Mit Lügen in die Insolvenz: Mit einem haltlosen Bericht über einen angeblichen sexuellen Übergriff in Hamburg zeigt der amerikanische Blogkonzern, was er kann – und warum er untergeht.

Es sah einfach zu gut aus. Auf der einen Seite steht scheinbar allein das Böse, der bekannte Netzaktivist Jacob Appelbaum, früher ein wichtiger Mitarbeiter des TORVerschlüsselungsdienstes, heute ein gejagter Mann, dem anonym im Internet durch eine Prangerseite sexuelles Fehlverhalten vorgeworfen wird. Ein Star der Szene, der zum Paria geworden ist, nachdem er das TOR-Projekt letzte Woche verlassen hat. Auf der anderen Seite stehen die Guten: Wütende Feministinnen, die den Bösen als Vergewaltiger bezeichnen, eine Netzöffentlichkeit, die nach weiteren Details der Übergriffe verlangt, und drei Helden, die bereit sind, offen und mit Klarnamen zu berichten, wie sie Augenzeugen bei einem Übergriff von Appelbaum wurden.
Außerdem soll sich das alles in der Öffentlichkeit zugetragen haben, beim renommierten Kongress des Chaos Computer Clubs im letzten Dezember, der seit längerem von Feministinnen wegen der Frauenfeindlichkeit in der Techszene kritisiert wird. Der Kongress, ein Jagdgrund für einen Frauenschänder, und andere Teilnehmer schauen einfach zu, bis drei
Zeugen genug haben und dem Übeltäter seine sicher geglaubte Beute entreißen.
Eine Opfergeschichte
Das ist die Geschichte, die die Zeugen Meredith Patterson, Andrea Shepard und Emerson Tan dem Redakteur William Turton vom Internetmagazin Gizmodo erzählten. Sie berichteten mit vielen Details, vom verstörten Blick der Frau, von Appelbaums Benehmen, seiner unerwünschten Grabscherei und seinen Versuchen, sie für sich zu gewinnen, und von der Rettung des Opfers in Form einer Intervention. Gizmodo gehört zum Konzern Gawker, der
jüngst einen Prozess gegen den Wrestler Hulk Hogan verlor, und nun gezwungen ist, ihm 140 Millionen Dollar wegen der Veröffentlichung eines Sexvideos und anderer Eingriffe in seine Privatsphäre zu zahlen.
Gizmodo ist die 2002 gegründete Keimzelle des Medienkonzerns, der Skandalfreunde mit Gawker.com und Feministinnen mit Jezebel unterhält: Eine bunte Palette von Nischenpublikationen, alle laut, alle auf den Klickerfolg ausgerichtet. Gizmodo ist das Kronjuwel der Firma, und die elddruckmaschine im Konzern. Und nun hat Gizmodo drei Augenzeugen, die dabei waren, als sich eine Szenegröße an einer Frau vergreifen wollte. Der Redakteur versuchte nach eigenen Angaben, Appelbaum zu erreichen, aber der schwieg. Also veröffentlichte Gizmodo die Geschichte einseitig. Sie schlug ein wie eine Bombe, wurde weit verbreitet und von vielen anderen Publikationen übernommen. Ein Scoop. Mit einem Schönheitsfehler. Gizmodo hatte die Zeugen und den angeblichen Täter. Aber nicht das angebliche Opfer.
Attacke aus dem Verborgenen
Das angebliche Opfer heißt Jill Bähring und meldete sich bald zusammen mit dem Chaos Computer Club zu Wort. Die Geschichte, die einfach zu gut aussah, war zu gut, um wahr zu sein: Die angeblichen Zeugen hatten den Vorgang aus größerer Distanz beobachtet, und sich in ihrer Voreingenommenheit gegenüber Appelbaum alles nur passend zusammengereimt.
Jill Bähring war freiwillig bei Appelbaum. Sie sind gut befreundet und haben sich gut verstanden. Niemand ist eingeschritten, weil es keinen Grund zum Einschreiten gab. Sie hatte andere Sorgen und sah deshalb nicht glücklich aus. Es gab keine Grabscherei. Der einzige unerwünschte Übergriff geschah, als Bähring sich von Appelbaum verabschieden wollte und der Zeuge Emerson Tan dazwischen platzte, und sich dabei ganz anders verhielt, als er Gizmodo
gegenüber behauptet hatte. Sie hätte Appelbaum an jenem Abend gern noch einmal gesehen.
Die drei Zeugen, die Gizmodo aufbot, um Appelbaum in bekannter, aber nicht unbedingt bewährter Manier des Hauses Gawker den Rest zu geben, haben, ohne das angebliche Opfer zu fragen, einen sexuellen Übergriff gezielt erfunden. Gizmodo belegte eindrucksvoll, warum Gawker als Medienkonzern am Ende ist: Weil derartig fahrlässige Methoden und Beihilfe in Schlammschlachten zwangsläufig vor Gericht schlecht ausgehen.
Was an anderen Vorwürfen gegen Appelbaum dran ist, ist weiter unklar: Die Betreiber des anonymen Prangers ziehen es weiter vor, im Verborgenen zu agieren – allerdings behauptet Andrea Shepard, TOR-Mitarbeiterin und eine der Kronzeuginnen von Gizmodo, den Macher zu kennen: es sei ein Mitarbeiter, dem sie traue. Shepard selbst ist mit Appelbaum seit über 10
Jahren bekannt – und verfeindet.
Peinlich ist die Geschichte nicht nur für die selbsternannte Zeugin Meredith Patterson, die Appelbaum gleich zu Beginn der Anschuldigungen bei Twitter diffamiert hatte, er hätte nun „genug Leute vergewaltigt“, als dass es das TOR-Projekt noch ignorieren könnte. Peinlich ist es auch für ZEIT Online, die ihren Lesern Pattersons Unterstellung als eine wie die Prangerseite
argumentierende Stimme verkaufte, “auch wenn sie selbst nicht betroffen“ sei. Wie man nun bei Gizmodo sieht, sind die Feministinnen Patterson und Shepard sehr wohl aktiver Teil einer offensichtlich konzertierten Hetzjagd – Patterson selbst streitet wegen eines angeblichen Plagiats seit 2007 vehement mit Appelbaum.
Von deutscher Seite hatten weitere Personen versucht, den Fall gegen den Chaos Computer Club auszuschlachten: Auf der für hemmungslose Beschimpfungen bekannte Seite Antiprodukt.de wurden nochmals stolz die Versuche radikaler Gruppen nacherzählt, den Kongress und den Verein auf ihre Weltsicht zu verpflichten. Und die Femgeeks bejahten die
selbst gestellte Frage, ob man Public Shaming wie bei Appelbaum bräuchte.
