Source text - Portuguese O presente trabalho tem por objetivo denotar um panorama da situação fática do aborto no Brasil, com enfoque no atendimento às gestantes que necessitem do procedimento abortivo. Por meio da análise de estatísticas e de depoimentos de profissionais da saúde, percebeu-se que há dificuldade de acesso tanto à informação acerca do direito ao aborto legal como ao procedimento em si para vítimas de violência sexual diante da pouquíssima quantidade de clínicas registradas. A respeito dos abortos seletivos, constatou-se que, ainda que exista na jurisprudência do Supremo Tribunal Federal jurisprudência cabível de aplicação direta ou por analogia ao caso concreto, existe muita resistência ainda no Poder Judiciário de se permitir o aborto piedoso baseado somente na opinião de mais de um médico. Apesar disso, o cenário é promissor haja vista muitos magistrados estão embasando suas decisões mais forte e confiantemente nos pareceres clínicos. Verificou-se através de estudos psicológicos que abortantes por motivo humanitário e por seletividade baseada em piedade possuem grau de dano psicológico similar e apresentam sintomas afins como ansiedade, episódios depressivos, sensação de culpa, medo e angústia constantes. Pôde-se observar também que a burocratização para se conseguir um procedimento de aborto seletivo por via judicial é prejudicial às gestantes ante o alto grau de risco de gestação de um feto portador de anomalia congênita e a morosidade do sistema de Justiça, graças à qual a possibilidade de se perder o principal objeto da ação ou recurso é grande. No mais, analisou-se que há poucos advogados voltados à área da Bioética e do Direito Médico quando a demanda na área é cada vez maior, em especial em ações contra o ramo da obstetrícia; também se analisou que o pouco conhecimento do profissional do Direito acerca das condições patológicas quando diante do caso concreto prejudica o processo de convencimento do magistrado, pois impossibilita uma defesa completamente segura.
Translation - English This paper aims to provide an overview of the factual situation of abortion in Brazil, focusing on the care of pregnant women who need the abortion procedure. Through the analysis of statistics and testimonies of health professionals, it was noticed that there is difficulty in accessing both information about the right to legal abortion and the procedure itself for victims of sexual violence, given the very few registered clinics. Regarding selective abortions, it was found that, although there is in the Supreme Court jurisprudence applicable directly or by analogy to the specific case, there is still much resistance in the Judiciary to allow pious abortion based only on the opinion of more than one doctor. Despite this, the scenario is promising as many magistrates are basing their decisions more strongly and confidently on clinical opinions. It was found through psychological studies that abortions for humanitarian reasons and for pity-based selectivity have a similar degree of psychological damage and have similar symptoms such as anxiety, depressive episodes, feelings of guilt, fear and constant anguish. It could also be observed that the bureaucratization to obtain a selective abortion procedure through the courts is harmful to pregnant women, given the high risk of pregnancy of a fetus with a congenital anomaly and the slowness of the justice system, thanks to which the The possibility of losing the main object of the action is great. Furthermore, it was analyzed that there are few lawyers focused on the area of Bioethics and Medical Law when the demand in the area is increasing, especially in lawsuits against the field of obstetrics; it was also analyzed that the lack of knowledge of the legal professional about the pathological conditions when faced with the concrete case prejudices the process of convincing the magistrate, as it makes a completely safe defense impossible.
