Essa reforma visa limitar o poder da Suprema Corte local para anular medidas tomadas pelo Poder Executivo.
A partir de agora, em decisões desse tipo, o tribunal não poderá mais utilizar o critério jurídico da "razoabilidade", que antes era usado para questionar ações do governo e bloquear nomeações ministeriais. No entanto, a Corte ainda terá o poder de anular condutas governamentais utilizando outras medidas legais. As informações foram relatadas pelo Estadão.
O conceito de "razoabilidade" nunca foi definido explicitamente em lei escrita, mas os juízes israelenses geralmente o consideravam como uma decisão tomada sem levar em conta todos os aspectos relevantes ou sem dar a devida importância a cada um deles. Translation - Portuguese On Monday (24/7), the Knesset, Israel's Parliament, approved part of the proposed judicial reform put forth by Prime Minister Benjamin Netanyahu's government. This reform aims to limit the power of the local Supreme Court to overturn measures taken by the Executive branch.
From now on, in such decisions, the court will no longer be able to use the legal standard of "reasonableness," which was previously employed to challenge government actions and block ministerial appointments. However, the Court will still have the authority to nullify government conduct using other legal means. This information was reported by Estadão.
The concept of "reasonableness" was never explicitly defined in written law, but Israeli judges commonly considered it as a decision made without taking all relevant issues into account or without giving proper weight to each of them. Supporters of the reform argued that this standard was too subjective and allowed for excessive judicial interference.
The approval of this law marks Netanyahu's first victory after a seven-month effort. In the previous month of March, due to significant protests on the streets and unrest within the Armed Forces, the Prime Minister's coalition had already suspended previous plans that would have granted the Knesset the power to overturn Supreme Court decisions and increased government influence over the appointment of judges to the Court.