Dass die Kronzeugen jetzt als Lügner dastehen, wird entweder ignoriert oder als Aussage einer Verbündeten von Appelbaum abgetan, deren Wort keine Bedeutung hätte. Anne Roth ist Feministin und Mitarbeiterin der Linkenfraktion beim NSA-Untersuchungsausschuss, und eine
Szenegröße, die sonstige Bekenntnisse zum Datenschutz nicht davon abgehalten haben, die Prangerseite ihren über 25.000 Followern zu zeigen. Sie schrieb danach: Wenn Ihr fragt, was Vergewaltigung für die Karriere und das Leben der Täter bedeutet, fragt dasselbe zu Karriere und Leben der Opfer.
Zu den Opfern der Gizmodo-Kronzeugen hat sie nichts zu sagen. Der beliebte Spruch „Believe the victim“ gilt in diesen Kreisen offensichtlich wenig, wenn die Opfer nicht in das Narrativ der weißen, männlichen Techszene als Inbegriff der Rape Culture passen. Für Gizmodo ist das deutsche Beihilfsschweigen nach dem Auffliegen keine Hilfe mehr: Gawker hat gestern als Gesamtkonzern Gläubigerschutz beantragt, und steht nun zum Verkauf – ein erstes Gebot des amerikanischen Medienkonzerns Ziff Davis liegt bei 90 Millionen Dollar.
Allerdings will der Käufer das Projekt, aber nicht die Verpflichtungen gegenüber Hulk Hogan und anderen Klägern übernehmen. Um weitere Niederlagen vor Gericht zu verhindern, wird sich das Projekt deutlich ändern müssen – und das betrifft vermutlich auch die Arbeitsweise von
Gizmodo-Redakteur William Turton. Seine Person wirft ein Schlaglicht auf die Gründe des Niedergangs: Gawker hat hier einen 18-Jährigen an ein riskantes Thema gelassen, für das man aufgrund der Tragweite Erfahrung und Fingerspitzengefühl gebraucht hätte. Turtons Einstellung bei Gawker wurde im April noch mit diesen Worten gefeiert: „we share the same enthusiasm for conversational, accessible, honest reporting about the companies, people, technologies, and trends that are shaping our future”.
Zwei Monate später sollte das “honest reporting“ von Gawker und Turton angesichts der Pleite kein Trend mehr sein, der die Zukunft formt.
Gerüchteproduktion im Netz Aktivistinnen rufen zum Ende der Hetzjagd gegen Appelbaum auf Nachdem eine Anschuldigung gegen den Aktivisten Jacob Appelbaum als Unwahrheit enttarnt wurde, mehren sich die Stimmen, die vom digitalen Kesseltreiben genug haben. Sie fordern „die Einhaltung moralischer Mindeststandards im Netz und bei den Medien.“

Neun Jahre nach einer komplexen Beziehung schreibt die Informatikerin Leigh Honeywell in ihr Blog die Worte „Believe Victims“. Davor steht eine Generalabrechnung mit dem ehemaligen TOR-Mitarbeiter Jacob Appelbaum, mit dem sie 2006 bis 2007 liiert gewesen ist. Die Vorwürfe
umfassen Handlungen, die zumeist sehr unhöflich, aber sicher nicht strafbar wären: Bei einerMenage a Trois soll Appelbaum ein Wort missachtet haben, das ihn zum Aufhören aufforderte.
Dass sie von Appelbaum miserabel behandelt wurde, sei ihr erst später bewusst geworden, als sie sich mit ihm überworfen hatte: Im Fall des der sexuellen Nötigung verdächtigten Julian Assange gingen die Einschätzungen von Honeywell und Appelbaum auseinander.

Der Journalismus sollte überprüfen
Unter normalen Umständen wäre die von Belastungseifer geprägte Nacherzählung einer kaputten Beziehung der Anlass, vorsichtig zu sein. „Believe Victims“ ist das Credo des neuen Feminismus, zu deren bekannten Vertreterinnen Honeywell gehört. Aber es ist normalerweise nicht das Grundprinzip des Journalismus, der überprüfen sollte, ob da wirklich ein Opfer vorhanden ist. Leigh Honeywell schreibt es trotzdem, und es wird ihr geglaubt: Denn gegen Appelbaum kursieren auf einer Prangerseite anonyme Anschuldigungen.
Dass Honeywell nun bereit ist, schmutzige Details nach ihrer Sicht zu liefern, macht sie zum Objekt der Berichterstattung, von amerikanischen Skandalmedien bis zum Zündfunk des Bayerischen Rundfunks, wo einige Anschuldigungen über zart tröpfelnder Musik mit trauriger Telefonsexstimme nachgehaucht werden. Danach darf die bei Femgeeks.de anonym agierende Bloggerin „Natanji“ erklären, warum Prangerseiten voll in Ordnung sind.
Scharfe Gegenreaktion
Aber auch andere kennen Appelbaum schon etwas länger und haben ganz andere Erfahrungen gemacht: Unter ourresponce.org haben bekannte Vertreterinnen der Bürgerechtszene und des Kulturlebens einen offenen Brief veröffentlicht, der scharf mit den Medien und ihrem Umgang
mit Gerüchten und nicht belegten Anschuldigungen ins Gericht geht: „It has become clear the mainstream media are unwilling to fact-check, and only too willing to persist in spreading uncorroborated and unfalsifiable rumor.“
Es ist in der Geschichte des Internetshitstorms nicht oft passiert, dass sich Frauen zusammentun, um Gerüchten entgegen zu treten: Im Fall Appelbaum wurde offensichtlich aber eine Grenze überschritten. Es gehe den Initiatorinnen nicht darum, die Erfahrungen anderer in Abrede zu stellen, sondern ihre eigene Einschätzung zu bekunden. In den Aktionen sehen sie
einen Fall von abgesprochenem Rufmord, wörtlich „charakter assassination “. So könne weder die Wahrheit ermittelt noch Gerechtigkeit erreicht werden.
Debatte auf der Grundlage von Beweisen
Dass Appelbaum nicht eben immer ein pflegeleichter Charakter ist, stellen sie nicht in Abrede. Sie betonen aber, dass ihre eigenen Erfahrungen mit Appelbaum ganz anders sind, und dass manche seine oft provokativen Äußerungen vielleicht als beleidigend auffassen könnten.
