Source text - German Bis zur Erfüllung aller Forderungen, die --- GmbH gegenüber dem Kunden jetzt oder zukünftig zustehen, bleibt die gelieferte Ware (Vorbehaltsware) ihr Eigentum. Im Falle vertragswidrigen Verhaltens des Kunden, z.B. bei Zahlungsverzug, hat --- GmbH nach Ablauf einer von ihr gesetzten angemessenen weiteren Zahlungsfrist, sofern diese fruchtlos verstreichen sollte, das Recht, die Vorbehaltsware zurückzunehmen. Nimmt sie die Vorbehaltsware zurück, stellt dieses einen Rücktritt vom Vertrag dar. Die --- GmbH ist sodann berechtigt, die Vorbehaltsware nach Rücknahme zu verwerten. Der Verwertungserlös ist mit den ihr vom Kunden geschuldeten Beträgen zu verrechnen, wobei --- GmbH berechtigt ist, einen angemessenen Betrag für den zusätzlichen Aufwand einer solchen Verwertung zu berechnen und aus dem Erlös zu entnehmen.
Translation - Czech Až do vyrovnání veškerých pohledávek, které společnost --- GmbH vůči zákazníkovi má nebo bude mít, zůstává dodané zboží (vyhrazené zboží) jejím vlastnictvím. Jestliže zákazník koná v rozporu se smlouvou, např. je v prodlení s platbou, společnost --- GmbH má právo vzít vyhrazené zboží zpět poté, co --- GmbH stanovila další přiměřenou lhůtu k platbě a tato lhůta marně uplynula. Zpětvzetím vyhrazeného zboží společnost --- GmbH odstupuje od smlouvy. Po zpětvzetí vyhrazeného zboží smí společnost --- GmbH toto zboží prodat. Výtěžek z prodeje se započte proti dlužným částkám zákazníka, přičemž je --- GmbH oprávněna vyúčtovat přiměřenou částku spojenou s dodatečnými náklady takového prodeje a tuto částku odečíst od výtěžku.
