Les membres pourront exclure de la brevetabilité les inventions dont il est nécessaire d’empêcher l’exploitation commerciale sur leur territoire pour protéger l’ordre public ou la moralité, y compris pour protéger la santé et la vie des personnes et des animaux ou préserver les végétaux, ou pour éviter de graves atteintes à l’environnement, à condition que cette exclusion **ne tienne pas uniquement au fait que l’exploitation** est interdite par leur législation.

neutral  Alan Muscat: Interesting. Do you think though that it might mean "... provided that such exclusion is inapplicable due to the fact that (financial) exploitation is prohibited/illegal" (for other reasons). I am notsure because I am not that "au fait" in French legalese
