| Translation - English As I personally know the individuals appearing before me and on the basis of their statements and my belief, I ATTEST to the truth of their identities. They assure me that they possess, and in my opinion they do possess, the necessary legal standing to execute this document and to that end they freely and voluntarily,
STATE
FIRST: It is the intention of the parties to be united in marriage and for the purposes of said marriage wish to execute the following PRENUPTIAL AGREEMENTS, which are set forth under the following:
CLAUSES AND CONDITIONS
FIRST: The parties wish to maintain separate ownership and control of their respective current and future property.
SECOND: The parties stipulate that after the marriage ties are formalized, neither their marriage nor their present or future property shall be subject to the regime of community property as provided by the Civil Code of Puerto Rico, but rather they will maintain separate ownership of property as set forth herein.
THIRD: Likewise, the parties have agreed that each will freely manage his/her respective property and will dispose thereof without interference or limitation, and that both will be free to carry out any type of transaction without the need for any permission or consent whatsoever, and that it is also hereby agreed and specified that either spouse may hold any type of position, either public or private, may devote him/herself to commerce, and may acquire any type of personal or real property, or an interest in real or personal property, and may also transfer, sell, exchange, donate, or mortgage such property by means of any agreements or conditions, and to any ends or purposes, and for any reason or by any means that they determine or have at their disposal, with no limitations whatsoever, and without any need for the involvement, knowledge, or consent of the other spouse.
...
FIFTH: The parties agree that only in the case of the real property that becomes their marital home, if it is purchased jointly by the parties, will they each have equal ownership interest in it including their debt obligation, any capital gain it generates and anything related to this, regardless of the contribution made by each to said real property in terms of its purchase, improvements, or maintenance. Both spouses are equally responsible for all the costs, income, and maintenance of the marital home, and in equal shares for living expenses including food and raising and educating any children that the couple has produced or will produce in the marriage.
An exception is noted in that if only one of the spouses receives an income, he/she shall be entirely responsible for the abovementioned expenses and outlays and shall not demand such contribution from the other.
SIXTH: Both parties knowingly promise to abide by these agreements and shall act in accordance with their terms and are bound to manage their marital household economy in conformity with the agreement set forth herein.
SEVENTH: For greater clarity, the parties state that all or any property they owned prior to their marriage or that they acquire after their marriage for any reason, shall also belong exclusively to the spouse that acquired that property, as the parties agree to wed in accordance with the rules of strict and absolute separation of property.
EIGHTH: By the same token, the future spouses stipulate that any and all debt or obligation held by each one of them respectively before the marriage, or acquired following the marriage, shall be the sole responsibility of the spouse that has acquired the debt, and that the other spouse shall bear no responsibility whatsoever with regard to such debt or debts.
