В практике Конституционного Суда РФ были сформулированы следующие обязательные стандарты, которые должны соблюдаться при принудительном лишении имущества :
- предварительный или последующий контроль суда (очевидно, что данный критерий в отношении scheme of arrangement будет соблюден, поскольку она одобряется решением английского суда);
Мой вопрос перекликается с предыдущими:
можно ли написать "because it is approved by an English court" (чтобы избежать нагромождения "by the decision of an English court" и пр.)?

В таком случае лучше заменить более юридическим термином слово 'because' (оно очень нейтральное) - рассмотрите since/ to the extent to/ subject to
e.g. since it is approved by the English court;
to the extent that it is approved by the English court
subject to the approval of the English court
еще варианты - whereas, due to (the fact that), given (the fact that).
В любом случае нужно заменить because.
