Law/Patents - Law: Contract(s)
Spanish term or phrase: renuncia, posposición y reserva de rango
Spain (Barcelona), corporate bylaws, list of administrator's powers: The ENTIRE bulleted item is: "Efectuar contratos de compraventa y permuta de inmuebles, constituir derechos reales, incluso hipotecas y subhipotecas sobre los mismos y cancelarlos, asi como las operaciones regístrales de renuncia, posposición y reserva de rango, observando en todo momento las disposiciones legales procedentes." MY CONCERN is with "efectuar... operaciones regístrales de renuncia, posposición y reserva de rango..." What is RANGO here / what is this phrase talking about? Many thanks.

English translation:waiver, declaring to be junior or senior
Explanation:
Renuncia is a declaration that you don't have a lien (or, at any rate, not one that has any legal consequences).
Posposición is declaring that your lien is junior to some other lien.
Reserva de rango is refusing to do that.

Efectuar operaciones registrales is to arrange to have the registration entries made, in this case, to register the priorities of the mortgages in question. I think you could probably summarize it as "register".

Thanks, Paul. I was really out of my element here, but I could make sense of your answer and it seemed the most straightforward...

Explanation:
I think that this part of the text refers to management of employees.
Hope that this helps.

Yes, on a second reading I see your point. I find a meaning for 'registro' as 'inspector' among the other connotations. If 'operaciones registrales' were 'oversight duties' then, when the subject found a breach of contract, he would be empowered to 'renounce the other terms of it', to 'put other contracts before his obligations under this one' or to 'preserve the status (rango) of his company as a party to the contract. :))

I'm not really joking with you. I confess I don't know what it means, but this phrase as a unit has the sound of boilerplate legaleze that is written into all such contracts in any language. There will be a phrase in English that's a lot shorter than what I just suggested.
I hope the discussion sparks some ideas in your mind.
Happy typing.

Asker: It's a good thought, Richard, but administrator powers related to employees are listed elsewhere. This phrase surely has to do with the subject at hand: real estate contracts. "Registration [or recording] procedures for the...?" Thanks.

disagree  Paul Merriam: The context makes it pretty clear that the context is real estate. The operaciones registrales refer to the hipotecas and subhipotecas.

Asker: Thank you, Paul, for not only the translation but the explanations. This does seem to work, but what about the "efectuar... operaciones registrales" part to go with your collocation? Thanks.

surrender, postponement and reservation of priority (of land-registered entry)

Explanation:
The co./corp. can give up priority of existing land registry entries such as liens and mortgages, postpone them to a *lower priority ranking* or reserve priority.

In the UK, the latter is done by a buyer's land or patent etc. search which takes priority for a 21-day period. No subsequent search can butt in and take precedence.
