1.1 Кратко описание на предложения проект.
ЕТ “Александър Ковачев” е регистрирана през 1992 и вече 14 години извършва полиграфически услуги. Първоначалното оборудванене на фирмата са 2 копирни апарата. Днес фирмата разполага с три печатни машини и допълнителна техника за производствения процес. През 2002 година бе построена нова печатна база с площ 800 кв.м и административен офис от 120 кв.м. През 2005 г. е открито представителство на фирмата в гр.София.
ЕТ “Александър Ковачев” е малка фирма и в своето развитие се сблъсква с многобройни трудности и предизвикателства, съпътстващи всички малки и средни предприятия в страната – липсата на финансови възможности за внедряване на модерни машини и технологии, международно признати стандарти, управление на качеството, инвестиране в човешки капитал.
Основната цел, която сме си поставили при разработване на проект “Професионално обучение и преквалификация на работната сила в условията на модернизиран производствен процес – алтернатива за създаване на заетост и устойчиво развитие на ЕТ “Александър Ковачев” е:
Да се повиши пригодността за заетост, адаптивността и конкурентноспособността на работната сила чрез професионално обучение и преквалификация в сферата на полиграфията, с цел разкриване на нови работни места и намаляване на безработицата и социалната изолация в регион Силистра.
Проектното предложение е разработено на основата на комбинация от професионално обучение, консултантски услуги и инвестиционно подпомагане:
професионално обучение на безработни и заети във фирмата лица
въвеждане на система за управление на човешките ресурси.
закупуване на машини за модернизиране на производствения процес;
обновяване и преустройство на производствената база с цел разширяване на производството и разкриване на нови работни места
Изборът на тези елементи е обоснован от основната стратегическа цел на фирмата-да се превърне в модерна, просперираща фирма от европейски тип с висококвалифицирани кадри, модерно оборудване, съвременни технологии и качество в съответствие с европейските норми и стандарти
По елемента за професионално обучение сме планирали следните курсове:
• Начално професионално обучение за придобиване на квалификация по част от професия “Полиграфист” за безработни лица
• Непрекъснато професионално обучение за актуализиране или разширяване на придобита професионална квалификация за работещите във фирмата лица за част от професия “Полиграфист” и “Оператор на компютър-компютърен график” за целите на полиграфията.
Курсове са съобразени с образователното и квалификационно ниво на целевите групи, както и рамкови програми Д и Е за обучение на лица над 16 г.
Идеята на предвидените консултантски услуги е фирмата да бъде подпомогната в създаване на стратегии и политики за управление на персонала – предпоставка за успешен бизнес.За целите на проекта ще бъде наета консултантска фирма Асоциация за трансгранично сътрудничество “Дунавска Добруджа”Силистра, която ще анализира дългосрочните перспективи за развитието на фирмата и разработи стратегии за адаптивността на предприятието и гъвкава организация на труда.
Нарастналия брой поръчки и недостатъчния производствен капацитет налагат да се реконструира производствената база и дооборудва с по-високо производителна и качествена техника. Това предопределя и разкриването на нови работни места. Предвидените СМР включват: ремонт на втория етаж на печатната база и изграждане на отоплителна инсталация. Планираме доставка на цифрова печатна машина, чрез която малотиражни поръчки ще станат икономически изгодни. Това ще рефлектира върху повишаване на производителността, обема на продажбите и респективно увеличаване финансовия капацитет на фирмата и нейният просперитет.

