Umowa (pisana przez Finów) dotyczy świadczenia usług informatycznych, głównie w zakresie tworzenia oprogramowania.
Jest w niej cały artykuł zatytułowany "Service Warranty and Step-in Rights" i, szczerze mówiąc, brak mi pomysłu, jak to po polsku ująć, choć wydaje mi się, że rozumiem o co chodzi.
When exercising its step-in rights, [Zamawiający] shall provide a prior written notice to Supplier (the “Step-In Notice”). The Step-In Notice shall specify in reasonable detail i) the basis on which [Zamawiający] is entitled to exercise its step-in rights; ii) the affected Services; and iii) how it proposes to remedy the affected Services.
When [Zamawiający]’s step-in rights are triggered in accordance with this Section, [Zamawiający] may exercise any of the following rights and take any of the following actions: (i tu następuje lista, raczej nieistotna dla pytania)

During the step-in period [Zamawiający] will be responsible for the changes that are made to the Services subject to the step-in rights. [Zamawiający] has the responsibility to inform Supplier of all measures taken and changes made to the service environment by or on behalf of [Zamawiający] during the step-in period.

As soon as both Parties agree that the failure is corrected this step-in right shall end or the step-in right shall be deemed to lapse when the relevant systems are fully operational for a period of three (3) business days without any unplanned outage or material interruption.

Notwithstanding the above, the Parties shall endeavour to exit the step-in period within one (???) ninety (90) days from when [Zamawiający] or a third party assumed the performance of the Services or part thereof as described above.

Wiem, że pytanie już tu padło kiedyś, ale mam wątpliwości, czy w moim przypadku chodzi o to samo...

Jednocześnie, zgadzam się z mike'iem23 -- razi mnie trochę, bo kojarzy mi się z prawem do interwencji państwa, policji, straży miejskiej, a jeszcze kiedyś... ORMO :)) ... ale także - nie jestem tu specjalistą i może tak ma być
trzeba zweryfikować z brzmieniem polskich przepisów, kodeksy, ...

Wstępowanie w prawa też było moim pierwszym pomysłem, ale im dłużej o tym myślę, tym mniej mi pasuje...
I odnośnie do Twojego ostatniego komentarza, bardzo podobnie kombinowałem, ale - podobnie jak Ciebie - żadna z tych opcji mnie nie przekonała.
Mam nadzieję, że jakiś prawnik się zlituje :)
Niestety z żadnym z nich się nie zgadzam, ale może ktoś się lepiej na tym zna. Przydałby się prawnik. Osobiście obstawiam pomysł z "wstąpieniem w prawa (i obowiązki)" i wariacje na temat
