GÉNÉRALITÉS
Il appartient au Client sous sa seule responsabilité, avant toute intervention de XXX ou d'un prestataire sur le réseau informatique ou sur le serveur du Client, ou avant toute installation d'un utilitaire, pour les produits XXX, par le Client par quelque moyen que ce soit, y compris le téléchargement, de procéder à la sauvegarde des fichiers, programmes ou bases de données figurant sur son serveur, de la vérifier et de la certifier.
En conséquence, malgré le soin apporté par XXX ou par le prestataire à la réalisation des prestations, le Client reconnaît que XXX ne pourra pas être tenu responsable des dégradations éventuelles des fichiers, des programmes, des bases de données ou de toutes autres informations ou plus généralement du fonctionnement du serveur ou du réseau informatique et qui seraient consécutives à l'intervention du XXX ou du prestataire. De même, il appartient au Client de s'assurer préalablement que XXX ou le prestataire peut librement intervenir sur son réseau informatique ou sur son serveur. Une copie du Logiciel est autorisée à des fins de sauvegarde uniquement.
2. RESTRICTIONS
Vous vous engagez à n'utiliser le Logiciel que conformément aux clauses du présent contrat et à ne pas concéder, céder en sous-licence ou en crédit-bail, vendre, louer, prêter ou transférer le Logiciel à un tiers. 3. DROITS D'AUTEUR

XXX et ses revendeurs conservent à tous égards les droits de titre et de propriété intellectuelle, ou non, relatifs au Logiciel. Sauf disposition expresse dans le présent contrat, XXX ne vous transfère ou accorde par le présent contrat aucune licence ni aucun droit, explicite ou implicite, relatifs à la propriété intellectuelle de XXX ou de ses revendeurs.

Vous pouvez résilier ce Contrat en détruisant l'original et toutes les copies du Logiciel en votre possession. Ce Contrat est automatiquement résilié en cas de violation de ses clauses ou conditions. Lors de la résiliation de ce Contrat, outre la mise en application des droits de XXX, vous vous engagez à détruire immédiatement l'original et toutes les copies du Logiciel en votre possession. Nonobstant ce qui précède, la section 4 et les sections 7 à 11 restent valables même après la résiliation du Contrat.
9. LOI AMÉRICAINE DES RESTRICTED RIGHTS
Le Logiciel est un "produit commercial", tel que défini par l'article 48 C.F.R. 2.101 (octobre 1995) ; il est composé d'un "logiciel commercial" et d'une "documentation de logiciel commercial", selon les termes de l'article 48 C.F.R. 12.212 (septembre 1995). Conformément à l'article 48 C.F.R. 12.212 et aux articles 48 C.F.R. 227.7202-1 à 227.7202-4 (juin 1995), tous les utilisateurs finaux du Gouvernement des Etats-Unis doivent acquérir le Logiciel uniquement en accord avec les droits énoncés dans le présent contrat. OVERVIEW
The customer is responsible for backing up and certifying his own files, programs and databases stored on his server before allowing XXX or a XXX’s contractor to service his network or server, or before installing any XXX product utility software by any mean whatsoever, including by way of download.
Therefore, the client agrees that XXX cannot be held responsible for possible degradations of his files, programs, databases or other data, or more generally any degradation of the performance of his server or network, as might arise despite XXX’s or a XXX contractor’s effort to offer quality service. Similarly, the customer is responsible for making sure that XXX or XXX’s contractor will be able to work freely on his network or server. Therefore, XXX will not be responsible for any effect XXX’s work could potentially have on any right held by the customer, or on any obligation the customer could have toward third parties in relation to his computer equipment.
In case of standard exchange, XXX shall be under no obligation and may not be able to restore the contents of files, programs or databases or other data recorded on the original equipment. Besides, should XXX’s responsibility for any damage be acknowledged, any compensation payable by XXX shall not exceed the amount originally paid by the customer to XXX for the service which may have caused the damage. Furthermore, XXX will accept no responsibility for indirect damages, loss of income or any damage to customer’s data, whether direct or indirect.
