"Les membres signataires" laisse entendre qu'il pourrait y avoir des "membres" non signataires. Bien sûr, l'extrait soumis ici nous permet de croire que tous les membres seront signataires (ce qui ne serait pas nécessairement le cas s'il s'agissait, par exemple, d'un traité international). Néanmoins, je trouve que dans les textes juridiques, il vaut mieux ne pas extrapoler et s'en tenir à ce qui est écrit. Je pense aussi "back-translation": si le texte soumis devait être retraduit vers l'anglais, le résultat serait-il fidèle à l'original?

Effectivement, la question aurait dû indiquer « Members hereto ». Selon le nouvel extrait fourni, les “Members” sont les membres de la coentreprise/du consortium. Ainsi :

Hereto a le sens de “à ceci”, “à la présente entente” et diffère de hereby :

The parties hereby agree… = Les parties conviennent par les présentes...
(Il ne nous appartient pas vraiment de présumer que le rédacteur voulait dire "hereby" plutôt que hereto)

unless there is a typo "the Members [of the organization we have just been talking about]" is the meaning of "The Members hereto", so without knowing anything about this organisation, it's difficult to suggest something that would fit for sure in your ST.

We don't even know if "Members" are natural persons or some commercial entities - could be the "members" of some consortium, or trade association or ...

Assuming the EN is not inherently flawed, I think you are parsing this incorrectly, which may not be helping your understanding.

I would understand this as being about 'the members hereto' — presumably, some organization etc. has been previously been mentioned that represents the 'here...' part; normally, one would be a member OF something, so it would be 'the members hereof'; or else one might be a 'signatory TO something', in which case it would be 'the signatories hereto' — so the very use of 'hereto' is questionable here.

However, I believe the meaning is still clear: "the members [of the organization we have just been talking about] confirm the understanding..."

It is conceivable that the writer meant to use 'hereby', in which case 'hereby confirm' would make some sense — except that it then sounds faintly odd to go on '...as follows'.

I am assuming that this 'understanding' means in fact some kind of 'agreement' between two (or more) parties, rather than the more everyday sense of 'interpretation / comprehension'.

As so often, having more of the wider context would make it a lot easier to understand what is actually going on here.