1.1 Brief description of the proposed action.
ST “Aleksandar Kovachev” is registered in 1992 and for 14 years it performs polygraphic services. The first equipment of the firm was 2 copying machines. Today the firm has three copying machines and additional equipment for the production process. In 2002 a new printing base was built on area of 800 m2 and an administrative office of 120 m2. In 2005 an office of the firm was opened in Sofia.
ST “Aleksandar Kovachev” is a small firm and on its way it encountered many difficulties and challenges, which accompany all small and medium size enterprises in the country – the lack of financial possibilities for introducing modern machines and technologies, internationally accepted standards, management of production, investing in human capital.
The main objective we have set to ourselves in the development of this project “Professional training and prequalification of manpower in the conditions of modernized production process – an alternative for creating employment and steady development of ST “Aleksandar Kovachev”” is:
To increase the suitability for employment, adaptiveness and competitiveness of manpower through professional training and prequalification in the sphere of polygraphy, with the aim to open new places of work and decrease the unemployment and social isolation in the region of Silistra.
The project offer is developed on the basis of combination between professional training, consultative services and investment support:
professional training of unemployed people and people engaged in the firm;
introducing a system of management of the human resources;
buying machines for the modernization of the production process;
renewal and reorganization of the production base with the aim of widening the production and opening new places of work.
The choice of these elements is based on the main strategic objective of the firm – to turn into a modern, prosperous firm of European type, having highly qualified personnel, modern equipment, contemporary technology and quality up to European norms and standards.
On the element of professional training we have planned the following courses:
• Basic professional training for acquiring a qualification as part of the “Polygraphist” profession for unemployed people
• Constant professional training for renewing or expanding the acquired professional qualification for the personnel working in the firm for part of the “Polygraphist” profession and “Operator of computer – computer graphic” for the aims of polygraphy.
The courses are consistent with the educational and qualification level of the target groups, as well as the frame programs D and E for training people over 16 years of age..
The idea of planned consultative services is the firm to be assisted in creating strategies and polices for management of the personnel – a prerequisite for successful business. For the objectives of the project a consultative firm will be hired: – Association for across-boarder cooperation “Dunavska Dobrudja” Silistra. Thus long term perspectives for the development of the firm will be realized and strategies for the adaptiveness of the enterprise and the flexible organization of work will be developed.
The growing number of orders and the insufficient production capacity compel us to reconstruct the production base and to equip it with more highly productive and qualitative machinery. This predetermines the opening of new places of work too. The planned (CAW) construction assembling works include: repair of the second floor of the printing base and building a heating installation. We plan the delivery of a digital printing machine with which small-circulation orders will become economically profitable. This will reflect on increasing the productivity, the volume of sales and respectively increasing the financial capacity of the firm and its prosperity.

General principles
Article 1.
(1) The non-profit Association Bulgaria – Switzerland “Lui Ayer”, Rousse, is an independent, non-political association and it is an assignee of the Bulgarian – Swiss Association “Liu Ayer”, registered in 1991 on firm case No: 4601 of the Law for Persons and Family /LPF/ and it keeps its author’s rights over its old name. The Association Bulgaria – Switzerland “Lui Ayer”, Rousse, called further down briefly “The association” is a juridical person in accordance with the regulations of the Law for Juridical Persons with Non-economic Aim /LJPNA/ in private benefit.
(2) The association will realize its activity according to this Statute, the decisions of the Board of Managers, the General Assembly of the Association and in conformity with the Bulgarian Legislation.
(3) The non-profit Association Bulgaria – Switzerland “Lui Ayer” is a separate one and is responsible for its duties with its own property, its members are responsible for its duties only up to the amount of the stipulated in this statute property fees, Name:
Article 2. (1) The association will realize its activity under the name Non-profit Association Bulgaria – Switzerland “Lui Ayer” and will be written for short in Bulgarian or in a foreign language – Association Bulgaria – Switzerland “Lui Ayer”. Place of seat

Article 4.(А) The Association has an aim to help in the development of the economic, industrial, agricultural, financial, scientific and technical, technological, social, medical, humanitarian relations, as well as in the sphere of tourism, law, banking, credit and insurance, culture, education, history, art and sport between Bulgaria and Switzerland, and if interest is shown also with other countries.
(B) To help the development of its members in all respect, if their activity does not contradict the law.
(C) To help and finance the development of talented children, young boys and girls, members of the association.
(D) To establish and develop: children’s, adolescents’ (pupils’), youths’ (students’) and other age interest group sections.
(E) To create work sections (commissions) according to interests for working on different programs and projects, also on ideas of its members, of Bulgarian and Swiss Institutions and Organizations as well as other countries in the interest of its members, the association, on local, national and international level.
(1) To help every institution for economic, financial, trade-and-industrial, agricultural, scientific and technical, technological, social, legal, medical, of forest industry, humanitarian, tourist, cultural, educational, and sporting activity, arising form Bulgarian or Swiss side, trade company, scientific or cultural institute, association, union, organization, physical or juridical person, whose target is to develop the cooperation between the two countries and which does not contradict to their constitution and legislation.
(2) To make, distribute and explain among its members and interested parties the economic, financial, trade-and-industrial, agricultural, scientific and technical, technological, social, medical, of forest industry, humanitarian, legal, sociological, tourist, educational, cultural and sporting information and materials, fresh news in the home trade regime and currency-financial conditions in the two countries, to organize, analyze and provide sociologic, marketing and other kind of studies. To organize and help for the organization of business meetings, symposiums, seminars, exhibitions and fairs of agricultural, forestry, industrial and other productions and works of art, history, archaeology, numismatics. As well as the achievements in the field of scientific and technical progress and cooperation in the field of law, sociology, culture, education, sport, medicine.
( 3) To cooperate with the government organs and institutions as well as with non-government organizations, civil and other forms of unions in the two countries in order to solve problems of mutual interest, for legal regulation of the trading, scientific, sociological, cultural, educational and other relations between partners in the two countries and for establishing favourable conditions for the development of economic, scientific and technical, cultural, educational and other forms, supporting the establishing of developed civil society, by means of taking part in and organizing joint event.
( 4 ) To cooperate with the Bulgarian Chamber of Commerce and Industry, the Bulgarian Economic Chamber, other Chambers of commerce, Houses and other economic and scientific forms and associations between Bulgaria, Switzerland and other countries. To cooperate with all similar associations and societies in Bulgaria, Switzerland and other countries when a contact of mutual interest is established. To support in the spirit of goodwill for settling disputes which had arisen between partners of the two countries.
( 5 ) The Association Bulgaria – Switzerland “Lui Ayer” shares the principles of the BRC –Bulgarian Red Cross and the International Red Cross for: Humanism, Objectivity, Neutrality, Independence, Voluntariness, Unanimity, Universality and will support their highly human activity. Political parties and movements cannot be members of the Association.

