme, et état des servitudes pouvant avoir une incidence sur la valeur vénale." Doesn't this refer to "easements" that could impact the property value? The translation I'm editing reads as follows: "Town planning and third party charges documents which might affect the market value of the property" (in a list of documents provided by the client). The translation is in British English. Thanks, Karen

I am no common law expert, but my recollection of my property law class indicates that "easement" is the preferred term to translate the civil law term "servitude". By the way, if you were translating this for the Quebec English market, "servitude" would also be correct in English. Termium does also provide "encumbrance", but I don't think it is specific enough to describe an encumbrance which is a servitude. As far as I know, an encumbrance could be any type of charge on property (including mortgages, etc.), but an easement specifially refers to a encumbrance which is a "servitude". I think the translation you're editing is also unclear with its use of "third party charges", since a mortgage is a third party charge, but is not an easement.

you can use it indeed or else

servitudes covers : properties the owner can get profit from renting or from a right of way and it is also used in more ancient texts and or large older properties such as castles, manors or farms for the attached buildings where they may have put horses or hay, etc ,a and which although they may not currently be in use, they could get a profit from were they allocated to a third party.

I hope my English is still understandable today as I have had a very hard day (and heard only badly spoken English).