The customer acknowledges that the information contained in this document is accurate and complete. The customer is responsible for any needed upgrading of his computer system or equipment to meet the above mentioned requirements before XXX’s print solution is set up. The customer shall inform XXX of any future modification to his computing environment, software or hardware, as described in this document. XXX shall not be held responsible for any malfunction of its solution that could arise as a result of a modification of the customer’s computing environment not previously approved by XXX. Before approving of a modification, XXX may require that a new installation description document be issued.
IMPORTANT - XXX SOFTWARE (DRIVER) LICENCE AGREEMENT
This document is a contract (hereafter “the Contract”) between you and XXX Inc. (hereafter “XXX”) relating to the use of XXX software, including its associated manuals or printed documentation (hereafter ‘the Software”) designed to drive certain XXX multifunction devices, photocopiers or printers (hereafter “the Products”).
BE SURE TO READ CAREFULLY AND UNDERSTAND THE RIGHTS AND LIMITATIONS DESCRIBED IN THIS CONTRACT BEFORE USING THE SOFTWARE. BY INDICATING YOUR AGREEMENT OR BY USING THE SOFTWARE, YOU AGREE TO ALL CLAUSES AND CONDITIONS OF THIS CONTRACT. DO NOT USE THE SOFTWARE IF YOU DISAGREE TO ANY OF THESE CLAUSES OR CONDITIONS. THE SOFTWARE HAVING BEEN SUPPLIED TO YOU FREE OF CHARGE, NO REIMBURSEMENT WILL BE GRANTED.
1. GRANTING OF LICENCE
XXX grants you a licence for a personal, limited and non-exclusive use of the Software ( “use” being used in this contract to refer to storing, loading, installing, accessing, executing or displaying data), solely in association with the Products, on computers connected directly or via a network to said Products (hereafter “the Designated Computer”).
The use of the Software by third parties or from other computers connected to the Designated Computer is allowed only as long as the clauses of this contract are not breached and third-party users are subject to the restrictions and obligations described below.
Creating one copy of the Software for back-up purpose only is allowed.
2. RESTRICTIONS
You agree to use the Software only as stipulated in the causes of this contract, and in particular to refrain from donating, sub-licensing, leasing, selling, renting or transferring the Software to any third party. It is strictly prohibited to alter, translate or convert into another programming language, modify, disassemble, decompile or reverse-engineer the Software, whether directly or via a third party.
3. COPYRIGHT
You may not alter or remove from the Software or any copy of the Software any mention of XXX’s or its resellers’ copyright.
4. PROPERTY
XXX and its resellers retain all property rights, whether of intellectual property or not, in any respect, to the Software. Except as otherwise stipulated in this contract, XXX has granted or transferred to you no licence or right, whether explicitly or implicitly, relative to the intellectual property of XXX or its resellers.
5. EXPORT RESTRICTIONS
You agree to abide by all laws, restrictions and regulations relating to the exportation of the Software, as applicable to your country of residence, and you agree to refrain from exporting or re-exporting the Software, whether directly or indirectly, if in breach of such laws, restrictions and regulations, or without first having obtained all required authorisations.
6. LACK OF ASSISTANCE
XXX, ITS SUBSIDIARIES AND ASSOCIATES, THEIR RESELLERS OR SUPPLIERS AND XXX’S RESELLERS MAY NOT BE HELD ACCOUNTABLE FOR ANY LACK OF MAINTENANCE OR ASSISTANCE RELATING TO THE USE OF THE SOFTWARE. NO PATCHES, UPDATES OR ASSISTANCE WILL BE AVAILABLE FOR THE SOFTWARE.