Um so wichtiger ist ihnen eine offene und auf Beweisen basierende Debatte. Nicht nur im Fall von Appelbaum, der zunehmend zum Opfer seiner nachweislichen Falschbeschuldiger wird, sondern generell, um zu einem fairen Verfahren zu kommen: „Furiously targeting one person without allowing for proper fact analysis will never solve the bigger structural problem that has been highlighted. We should use this moment to grow and make things better, not destroy the movement and create divisions. “
Tatsächlich ist der aktuelle Fall nur einer in einer langen Reihe von Versuchen, die Tech- und Hackerszene als besonders sexistisch zu diskreditieren. Der Zündfunk lässt dafür ausgerechnet Anke Domscheidt-Berg als Kronzeugin auftreten, die schon die Piraten mit öffentlich ausgetragenen Konflikten wegen angeblichem Sexismus vorführte.
Auch Domscheit-Berg spricht sich für anonyme Pranger aus. Im Internet machen exakt jene Kreise Stimmung, die dem Chaos Computer Club seit Jahren ihre eigenen Verhaltensregeln auf seinen Kongressen aufzwingen wollen. Vor drei Jahren kam es wegen sogenannter „Creeper Cards“, mit denen sogar türaufhaltenden Männern Sexismus vorgeworfen werden konnte, zum Eklat. Die Heftigkeit der aktuellen Auseinandersetzungen ist nur zu verstehen, wenn man die Aktivitäten der Ankläger über einen längeren Zeitraum betrachtet.
Insofern weist ourresponse.org weit über den aktuellen Konflikt hinaus: Es ist offensichtlich, dass auch in Zukunft jeder echte, aufgebauschte oder erfundene Fall benutzt wird, Einfluss und Macht zu erringen. Die Angreifer und die mit ihnen befreundeten Medien wissen, wie das geht.
Eine per Internet übertragene Keynote von Julian Assange auf dem Kongress des CCC wurde technisch gestört, und mit dem Störer sprach sehr gefällig jener SZ-Journalist, der beim Netzprojekt von Anne Wizorek mitgearbeitet hat, die den Auftritt von Assange vorab gern verhindert hätte.
Wer nicht mitmacht, gilt als Verharmloser
Für die Szene, die angesichts von Geheimdiensten und Überwachung keine Ressourcen für die immer gleichen Schlammschlachten hat, ist die Lage unangenehm. Wer den angeblichen Opfern nicht unbesehen glauben will, wird als Verharmloser gebrandmarkt und als Beispiel für eine Gruppe vorgeführt, die sich gegen notwendige Neuerungen und Machtzuwachs feministischer Ideologien sperrt. Hacker gelten - auch dank der gebetsmühlenartigen
Wiederholungen von Anke Domscheit-Berg und ihrem Umfeld - als verschworene Gesellschaft von Männern, die mit Rechnern besser als mit Frauen umgehen können.
Auf diesem inherent sexistischen Vorurteil wuchern die Gerüchte über angeblichen Missbrauch besonders gut.
Mit der Intervention, die von der Menschenrechtsjuristin Renata Avila, der Journalistin Sarah Harrison und weiteren namhaften Vertreterinnen der Bürgerrechtsbewegung unterzeichnet wurde, gibt es ein deutliches Signal für ein Ende dieser populären Hetzjagden. Sie fordern eine positive Agenda im Umgang mit Sexismus und Geschlechterfragen, ohne Vorverurteilungen
und mit einem fairen Verfahren für Menschen, die sich für Bürgerrechte einsetzen. So, wie es in Rechtsstaaten bei den normalen Bürgern auch sein sollte.
Missbrauchsvorwürfe Jacob Appelbaum
Tage der Abrechnung
Jahrelang feierte die Hackerszene Jacob Appelbaum als Helden. Nun gibt es schwerwiegende Vorwürfe und viele offene Rechnungen.
BERLIN taz | Es ist gut, wie ein Fremder in diese Menge hineintreten zu können, in diese anarchistische, schwer auszuleuchtende Szene, sich dort umzuschauen, zwischen den Slushmaschinen, in denen neonfarbene Eisgetränke gerührt werden; zwischen den auf dunklen Monitoren hell erscheinenden Programmierzeichen. Langsam kann dort eine Ahnung davon entstehen, was in dieser Welt, der Hackerwelt, von Bedeutung ist.
Die Befreiung vor allem, ganz allgemein, und die Selbstermächtigung; und dann, konkreter, die dunklen, teils dunkel geschminkten Augenränder, die Technikparties und manchmal auch Sexparties und natürlich die Prüfsummenalgorithmen, vor allem diese. Und dann ist es auch gut, wieder hinauszutreten aus diesem Wahnsinn. Glücklich, wem das gelingt, bevor wieder alle Grenzen verschwimmen.
Es gerät in dieser Welt viel zu oft viel zu viel durcheinander. Dabei ist es doch eigentlich so einfach: Eine Prüfsumme ist ein Wert, mit dem die Integrität von Daten ermittelt werden kann. Es wäre derzeit ganz sinnvoll, wenn die aufgebrachte globale Technik-, Hacker- und Nerdgemeinschaft sich wieder ein wenig auf ihre einfachsten Einsichten besinnen würde.
Seit gut einer Woche ist der Kampf gegen Jacob Appelbaum eröffnet, zumindest nach allem, was öffentlich zu beobachten ist. Hinter den Kulissen, in privaten Treffen, in verschlüsselten Emails und Chats, wird der Kampf gegen diesen Mann bereits seit über einem Jahr geführt. Die Gründe dafür sind gewichtig: Jacob Appelbaum, eine der Führungsfiguren der globalen
Antiüberwachungsbewegung, soll wiederholt, so lauten die meist anonym vorgebrachten Vorwürfe, die Grenzen anderer überschritten haben, teils verbal und teils auch sexuell.
Einer der profiliertesten Sprecher der Szene Für die weltweit mächtigsten Organisationen des digitalen Widerstands ist dies ein herber Schlag. Appelbaum ist einer der profiliertesten Sprecher der Szene. Er spielte eine entscheidende Rolle bei der Veröffentlichung der Snowden-Dokumente, enthüllte die Ausspähaffäre rund um das Handy von Angela Merkel, verfügt über engste Kontakte in den inneren Zirkel von Wikileaks und war das Aushängeschild des sogenannten Tor-Netzwerkes.
