The purpose of this booklet is to provide an outline of Australia’s decision-making and court processes in relation to migration cases. In particular, it shows why some cases, including those involving alleged criminal activity, may take a long time to resolve.
The booklet also aims to explain why even when criminal activity has been demonstrated there may be instances where it is not possible to return a person to another jurisdiction to face criminal processes there. This is because the return of this person may contravene Australia’s international legal obligations. One such obligation is not to subject a person to the possible imposition of the death penalty in another jurisdiction.
The Australian Constitution ensures that power is divided between the Parliament, the Executive and the Judiciary. The purpose of the separation of powers doctrine is to ensure no one body obtains too much power. It means that the courts are able to review and overturn actions/decisions of government.
Immigration law in Australia is a dynamic, controversial and contested area of public policy. A key issue in Australian public life is to ensure the accountability of public officials for making decisions. The Department of Immigration and Citizenship aims
to ensure its decisions are fair, reasonable, transparent, well-supported by evidence, properly recorded and lead to improved outcomes.
At the request of an applicant or visa holder, decisions made by the department are subject to merits review (if the applicant or sponsor is onshore) or judicial review. Merits review aims to ensure that administrative decisions are correct, fair and preferable. It is not a review of the reasoning or application of law in the original
decision. Judicial review determines if there has been an error in law. The Australian Government cannot interfere with the judicial review process and cannot influence the outcomes of these reviews.
