Source text - French Le Parlement a adopté définitivement lundi 24 février, par des votes successifs de l'Assemblée et du Sénat, le projet de loi encadrant l'utilisation de la géolocalisation dans les enquêtes préliminaires. Le texte, issu de l'accord trouvé entre les deux Chambres en commission mixte paritaire, a été soutenu sur tous les bancs à l'Assemblée comme au Sénat, seuls les écologistes s'abstenant.
Le projet de loi clarifie les conditions d'utilisation de la géolocalisation par les services enquêteurs, après que la Cour de cassation, s'appuyant sur la jurisprudence de la Cour européenne des droits de l'homme (CEDH), eut récemment invalidé des pièces de procédure recueillies par ce moyen (portables, balises GPS...) dans le cadre d'enquêtes préliminaires.
La Cour de cassation avait considéré en octobre que la technique de géolocalisation constituait une « ingérence dans la vie privée dont la gravité nécessite qu'elle soit exécutée sous le contrôle d'un juge », et non du parquet qui mène les enquêtes préliminaires. Cet arrêt avait provoqué la colère des policiers qui craignaient, en perdant un moyen d'investigation, que leurs enquêtes ne s'en trouvent paralysées, notamment dans les affaires de grand banditisme ou de stupéfiants.
Translation - English Parliament passed a bill governing the use of geolocalisation in preliminary investigations on Monday, 24th February, after consecutive votes in the Assembly and Senate. The law, proposed by a joint committee formed from both Chambers, was supported by all parties in the Assembly, as well as in the Senate. Only the Green Party abstained.
The bill clarifies the conditions under which geolocalisation can be used by police investigations based on the case law of the European Court of Human Rights (ECHR), after the Court of Cassation recently invalidated procedural documents obtained using this process (for example mobile phones and GPS beacons) during preliminary investigations.
In October, the Court decided that geolocalisation techniques “invade privacy to the extent that they should be under the control of a judge”, rather than the Prosecutor’s Office in charge of the investigation. This judgement angered police officers, concerned over the resultant loss of power to complete an investigation, especially for cases involving armed robbery and narcotics.
