Kim is surely right, "damage" is correct, no matter if it is US or British English. The defendant "haftet für den Schaden" thus seems to be a good solution.

: "any arising damage" is far less explicit than "still accruing damage" - in a legal document, one must stick to the source text as much as possible, in terms of expliciteness.