Das ist ein Zusammenschluss von Entwicklerinnen und Entwicklern, die eine
Anonymisierungssoftware betreiben und so das überwachungslose Surfen und Kommunizieren im Internet ermöglichen wollen, eines der bedeutendsten Hackernetzwerke der Welt. Am 25. Mai hat Appelbaum seinen sehr gut bezahlten Job dort niedergelegt, der Druck auf ihn wurde zu
groß. Er ist einem Rauswurf damit zuvor gekommen.
Seitdem ist die Gemengelage kompliziert und, wie es in der Szene bei Konflikten üblich ist, unübersichtlich, marktschreierisch und hysterisch. Das liegt vor allem daran, dass die Vorwürfe, die gegen Jacob Appelbaum zuvor nicht- oder nur halböffentlich ins Feld geführt worden waren, nicht vor einer Polizei oder Justiz zur Sprache kommen sollen, sondern dass sie in der
staatskritischen Netzgemeinde wie auf einem Marktplatz nun öffentlich verhandelt und verstärkt, diskutiert und widerlegt werden bis am Ende alle Beteiligten ihren Schaden davon getragen haben.
Es ist ein Kampf um die letzte Wahrheit eines bis gestern noch gefeierten Helden: Ist Jacob Appelbaum ein Rockstar mit Macken? Ist er ein Arschloch und Grenzgänger? Oder ist er gar, was einige Menschen nun meist anonym behaupten, ein Vergewaltiger? Über all dies wird derzeit öffentlich verhandelt.
„Ein Vergewaltiger wohnt hier“ Wie valide die Vorwürfe, von denen die schwersten kaum zu überprüfen sind, auch immer sein mögen: Die Form ihrer Präsentation und ihr Umgang mit ihnen steht einer Rufmordkampagne in
wenig nach.
Es ist, im Gegenteil, das erklärte Ziel dieser Kampagne, den einstigen Helden auszugrenzen oder, wie ein Hackerkollektiv, in dem Appelbaum bis zuletzt Mitglied war, schrieb: „Wir haben ihn von der Herde getrennt.“ An dem Wohnhaus, in dem Appelbaum bis zuletzt in Berlin wohnte, prangt heute ein Graffiti. Dort steht auf deutsch und auf englisch zu lesen: „Ein Vergewaltiger wohnt hier“.
Einige Tage ist es nun her, dass eine Homepage veröffentlicht wurde, die zwar auf Jacob Appelbaums eigenen Namen lautet, aber von seinen ärgsten Feinden betrieben wird. Darauf klagen überwiegend anonyme Personen ihn öffentlich an. Unbekannte schildern dort ihre Erfahrungen mit Jacob Appelbaum. Sie zeichnen das Bild eines manipulativen Aktivisten, der gezielt und immer wieder auch die körperlichen und sexuellen Grenzen anderer ignoriert.
In der feministischen Szene wird diese Webseite verteidigt: Wie sonst, fragen
FrauenrechtsaktivistInnen, soll dem Treiben von Peinigern ein Ende bereitet werden, wenn doch statistisch erwiesen ist, dass der juristische Weg den Opfern in solchen Fällen kaum etwas nützt?
Allerdings: Nicht nur die aufgemotzte Homepage zeugt von Unsachlichkeit – auch inhaltliche Einlassungen, die gegen Appelbaum vorgebracht wurden, mussten inzwischen relativiert oder gänzlich zurückgezogen werden. Das muss nicht heißen, dass andere Vorwürfe falsch sind. Doch es zeigt an, auf welche Weise die sogenannte „Community“ mit sich selbst ins Gericht geht; und wie grenzüberschreitend dies wiederum geschieht.
CCC-Congress in Hamburg In einem der wenigen Fälle, in denen die Ankläger nicht anonym auftraten, skizzierten sie eine Szene, in der Appelbaum am Rande des Hamburger Jahreskongresses des Chaos Computer Clubs öffentlich eine Frau gegen ihren Willen begrapscht haben soll. Weil diejenigen, die diese
Vorwürfe vorbrachten, sogar namentlich in Erscheinung traten, galten sie rasch als Kronzeugen.
Allein: Mit der Frau, die vermeintlich bedrängt worden war, hatten die Ankläger gar nicht geredet. Sie steht noch heute in engem Verhältnis zu Appelbaum und konnte es kaum fassen, als sie nun selbst über sich lesen musste.
Und so erschien dann ein weiterer Text im Internet, indem diese Frau die Dinge aus ihrer eigenen Perspektive schildert: Dass es aus ihrer Sicht in jener Nacht in der Lobby des Hamburger Radisson Blu-Hotels überhaupt kein Problem mit Appelbaum gab. Nun wollte sie wissen, was denn das Problem der anderen sei – und warum überhaupt fremde Leute in ihrem Namen Anklage führten? Auch andere seiner engen Freundinnen und Ex-Freundinnen verteidigen Appelbaum vehement. Heißt das, dass an den Vorwürfen nichts dran ist?
Nein. Das heißt erstmal alles gar nichts, weder in die eine, noch in die andere Richtung.
Als Fakt kann genommen werden, dass die Szene schon lange über den Umgang mit dem von vielen als brilliant, gewinnend und pointiert, aber auch als eitel, geltungsbedürftig und grenzüberschreitend wahrgenommenen Appelbaum diskutiert. Bereits im März 2015 wurde er für 10 Arbeitstage von seiner Arbeit im Tor-Netzwerk suspendiert, nachdem er gesagt haben
soll, seine sexuelle Rekrutierungsstrategie sei erfolgreich. So berichtet es das Onlineportal Golem.de.
Appelbaum hat viele Feinde Und so kann es nicht wirklich überraschen, dass die Szene jetzt durchdreht, nachdem sie über Monate und Jahre keinen Weg gefunden hat, auf angemessene Weise mit Vorwürfen und Ahnungen, ob begründet oder nicht, angemessen umzugehen. Jacob Appelbaum hat dazu
einen großen Teil beigetragen.
Dass die Gruppe derjenigen, die ihn heute noch verteidigen, übersichtlich ist, hat auch damit zu tun, dass er sich – kompromisslos, hart im Urteil, dränglerisch – viele Feinde gemacht hat.
Und dann ist da noch dieser Aspekt: Seine Reden sind groß, seine Auftritte fulminant, er kann Säle beherrschen, auch wenn er nicht auf der Bühne sitzt. Und wenn er dann, bejubelt und beklatscht, abends in einer dieser fremden Bars landete, oft auch umringt von Groupies und Fanboys, dann ging es anschließend häufig noch auf ein Zimmer. Warum auch nicht?