Source text - English Article 9 – Termination of Contract
In case that the buyer fails or does not want to observe any provision of this contract, the commissioner will be allowed 10 days after its notice in writing cause the contract termination on behalf of both parties without any requirement for referring to judiciary authorities and the buyer hereby waives its right to make any claim or complaint against the contract termination in that event. Termination shall be announced to the buyer through a letter.
Article 10 – Force Majeures
The results of force majeures such as floods, earthquake, water and similar unpredicted accidents shall bring no obligation for the parties to this contract.
Article 11 – Other Conditions
11-1 Obligations of Buyer
11-1-1 The buyer is not allowed to transfer the obligations arising from this contract to other real or legal persons.
11-1-2 By signing this contract, the buyer alleges that it has purchased the goods for exportation and it is not allowed to offer the goods inside the country. Whenever, the buyer takes any action on contrary to this clause, the commissioner will have the right to stop loading and shipping and terminate the contract.
11-1-3 If case of non-discharge of the goods equal to ... tons for three months, the commissioner will be authorized to terminate the contract one week after its notice in writing and non-solution of the problem.
11-1-4 The buyer undertakes not to purchase the goods subject of this contract from any other supplier in the country of origin (I...) during the effective period of this contract. Otherwise, the commission will be allowed to terminate the contract one week after its notice to the buyer in writing by presenting supporting documents and without any necessity to refer the case to the judiciary authorities. In this event, the commissioner will have the right to claim ...аs penalty per tonn of contract quantity.

В случай, че купувачът наруши или не желае да спазва която и да е от клаузите на настоящия договор, на комисионерът ще са позволени 10 дни, след което неговото писмено известие ще доведе до прекратяването на договора, от името на двете страни и без никакви условия/претенции за отнасяне на спора към съда и купувачът се отказва от правото си да предяви жалба или оплакване срещу прекратяването на договора, в този случай. Прекратяването ще бъде обявено на купувачът посредством писмо.
Точка 10 - Форсмажорни обстоятелства
Резултатите от форсмажори като наводнения, земетресения, водни и др. подобни непредсказуеми инциденти, няма да доведат до никакви задължения за страните по договора.
Точка 11 - Други условия
11-1 Задължения на Купувача
11-1-1 На Купувача не се позволява да прехвърля задълженията си, произлизащи от този договор на други физически или юридически лица.
11-1-2 С подписването на този договор купувачът заявява, че е закупил стоката за износ и не му е позволено да предлага стоката вътре в страната. Ако купувачът предприеме действие в противоречие на тази клауза, комисионерът ще има право да спре зареждането и товаренето и да прекрати договора.
11-1-3 В случай на неразтоварване на стоката отговаряща на ... тона в рамките на 3 месеца, комисионерът ще бъде оторизиран да прекрати договора една седмица след неговото писмено известие и несвоевременното решаване на проблема.
11-1-4 Купувачът гарантира да не зaкупува стоката, предмет на този договор, от никой друг доставчик в страната от където произхожда /И..../ в продължение на ефективния период на този договор. В противен случай на комисионерът ще бъде позволено да прекрати договора една седмица след предварителното известяване на Купувачът в писмен вид, посредством представяне на поддържащи документи и без никаква необходимост да се отнася случая до съдебните власти. В този случай, комисионерът ще има право за предявяване на глоба от ...на тон от договореното количество.
