However, not everyone has the same opinion, as you will see if you look it up. Please see 1st ref for Joan Wallace's case for using discussion, and not excussion, which certainly convinced me when I first looked up the term. excluding the benefits? expressly accepting personal, primary and joint liability Explanation: Shorter version or another way of looking at any exclusion: 'expressly accepting primary liability' used by Eng. lawyers in Madrid. This question has come up before on KudoZ, so there are plenty of answers to look at. The only thing is that the benefits of order, division and excussio are Roman law terms that are meaningless in Rng. Orden> giving the creditor priority to claim; division > dividing up the debt and letting the creditor claim a several part; excussio > the guarantor can require the creditor to sue the debtor first. If these benefits are excluded, then the above phrases are usable. |