Gemeinsam mit anderen, mal wenigen, mal vielen, mal Frauen, mal Männern, aber doch auf eine Art, die auch Außenstehenden anzeigte: Da macht sich einer, der ohne Zweifel mit der NSA einen der mächtigsten Gegner der Welt hat, sehr angreifbar. Unabhängig davon, was dann in diesen Zimmern geschah: Es war nur eine Frage der Zeit, bis das System Appelbaum Error
melden musste.
Es gibt Leute, die heute sagen, sie hätten bestimmte Parties gemieden, weil sie nicht die Typen für Sexparties seien. Andere merkten zu spät, wo sie hineingerieten, aber blieben. Und viele feierten dort einfach fröhlich. Und dann passierte dies und dann passierte das und plötzlich war
da diese umdrogte Wirre, jener Moment, in dem Grenzen wieder verschwimmen, in der ein Nein vielleicht nicht mehr Nein heißt, sondern? Ja, was denn eigentlich sonst? Das ist die Szenerie, in der die meisten Vorwürfe, die heute in der Welt sind, geboren wurden.
Gerechtigkeit herstellen – aber wie? Nicht alles, was mit dem Gestus des Coolen und Libertären einhergeht, ist, das ist vielleicht eine der Lehren aus diesem Stück, auch immer gleich cool und libertär. Und wenn dann all
diese Grenzen wieder einmal verschwimmen, dann tragen womöglich all jene ihren Teil, die daran mitgewirkt haben. Aber vor allem nun einmal der, der die Grenze der anderen selbst überschritten hat. Das gilt für Rockstars mit Macken, für Arschlöcher und das gilt auch für Peiniger. Und es gilt heute ganz genauso für all jene, die meinen, Gerechtigkeit ließe sich herstellen, in einem Meer von unwidersprechbaren Anwürfen, in dem es nicht mehr wichtig zu
sein scheint, ob die Integrität dieser Daten überhaupt noch ermittelt werden kann.
In einem Rechtsstaat gilt in der Regel: „Jede Person, die einer Straftat angeklagt ist, gilt bis zum gesetzlichen Beweis ihrer Schuld als unschuldig.“ Das ist zwar nicht besonders revolutionär, aber es ist auch nicht alles schlecht, was gesetzlich geregelt ist. Und deshalb ist es manchmal gut, aus diesem Wahnsinn, aus jener Welt herauszutreten, in der die Selbstermächtigung der
einen zur Unterdrückung der anderen führt. Glücklich, wem das gelingt, bevor wieder alles so wild durcheinander geht.

It just sounded too good. On one side of the fence, supposedly evil incarnate, the well-known net activist Jacob Appelbaum, previously an important employee of the TOR encryption service, today a persecuted man, anonymously accused of sexual misconduct, by a condemnatory site on the internet. From star of the scene to pariah, after leaving the TOR project last week. On the other side of the fence, the virtuous: enraged feminists, who label the evil one a rapist, an internet public who are demanding further details of the assault, and three heroes, who are prepared to openly and plainly proclaim how they came to be eyewitnesses of an assault by Appelbaum.
Furthermore, all this supposedly occurred in public, at the well-renowned congress of the Chaos Computer Club last December, which has been criticised for quite some time by feminists, who label the tech-scene as being misogynistic. The congress, a hunting ground for a molester of women where fellow participants simply watched, until three witnesses had had enough, and snatched his assumed prey away.
A Story of Victimisation
That is the story, which the witnesses Meredith Patterson, Andrea Shepard and Emerson Tan told the editor William Turton, of the internet magazine Gizmodo. They reported numerous details; of the distraught expression on the woman’s face, of Appelbaum’s behaviour, his unwanted pawing, and his attempts to win her over, as well as the rescue of the victim via an intervention. Gizmodo belongs to the Gawker group, which has recently lost a lawsuit against the wrestler Hulk Hogan, and is now forced to pay him 140 Million Dollars for the release of a sex video, and other transgressions on his privacy.
Gizmodo is the seed company of the Media Group, which entertains scandal mongers with Gawker.com, and feminists with Jezebel. A colourful palette of niche publications, all loud, all aimed at garnering high click rates. Gizmodo is the crown jewel of the group, and the money-maker of the concern. And now Gizmodo has three eyewitnesses, who were present when a big player in the industry wanted to molest a woman. According to him, the editor tried to reach Appelbaum, but he remained silent. So, Gizmodo released the story one-sidedly. It made a huge impact, was widely distributed and taken over by many other publications. A scoop. With one (beauty) flaw. Gizmodo had the witnesses and the alleged perpetrator. But not the alleged victim.
An Unseen Attack
The alleged victim is called Jill Bähring, and soon replied, together with the Chaos Computer Club. The story, that simply looked too good, was too good to be true: The alleged witnesses had observed the situation from a lengthy distance, and in their prejudice against Appelbaum simply spun together a fitting story, based on what they think they saw. Jill Bähring was with Appelbaum out of her own free will. They are good friends, and got on
well. Nobody intervened, because there was no reason for an intervention. She had other worries, and therefore did not look happy. There was no groping or pawing. The only unwanted encroachment that took place, was when Bähring wanted to say goodbye, and the witness Emerson Tan burst between them, and behaved very differently to what he had described to Gizmodo. She would have liked to have seen Appelbaum again that evening. The three witnesses that mobilized Gizmodo to put the boot into Appelbaum, by notorious, but not necessarily proven means, purposefully, and without asking the victim, simply made up a story about a sexual assault. Gizmodo confirmed impressively, why Gawker is nearing its end as a media company: Because such negligent methods inevitably go badly before a court of law. If there is any truth in further allegations against Appelbaum, is uncertain at this time: the distributors of the malicious denunciation, continue to act covertly. However, Andrea Shepard, co-worker at TOR, and one of the key witnesses for Gizmodo, claims to know the man in question: he is a trusted co-worker. Shepard herself knows Appelbaum for over 10 years, and they are rivals.
The story is embarrassing, not only for the self-proclaimed witness, Meredith Patterson, who defamed Appelbaum on Twitter, right at the beginning of the indictment, saying: “enough people raped”, but also for TOR, which could not no longer ignore it. It is also an embarrassment for ZEIT online, who sold Patterson’s allegations to its readers, arguing with the voice of the pillory (defamatory) site, “even though they were not involved themselves”. As is now clearly visible with Gizmodo, the feminists Patterson and Shepard, are most certainly an active element of an obvious and intensive hounding action. Patterson herself, has been involved in a vehement dispute with Appelbaum since 2007 about an alleged case of plagiarism.
