Но между discretion и do so fairly должна быть запятая, а не частица to, имхо :)

Вначале нужно правильно расставить знаки препинания. По-моему, после "if authorised to certify, determine or exercise discretion" должна быть пауза, обозначенная тире или запятой:
"if authorised to certify, determine or exercise discretion — to do so fairly between the Client and third party ..."
Тогда смысл предложения становится понятен:
"Будучи уполномоченным(и) удостоверять, констатировать, или предпринимать какие-либо действия — делать (выполнять, осуществлять) это на справедливой основе..."
