Polish law recognizes the concept of "employment establishment," which is different from the concept of enterprise. An "employment establishment" is a set of assets that serve as a workplace for employees. The definition of an "enterprise" is more business-oriented: an enterprise must be capable of performing identified economic tasks.
An establishment, or a part of it, may be the subject of trade: sale, lease, contribution to share capital. The task of labor law is to define the fate of the employees working in the traded establishment. Labor law rules governing this issue represent a crucial part in the comprehensive structuring of business transactions.