7. DISCLAIMER OF WARRANTY AND ABSENCE OF COMPENSATION

8. VALIDITY
This Contract becomes valid as soon as you accept it, either by indicating your agreement or by using the Software, and remains in effect until terminated. You may terminate this contract by destroying the original Software and any copy of it in your possession. Termination of this Contract becomes automatic in case of breach of any of its clauses or conditions. Upon terminating this Contract, besides acknowledging XXX’s rights, you agree to immediately destroy the original Software as well as any copy of it that you may still possess. Notwithstanding the above, section 4 and sections 7 to 11 above remain valid beyond Contract termination.
9. U.S. LAW ON RESTRICTED RIGHTS
This Software is a “commercial product” as defined by Article 48 C.F.R. 2.101 (October 1995); it is composed of a “commercial software” and a “commercial software documentation” according to the terms of Article 48 C.F.R. 12.212 (September 1995). According to Article 48 C.F.R. 12.212 and Articles 48 C.F.R. 227.7202-1 to 227.7202-4 (June 1995), all end-users of the Government of the United States of America must acquire the Software solely according to the rights set forth in this Contract. The manufacturer is XXX Inc. [[postal address]], Japan.
10. AUTONOMY OF CONTRACT CLAUSES
Should a clause of this contract be declared illegal by any court of law or any other appropriate authority, the clause in question will become null for that particular jurisdiction or authority, however this shall not invalidate the other clauses of this Contract.
11. ACCEPTATION
BY INDICATING YOUR AGREEMENT OR BY USING THE SOFTWARE, YOU ACKNOWLEDGE HAVING READ THIS CONTRACT, HAVING UNDERSTOOD ITS TERMS AND BEING BOUND BY ITS CLAUSES AND CONDITIONS. YOU ALSO ACKNOWLEDGE THAT THIS DOCUMENT IS THE FULL AND EXCLUSIVE TEXT OF THE CONTRACT BETWEEN YOU AND XXX, AND THIS IT PREVAILS OVER ANY EARLIER CONTRACT OR PROPOSITION, WHETHER VERBAL OR WRITTEN, AND OVER ANY OTHER COMMUNICATION BETWEEN YOU AND XXX AS TO THE CONTENTS OF THIS CONTRACT. NO AMENDMENT TO THIS CONTRACT SHALL BE VALID UNLESS SIGNED BY AN OFFICIAL REPRESENTATIVE OF XXX.

Four new high-speed, LVPECL and LVDS clock fanout buffers for the ultra-low jitter and skew requirements of SONET/SDH communications systems, high-end enterprise server applications, and ATE systems have been developed by Micrel Semiconductor (NASDAQ: MCRL), an industry leader in the design and manufacture of integrated circuits for the high-speed communications, analog and power management markets.
The latest additions to Micrel’s Precision Edgeª Timing & Distribution family, the SY89831, SY89832/3, and SY89834 are high-speed, precision LVPECL and LVDS 1:4 fanout buffers. The devices are designed with a unique input stage that includes internal termination and the ability to accept any differential input source, whether the input signal is AC-coupled or DC-coupled. No external components are required in the signal path. Stubs associated with external termination networks are eliminated, thus preserving signal integrity.
The SY89831U operates from a 2.5V or 3.3V supply and is optimized for applications that require up to four precision LVPECL outputs. Skew within the device is guaranteed to be less than 20ps, and rise-and-fall times are less than 225ps. The SY89834 is optimized for applications that require LVPECL outputs from a single-ended LVTTL/CMOS source. For applications that require LVDS outputs, the SY89832 operates from a 2.5V supply, and the SY89833 operates from a 3.3V supply. Unlike other LVDS buffers, the SY89832/3 feature rise and fall times as low as 190ps–the fastest edge rates in the industry.
The SY89831 family is optimized for all communications applications, including all SONET/SDH, Gigabit Ethernet, and Fiber Channel clock trees. Designed for communications applications, the family features a total jitter (the amount of peak-to-peak jitter measured over 1012 clock cycles) of less than 1ps over the device’s full temperature and voltage ranges. In addition, the SY8983x family are offered in a 16-pin (3mm x 3mm) package, which represents a 70% reduction in footprint area compared to alternative solutions.
