Source text - English 5.3 Loss of or Damage to the Works
5.3.1 Can only accept liability for loss or damage to the WORKS, arising out of or relating to the performance of the CONSULTANCY CONTRACT, on a CONSULTANCY CONTRACT under which Amec Foster Wheeler has custody and control of the WORKS and then only:
(a) for loss or damage occurring during the period in which Amec Foster Wheeler has custody and control of the WORKS; and
(b) provided that the risk is covered by an appropriate Contractor’s All Risks (CAR) or Builder’s Risk / Installation insurance policy (BAR) (Amec Foster Wheeler Blanket / Base or project specific, and, where project specific, whether provided by Amec Foster Wheeler, the Client, or a Joint Venture in which Amec Foster Wheeler is a participant).

5.3.1 Solo se puede aceptar la responsabilidad por pérdida o daño de las OBRAS, que surgen o se relacionan del desarrollo del CONTRATO DE CONSULTORÍA, en un CONTRATO DE CONSULTORÍA donde Amec Foster Wheeler tiene la custodia y control de las OBRAS y:
(a) Por pérdida o daño que ocurre durante el periodo en el cual Amec Foster Wheeler tiene custodia y control de las OBRAS; y
(b) siempre y cuando que el riesgo sea cubierto por una póliza de seguros de instalación/riesgos del constructor (proyecto específico, Base/Seguro general Amec Foster Wheeler y, donde el proyecto específico, ya sea proporcionado por Amec Foster Wheeler, el cliente o un partícipe en negocio conjunto en donde Amec Foster Wheeler es participante).