From the German side, more people attempted to cannibalize the case against the Chaos Computer Club: On the site Antiprodukt.de, which is known for its unrestricted invectives, proudly declared once again, articulating the attempts by radical groups, to make the Congress and the Club to openly proclaim its world view. The Femgeeks affirmed the self-formulated question as to whether public shaming, as was the case with Appelbaum, is necessary.
The fact that the key witnesses have been outed as liars, is either ignored, or is dismissed as an assertion by supposed allies of Appelbaum, whose words have no meaning. Anne Roth is a feminist and a member of staff of the leftist faction of the NSA Committee of Enquiry, and a well-known person in the industry, whose one-time professions on (the importance of) data protection and privacy notwithstanding, did not let it prevent her from sharing the derogatory website with her over 25 000-strong followers. Afterwards she wrote: If you ask how rape affects the career and life of the perpetrator, ask the same question about the career and life of the victim.
She has nothing to say, however, about the victims of the Gizmodo key witnesses. The well-used maxim, “believe the victim” clearly seems to hold little water in these circles, when the victim does not fit into the narrative of the white, male Tech Scene, as synonymous with rape culture. For Gizmodo, the silence of the Germans, aiding and abetting, is no longer helpful, after the exposé: Yesterday Gawker, as a group, applied for creditor protection, and is now up for sale. The first offer by American Media House, Ziff Davis, is 90 Million Dollars. However, the buyer wants the project, but not the obligations to Hulk Hogan and other plaintiffs. To prevent further losses in court, the project clearly has to change, and that apparently includes the working methodology of the Gizmodo Editor, William Turton. He throws a spotlight on the reasons for the demise: Gawker left a risky subject to an 18-year-old, a subject that should have had an experienced touch, due to its scope and scale. Turton’s approach at Gawker was lauded as recently as April, with the words: “we share the same enthusiasm for conversational, accessible, honest reporting about the companies, people, technologies, and trends that are shaping our future”.
Two months later the “honest reporting” at Gawker, in the face of bankruptcy, is no longer a trend that that should shape the future. (Its) The rumour mill on the web. Activists are calling for an end to the persecution against Appelbaum, after the allegations against the activist Jacob Appelbaum were revealed to be a lie. The voices are growing louder from those who have had enough of the digital witch hunt. They are calling for a “minimum standard of ethics in the web and in the media”.

Nine years after a complex relationship, the computer scientist Leigh Honeywell wrote these words in her blog: “Believe Victims”. Before that a general reckoning with the ex-TOR employee Jacob Appelbaum, with whom she was romantically involved from 2006 – 2007, must ensue (must still take place). The allegations include actions, that were mostly very discourteous, but would certainly not be (deemed) criminal: During a ménage a trois, Appelbaum apparently ignored a word (request), that requested him to stop. She only became conscious of the fact that she was treated badly by Appelbaum, later, after she had fallen out with him: In Julian Assange’s suspected sexual harassment case, Honeywell and Appelbaum had differing viewpoints.
Journalism should examine facts thoroughly
Under normal circumstances, the loaded zeal (passion) in retelling the story, in the aftermath of a broken relationship, should (in itself) be a reason for treading carefully. “Believe the victims” is the credo of the new feminism, and Honeywell is a well-known member of its ranks. However, is it normally not the basic principle of journalism, which should examine carefully whether a victim really exists.(?) Leigh Honeywell writes (about) it anyway, and people believe her: (simply) because anonymous allegations are doing the rounds on a defamatory site.
The fact that Honeywell is now prepared to reveal filthy details, according to her viewpoint, makes her the object of reporting, from (the) American scandal media, to the Bavarian broadcaster, where several (of her) allegations are breathily repeated over soft music, in a sad telephone-sex- voice. After that the anonymously operating blogger “Natanji” at Femgeeks explains why defamatory sites are totally legitimate.
Sharp Backlash
Others (who) know Appelbaum a little longer, (and) have had totally different experiences : Under ourresponse.org, well-known representatives of the civil rights scene and its cultural division, published an open letter, which sharply states that they will go to court as a consequence of rumour-mongering and unsubstantiated accusations: „It has become clear the mainstream media are unwilling to fact-check, and only too willing to persist in spreading uncorroborated and unfalsifiable rumour. “
In the history of the internet shit storm, it hasn’t often happened, that women get together to counter-act rumours: In the case of Appelbaum, a line has clearly been crossed. The initiators (originators of the allegations) are not interested in denying the experiences of
others, but are rather (more interested in) broadcasting their own opinions. In the (their) actions, they see a case of pre-agreed character assassination, quite literally: character assassination. Like this (with this modus operandi), neither the truth, nor justice, can be achieved.
Debate, Based on Facts
The fact that Appelbaum is not an “easy” character, is not something they are trying to deny. They emphasize, however, that their experience of Appelbaum is very different, and that some people may interpret his often provocative statements, as insulting.
This makes it even more important to have an open debate, based on facts. Not only in the case of Appelbaum, who is increasingly becoming a victim of his own, provably false accusers, but in general, in order to obtain a fair trial: „Furiously targeting one person without allowing for proper fact analysis will never solve the bigger structural problem that has been highlighted. We should use this moment to grow and make things better, not destroy the movement and create divisions. “
In fact, the current case is only one in a long line of attempts to discredit the Tech- and Hacker scene as particularly sexist. Zündfunk (a broadcaster) is calculatedly using Anke Domscheidt-Berg as key witness for this, who already showed up the “Piraten” in public conflicts (in the past) with regard to alleged sexism. Also, Domscheit-Berg is in favour of anonymous “outers” on the internet; it’s exactly those circles who have been trying to force their behavioural codes on the Chaos Computer Club congresses for years, that are making a noise (now). Three years ago, due to so-called “creeper cards” it came to a conflict (row), where even door-opening men could be accused of sexism. The ferocity of the current disturbances (defamatory statements) can be understood in the context of the activities of the accusers, over a longer period of time.
Insofar (in this context), our response.org goes far beyond the current conflict: it is obvious that, also in future (situations), every real, exaggerated or made-up case is used, to gain influence and power. The attackers, and their allied media know how it goes.
An internet-broadcast keynote at the CCC congress, by Julian Assange was telephonically interrupted, and the interrupter spoke very obligingly (positively) about the SZ-Journalist, who was a co-worker on the Anne Wizoreck net project, who would have liked to prevent Assange’s performance (keynote speech).
