Ein (privatrechliches) Gesetz ist in den USA normalerweise keine umfassende, in sich konsistente und vollständige Regelung eines Gesamtgebiets, vielmehr ist es als Lösung von Einzelproblemen konzipiert. Das kommt daher, dass statutes traditionell der Lückenfüllung und Korrektur des case law dienen.

Cases und statutes existieren nebeneinander und stehen oft in Wechselbeziehung miteinander. Doppelt gemoppelt ist das deshalb aber nicht.
