Em razão do princípio dispositivo, que impede o Juíz agir de ofício e do princípio do contraditório, pelo qual é preciso que o autor exponha os fatos para que o réu possa defender-se, objetivando possibilitar a justa e completa prestação jurisdicional requerida, é preciso que o autor narre de modo lógico e comprove os acontecimentos ocorridos, os quais, segundo seu entendimento, geraram a violação do direito dos credores.

The case law on the princípio dispositivo in Brazil goes back to Article 130 of the Code of Civil Procedure, which indicates that the decision to determine whether evidence is relevant is the judge's, either sua sponte or at a party's motion.