Those who do not join in, are deemed apologists
This scene, because of the ever-present secret service and surveillance, has no resources for the same repetitive mud fights, and so the situation is unpleasant (for them). Those who do not believe the unseen victims, are branded as apologists, and paraded as an example of a group which closes itself to feminist ideology, (and are) against the necessary enhancements (strengthening of their cause) and growth they need. Hackers stand - thanks to the mantra-like repetitions of Anke Domscheit-Berg and her milieu - as a conspiratorial society of men who can handle computers better than women.
On this inherently sexist prejudice, the rumours of alleged abuse find fertile ground and grow well. With the intervention, which was signed by the human rights lawyer Renata Avila, the journalist Sarah Harrison and other well-known representatives of the civil rights movement, there is a clear signal to put an end to this prevalent persecution.
They promote a positive agenda in dealings around sexism and gender, without prejudices, and via a fair process for people who support civil rights. As it should be in a constitutional (legal) state, for normal citizens.
Abuse allegations against Jacob Appelbaum Day of reckoning
For years the hacker scene lauded Jacob Appelbaum as a hero. Now, there areserious allegations and many open accounts (issues). BERLIN taz – “ it is good to be able to enter into this crowd as a stranger, into this anarchistic, murky scene, to be able to look around, between the slushy machines, where neon-coloured ice drinks are stirred; between the dark monitors, bright programming characters (on the screens). Slowly, one gets an inkling, of what has meaning in this world, the hacker world.
Especially the liberation (self-liberation), in general, and the self-empowerment; and then, more concretely, the dark, and (partly) darkly made up eyes, the Tech parties, and sometimes also, sex parties. And, of course, the checksum algorithms, especially these. And then it’s good to leave again, get away from the madness. Lucky is the person who can do this, before the lines blur.
In this world, much too often, too many things get mixed up. But, its actually so easy: a checksum is a value, with which the integrity of data can be determined. It would make sense currently, for the upset global tech-, hacker- and nerd community, (if they) were to recall (remember) the simplest of insights. The war on Jacob Appelbaum has been raging for at least a week, at least what one has been able to observe publicly. Behind the scenes, in private meetings, in encrypted emails and chats, the battle has been going (on), against this man, for over a year already. The reasons for this are weighty: Jacob Appelbaum, one of the leading figures of the global anti-surveillance movement, supposedly repeatedly crossed the personal space of others, partly verbally, and partly sexually, according to the, mostly, anonymous allegations.
For one of the most prolific speakers on the scene, for (one of) the world’s most powerful digital resistance movements, it’s a bitter blow.
Appelbaum is one of the most prolific speakers on the scene. He played an important part in the publication of the Snowdon documents, exposed the surveillance around Angela Merkel’s cell phone, is in close contact with the inner circle of Wikileaks, and was the figurehead of the TOR network. It is an association of developers, that operates a software that lends anonymity, and in this way intends to make surveillance-free surfing and communication possible, one of the most important hacker networks in the world. On May 25, Appelbaum resigned from his very well paid job there, the pressure on him was too great. In this way he pre-empted being fired.
Since then the conflict situation became complicated, and as is common in this scene, when it comes to conflict, (that) it becomes cluttered, confusing, brash and hysterical. The main reason is that the allegations that had been previously made, were not public, or were semi-public; they were not intended for the police or the judiciary, but rather for the state-critical internet community, to be negotiated, traded and strengthened, like on a public market-place, to be discussed and refuted. In the end all parties carried some damage from this engagement (actions).
It is a fight for the final (basic) truth of a lauded hero, who was, (only very) recently celebrated: Is Jacob Appelbaum a rock star with flaws? Is he an arsehole and a crosser of
boundaries? Or is he, as some people mostly anonymously allege, a rapist? All of this is being publicly negotiated. “A rapist lives here”. How valid the allegations, of which the worst can hardly be proven, actually are (is unclear): The format of the presentation (the way facts are being presented), and how the situation is being handled, is tantamount to character assassination.
It is, on the contrary, the stated goal of this campaign, to exclude the former hero, or, as a hacker collective, where Appelbaum until recently was a member, wrote: ". We have separated him from the herd" On the building, in which Appelbaum last lived in Berlin, graffiti has been painted. In German and English: "A rapist lives here”.
It’s been a few days since a homepage was published, which runs on Appelbaum’s name, but is (actually) operated by his worst enemies. On this site, mostly anonymous people, make public allegations. Unknown people describe their experiences with Appelbaum. They paint the picture of a manipulative activist, who purposefully and repeatedly, ignores the physical and sexual boundaries of others. In feminist circles, this website is defended: How else, the women’s rights activists ask, could one stop the actions of perpetrators, when it is statistically proven that the judicial route is hardly ever effective in such cases?
However: Not only the souped-up website testifies to (a) lack of objectivity; also substantive submissions that were alleged, had to be rationalised or completely withdrawn. That does not mean that other allegations are false. However, it shows, in which way the so-called “community” goes to trial with itself; and this crosses boundaries.
The CCC Congress in Hamburg, in one of the few cases where the accusers did not act anonymously, and sketched a scene where Appelbaum, on the outskirts of the Hamburg annual congress of the Chaos Computer Club, allegedly publicly groped a woman.
However: The accusers did not even speak to the woman who was allegedly molested. She still has a close relationship with Appelbaum, and could not believe her eyes, when she read supposed reports about herself. And so, another piece appeared in the internet, in which this woman describes the situation from her perspective: that from her perspective, there was no problem with Appelbaum, on this night in the lobby of the Hamburg Radission Blu hotel. She wanted to know what problem the others had, and why strangers make allegations in her name. Also, other close female friends, and ex-girlfriends, defended Appelbaum vehemently. Does this mean that there is no truth to the allegations?
No. This all means nothing at this point, one way or the other. What can be taken as fact, is that the scene has been discussing, for a long time, about how to deal with Appelbaum -perceived by many as- brilliant, winning and succinct, but also seen as vain, egotistical and a man who crosses boundaries. Appelbaum has many enemies, so it comes as no surprise, that the whole scene is now going berserk, when after months and years, they were not able to find an appropriate way to deal with allegations and suspicions, whether justified or not. Jacob Appelbaum (himself) has contributed a great deal to this situation.
The fact that the group who still defend him today, is relatively small, can be attributed to the fact that he has made many enemies, with his uncompromising, tough judgmental and domineering (oppressive) approach.
And then there is this aspect: His speeches are great, his performances brilliant, he can reign over entire halls (audiences), even when he is not on-stage. And when he, praised and applauded, ended up in one of those strange bars, frequently surrounded by groupies and fan-boys, he often ended up going to somebody’s hotel room. And, why not?
Together with others, sometimes with (a) few people, sometimes in a group, sometimes with women, other times with men, but in a way that included outsiders (of the scene): this makes someone, who, without a doubt, has one of the most powerful enemies in the world, the NSA, very vulnerable to attack. Notwithstanding what may, or may not, have happened in these rooms: it was only a question of time until the system Appelbaum had (reported) an “error” message. There are people, who today are saying that they avoided certain parties, because they are not the types (sort of people) who enjoy sex parties. Others noticed too late what they had got themselves into, but they stayed anyway. And many partied there with great enjoyment. And then this happened, and that happened, and suddenly, in a drugged haze, the moment happened when the boundaries become blurred again, where “no” no longer meant “no”, but…? Yes, but what is to be expected (what can one expect)? This is the setting in which most of the accusations that exist today, were born (originated).
Restore justice? But, how? Perhaps one of the lessons to take from this situation, is that not everything that goes along with the idea of coolness and permissiveness (open-mindedness), is in fact cool and permissive. And when these boundaries once again blur, then maybe those who contributed to it, (and who) played their part. But especially the one who has crossed the boundaries of others. This is true for rock stars with quirks, for arseholes and also for tormentors. And it is true today, in exactly the same way to for all those who believe that justice can be restored, in a sea of unresolved accusations, in which it no longer seems important, whether the integrity of that information can be still be proven.
In a constitutional state, there is a rule: “Every person, who is accused of a crime, is seen as innocent, until the law proves their guilt”. This is not particularly revolutionary, but not everything, which is regulated by law, is bad. And therefore it is sometimes good to step out of this madness, out of that world in which the self-empowerment of some, leads to the oppression of others. Lucky is the one who succeeds, before everything goes totally wild and crazy again.

Herrn Van Huu Doan geb. am 24. April 1951 und
Frau Lisa Tran geboren am 15. März 1957
wohnhaft in 38126 Braunschweig, Helmstedter Str. 57 N
jedem allein, - nachstehend "der Bevollmächtigte" genannt -
V o l l m a c h t
zum Verkauf des folgenden Grundbesitzes:
Grundbuch des Amtsgerichts Braunschweig,
Gemarkung Rüningen, Flur 4, Flst. Nr. 89/80, 89/78 und 89/79,
eingetragen in den Wohnungsgrundbüchern von Rüningen Blatt
1283 bis 1327, und zwar insgesamt oder bezogen auf einzelne Wohnungen,
Grundstücke oder Grundstücksteile.
Der Bevollmächtigte ist insbesondere berechtigt, alle Erklärungen
gegenüber Privaten und Behörden abzugeben und entgegenzunehmen,
die zum Eigentumserwerb durch von ihm zu bestimmende
Dritte erforderlich oder zweckdienlich sind, insbesondere
die sämtlichen Kaufbedingungen nach seinem Ermessen festzulegen,
die Auflassung zu erklären, bei der Belastung des Grundstücks
mit sämtlichen im Grundbuch eintragungsfähigen Rechten mitzuwirken,
Grundpfandrechte in beliebiger Höhe zu bestellen, die dingliche
Zwangsvollstreckung gem. § 800 ZPO zu erklären, überhaupt alle Erklärungen
abzugeben, welche nach dem Ermessen des Bevollmächtigten
im Zusammenhang mit dem Kauf zweckdienlich sind.
Die Vollmacht gilt über den Tod hinaus. Der Bevollmächtigte ist berechtigt,
diese Vollmacht ganz oder teilweise auf einen Dritten zu
übertragen. Von den Beschränkungen des § 181 BGB ist der Bevollmächtigte
befreit.
II. Belehrungen
Der Notar hat auf den Vertrauenscharakter der erteilten Vollmacht
sowie darauf hingewiesen, dass die Vollmacht gegenüber Dritten
solange weiter gilt, wie der Bevollmächtigte eine Ausfertigung oder
die Urschrift in Händen hält.

Der Notar hat ferner darauf hingewiesen, dass der den Vertrag beurkundende
Notar seine Amtspflicht zur Erläuterung und Belehrung
des Inhaltes der beabsichtigten notariellen Urkunde bei persönlicher
Anwesenheit der Beteiligten am besten erfüllen kann.
Die vorbenannte Vollmachtserteilung wurde trotzdem gewünscht.
III. Schlussbestimmungen
Der Vollmachtgeber trägt die Kosten der Urkunde und bittet um Erteilung
je einer begl. Abschrift für sich und für den Bevollmächtigten.
Die Urschrift kann dem Bevollmächtigten ausgehändigt werden.

Power of Attorney
For the sale of the following Real Estate:
Land Registry of the District Court of Braunschweig,
District Rüningen, Hall / Passage 4, FLST. No. 89/80, 89/78 and 89/79,
registered in the residential Land Registers of Rüningen, pages
1283-1327, either in its entirety, or with regard to individual apartments,
land or land shares.
“The Plenipotentiary” is specifically authorized to deliver to all declarations,
to private persons and public authorities, and to receive official correspondence, for the purpose of the property purchase by third parties to be determined by him, as is deemed necessary or appropriate; in particular, to set the all purchase conditions at his discretion, to explain the conveyancing, the mortgaging, to collaborate in all legal actions allowed by the legally registered land rights, to apply for mortgages in any amount, to declare asset sequestration, according to § 800 ZPO, and, in general, is authorized to deliver all declarations, which, at the discretion of “the Plenipotentiary”, is deemed necessary with regard to the purchase.
The Power of Attorney is valid after / beyond death. “The Plenipotentiary” is authorized to transfer this Power wholly, or partly, to a third party. “The Plenipotentiary” is exempt from the restrictions of § 181 of the Civil Law Code (BGB).
II. Instructions
The Notary pointed out the confidential nature of the authorized Power of Attorney, and further pointed out that the Power of Attorney to third parties will apply, as long as the Plenipotentiary has a copy or the original in his possession.
The Notary has additionally noted, that the notarising Notary could best fulfill his official duty to explain and instruct the content of the proposed Notarial Deed in person. The presence of the parties can best meet. The aforesaid Power of Attorney was nonetheless preferred.
III. Final Provisions
“The Authorizer” pays the costs of the notarised document and requests a certified copy be handed out, to themselves and to the Plenipotentiary
The original can be handed out to the Plenipotentiary.
